{"id":1564100,"date":"2022-07-21T08:05:19","date_gmt":"2022-07-21T12:05:19","guid":{"rendered":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/?p=1564100"},"modified":"2022-07-21T08:05:27","modified_gmt":"2022-07-21T12:05:27","slug":"justice-wont-be-served-in-spygate-without-john-durham-investigating-more-confidential-human-sources","status":"publish","type":"post","link":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justice-wont-be-served-in-spygate-without-john-durham-investigating-more-confidential-human-sources\/","title":{"rendered":"Justice Won\u2019t Be Served In SpyGate Without John Durham Investigating More Confidential Human Sources"},"content":{"rendered":"<aside class=\"mashsb-container mashsb-main mashsb-stretched\"><div class=\"mashsb-box\"><div class=\"mashsb-count mash-medium\" style=\"&quot;\"><div class=\"counts mashsbcount\">28<\/div><span class=\"mashsb-sharetext\">SHARES<\/span><\/div><div class=\"mashsb-buttons\"><a class=\"mashicon-facebook mash-medium mash-nomargin mashsb-noshadow\" href=\"https:\/\/www.facebook.com\/sharer.php?u=https%3A%2F%2Fwww.conservativenewsdaily.net%2Fbreaking-news%2Fjustice-wont-be-served-in-spygate-without-john-durham-investigating-more-confidential-human-sources%2F\" target=\"_top\" rel=\"nofollow\"><span class=\"icon\"><\/span><span class=\"text\">Facebook<\/span><\/a><a class=\"mashicon-twitter mash-medium mash-nomargin mashsb-noshadow\" href=\"https:\/\/twitter.com\/intent\/tweet?text=&amp;url=https:\/\/www.conservativenewsdaily.net\/breaking-news\/?p=1564100&amp;via=ConservNewsDly\" target=\"_top\" rel=\"nofollow\"><span class=\"icon\"><\/span><span class=\"text\">Twitter<\/span><\/a><a class=\"mashicon-subscribe mash-medium mash-nomargin mashsb-noshadow\" href=\"#\" target=\"_top\" rel=\"nofollow\"><span class=\"icon\"><\/span><span class=\"text\">Subscribe<\/span><\/a><div class=\"onoffswitch2 mash-medium mashsb-noshadow\" style=\"display:none\"><\/div><\/div>\n            <\/div>\n                <div style=\"clear:both\"><\/div><\/aside>\n            <!-- Share buttons by mashshare.net - Version: 4.0.47--><p>The Crossfire Hurricane and Robert Mueller Special Counsel teams undisputedly had a problem with confidential human sources, or \u201cCHS.\u201d The question remains whether John Durham\u2019s team also has a problem \u2014 with double-standards.<\/p>\n<p>Yesterday, The Federalist <a href=\"https:\/\/thefederalist.com\/2022\/07\/20\/judge-in-stefan-halper-case-drops-spygate-bombshell-in-denying-his-motion-to-dismiss-halper-likely-lied-to-the-fbi-on-purpose\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> that on Friday a federal judge concluded, \u201c[D]ocuments suggest that Stefan Halper \u2018may have made clear misstatements to the FBI\u2019 and may be responsible for \u2018some falsehoods\u2019 about Michael Flynn and Svetlana Lokhova\u2026\u201d The judge\u2019s comments came during proceedings in Lokhova\u2019s defamation case against Halper, with the potential \u201cmisstatements\u201d and \u201cfalsehoods\u201d concerning Halper\u2019s interviews with FBI agents in August of 2016.\u00a0<\/p>\n<p>According to electronic communications documenting the agents\u2019 interview with Halper on August 11, 2016, Halper claimed to have witnessed Lokhova leave a dinner with Flynn, after which she \u201csurprised everyone and got into [Flynn\u2019s] cab and joined [Flynn] on the train ride to London.\u201d Halper further \u201crecalled that LOKHOVA \u2018latched\u2019 onto Flynn when he was at the [dinner.].\u201d <\/p>\n<p>The FBI\u2019s summary of Halper\u2019s comments added that he claimed to be \u201csomewhat suspicious of LOKHOVA\u201d and that he \u201cbelieves that LOKHOVA\u2019S father may be a Russian Oligarch living in London.\u201d Halper repeated the story of Lokhova joining Flynn in a cab the next day during a second interview. But contrary to Halper\u2019s claims, he did not attend the dinner at which Flynn spoke, Lokhova did not leave the dinner with Flynn, and she did not jump into a cab with him nor accompany him to London on the train.<\/p>\n<p>In addition to Halper\u2019s alleged lies to the FBI, Lokhova claims he repeated his false allegations about her and \u201cGeneral Flynn to various members of the media who, upon information and belief, include, among others, journalists working for the Wall Street Journal, the Guardian, the New York Times, and the Washington Post.\u201d In turn, according to Lokhova\u2019s lawsuit, \u201cmany commentators, from national television hosts to ordinary citizens on social media, credited the false allegations that Plaintiff was a Russian spy who had ensnared General Flynn in a sexual or romantic imbroglio at the behest of the Kremlin.\u201d Further, Lokhova\u2019s complaint alleged, Halper\u2019s claims to the FBI were \u201ca key reason why the FBI opened a subpart of [the Crossfire Hurricane] investigation that specifically focused on General Flynn,\u201d with the FBI targeting Flynn within days of Halper framing Lokhova as a honeypot.<\/p>\n<p>The Federalist further revealed on Wednesday that the same electronic communications indicate Halper had lied to the FBI about former Trump adviser Carter Page. Specifically, the summary of the FBI\u2019s debriefing with Halper documented Halper telling agents that he met privately with Page around July 18, 2016, and that \u201cthe purpose of the meeting was to ask the CHS if s\/he would want to join the Trump campaign as a foreign policy adviser.