The guidance was\u00a0released last year by the Education Department and the\u00a0Equal Employment Opportunity Commission.<\/p>\n<p>\u201cAs it currently stands, plaintiffs must choose between the threat of legal consequences \u2014 enforcement action, civil penalties, and the withholding of federal funding \u2014 or altering their state laws to ensure compliance with the guidance and avoid such adverse action,\u201d\u00a0Atchley, a Trump appointee, <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/TennesseeOrderOpinionPI.pdf\">wrote<\/a>\u00a0in his\u00a0preliminary injunction.<\/p>\n<p>The Biden administration inappropriately invoked the\u00a0Supreme Court\u2019s 2020 ruling in <em>Bostock v. Clayton County<\/em>, a case that dealt with transgender employment, the judge said.<\/p>\n<p>In the <em>Bostock<\/em> majority opinion, Justice Neil Gorsuch included a caveat about the scope of the court\u2019s decision.<\/p>\n<p>\u201cThey say sex-segregated bathrooms, locker rooms, and dress codes will prove unsustainable after our decision today but none of these other laws are before us; we have not had the benefit of adversarial testing about the meaning of their terms, and we do not prejudge any such question today,\u201d Gorsuch wrote.<\/p>\n<p>Atchley wrote that, \u201cin applying <em>Bostock<\/em> to Title IX, the Department overlooked the caveats expressly recognized by the Supreme Court and created new law.\u201d<\/p>\n<p>The judge cited Tennessee\u2019s laws, which organize school sports teams by \u201cthe student\u2019s sex at the time of the student\u2019s birth\u201d and allow students and employees to sue a school that deliberately allows people of the opposite sex use a single-sex bathroom.<\/p>\n<p>Atchley declared that at least 10 of the 20 states have demonstrated that there is a concrete and imminent\u00a0threat to their ability to enforce their state laws. That threat is \u201cfairly traceable\u201d back to the guidelines, the judge said.<\/p>\n<p>Last week\u2019s ruling marks a major victory for the\u00a0group of Republican attorneys general who\u00a0sued the administration last summer over the guidance. The group is\u00a0led by Tennessee Attorney General Herbert Slattery.<\/p>\n<p>The Alliance Defending Freedom applauded the ruling. The conservative legal group has filed a motion to intervene in the lawsuit on behalf of three female student athletes and a Christian schools association.<\/p>\n<p>\u201cGirls involved in sports deserve the opportunity to compete on a safe and fair playing field against other female athletes. The court was right to find that the Biden administration exceeded its authority in issuing orders that jeopardize fair play,\u201d ADF Senior Counsel Jonathan Scruggs said.<\/p>\n<p>\u201cThe Biden administration\u2019s radical push to redefine sex in federal law\u2014and without the required public comment period\u2014threatens to erase women\u2019s sports and eliminate the opportunities for women that Title IX was intended to protect. We are pleased that female athletes will be protected in 20 states while this lawsuit moves forward,\u201d he added.<\/p>\n<p>Meanwhile, the Human Rights Campaign bashed the ruling, calling it \u201canother example of far-right judges legislating from the bench.\u201d<\/p>\n<p>\u201cHRC will continue to fight these anti-transgender rulings with every tool in our toolbox,\u201d said the group, the largest LGBT advocacy and political lobbying organization in the country.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A federal judge has temporarily blocked the Biden administration\u2019s Title IX guidance on gender identity and sexual orientation.