\u201d <\/p>\n<p>In an <a href=\"https:\/\/thefederalist.com\/2020\/01\/08\/exclusive-carter-page-interview-raises-new-questions-about-inaccuracy-laden-ig-report\/\" target=\"_blank\" rel=\"noreferrer noopener\">exclusive interview<\/a> with The Federalist in 2020, however, Page, who had not yet seen the electronic communications, unequivocally denied asking Halper \u201cto be a foreign policy advisor for the Trump campaign.\u201d \u201cIt is possible,\u201d Page acknowledged at the time, \u201cthat they explored some ways Halper might get involved indirectly at some point down the road,\u201d but it is \u201can extraordinary mischaracterization,\u201d to say that he had asked Halper \u201cto be a foreign policy advisor for the Trump campaign.\u201d<\/p>\n<p>Halper, however, was not the only problematic CHS involved in the investigation into Donald Trump\u2019s supposed collusion with Russia. Christopher Steele, who had served as a CHS since 2013, reached out to his handler, Michael Gaeta, about Steele\u2019s supposed \u201cintel\u201d on Trump. On July 5, 2016, Steele met with Gaeta, the later of whom was stationed in Rome at the time, <a href=\"https:\/\/www.realclearinvestigations.com\/articles\/2020\/02\/13\/buried_in_ig_report_fbi_gave_steele_highly_protected_secrets_122394.html#!\" target=\"_blank\" rel=\"noreferrer noopener\">telling<\/a> Gaeta about Trump\u2019s supposed concerning connections with Russia. Steele would later provide Gaeta with various memos that have since became known as the Steele dossier, with Gaeta in late July <a href=\"https:\/\/thefederalist.com\/2020\/03\/02\/leak-of-crossfire-hurricane-agents-identity-to-the-nyt-suggests-more-to-come\/\" target=\"_blank\" rel=\"noreferrer noopener\">sending<\/a> multiple memos to the New York Field Office.<\/p>\n<h2>The Christopher Steele Problem<\/h2>\n<p>Special Counsel John Durham\u2019s November 2021 indictment of Igor Danchenko on <a href=\"https:\/\/thefederalist.com\/2022\/06\/03\/why-the-special-counsel-needs-to-fight-for-more-spygate-documents-stat\/\" target=\"_blank\" rel=\"noreferrer noopener\">charges<\/a> that Danchenko lied to the FBI during questioning \u201crelated to his role as Steele\u2019s \u2018Primary Sub-Source\u2019 for the notorious dossier that enabled Obama administration surveillance of the Trump campaign,\u201d reveals one major problem with Steele serving as a CHS: Steele\u2019s reporting was contrived.\u00a0<\/p>\n<p>But the inaccuracy of Steele\u2019s reporting forms but one problem with this second CHS. Steele, in conflict with bureau policies, \u201c<a href=\"https:\/\/dailycaller.com\/2021\/01\/17\/christopher-steele-michael-gaeta-dossier-fbi-untrustworthy\/\" target=\"_blank\" rel=\"noreferrer noopener\">began<\/a> meeting with journalists regarding information from his dossier in September 2016. Fusion GPS, the firm that hired Steele on behalf of the Clinton campaign and DNC, arranged the briefings with reporters from The New York Times, Washington Post, New Yorker, Mother Jones and Yahoo! News.\u201d Gaeta would later testify before Congress that he confronted Steele about the Mother Jones article and then cut him off as a CHS, <a href=\"https:\/\/dailycaller.com\/2021\/01\/17\/christopher-steele-michael-gaeta-dossier-fbi-untrustworthy\/\" target=\"_blank\" rel=\"noreferrer noopener\">explaining<\/a> that by going to the media, \u201cIt told [him] that Steele was completely untrustworthy at that point as a source and could not be handled and would not be reliable.\u201d\u00a0<\/p>\n<p>Yet after terminating Steele as a CHS, the FBI continued to use Steele\u2019s \u201cintel,\u201d with the fired CHS \u2014 instead of providing his reports to his handler \u2014 giving updates to Justice Department lawyer Bruce Ohr, who in turned shared Steele\u2019s information with the FBI in a series of more than 12 interviews, including ones that <a href=\"https:\/\/thefederalist.com\/2019\/03\/11\/11-key-things-inside-house-interview-spygate-figure-bruce-ohr\/\" target=\"_blank\" rel=\"noreferrer noopener\">post-dated<\/a> both the election and the appointment of Mueller as a special counsel.<\/p>\n<p>But it wasn\u2019t merely that Steele peddled the dossier to the media in violation of FBI policy. \u201cOne FBI agent <a href=\"https:\/\/dailycaller.com\/2021\/01\/17\/christopher-steele-michael-gaeta-dossier-fbi-untrustworthy\/\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a> the Justice Department inspector general that Steele \u2018clearly\u2019 hadn\u2019t been truthful with FBI agents regarding his contacts with journalists.\u201d The Foreign Intelligence Surveillance Act application submitted to the FISA court to obtain an order to surveil Page suggests the same, with the DOJ telling the FISA court that Steele \u201ctold the FBI that he\/she only provided this information to the business associate and the FBI.\u201d <\/p>\n<p>Then after noting the consistency between the Steele dossier and a Yahoo! News article from September 23, 2016, the FISA application stated the FBI assessed that Steele\u2019s \u201cbusiness associate or the law firm that hired the business associate likely provided this information to the press,\u201d and that the FBI did not believe that Steele \u201cdirectly provided this information to the press.\u201d<\/p>\n<p>However, as Jason Beale <a href=\"https:\/\/thefederalist.com\/2018\/07\/25\/suspicious-fbi-doj-didnt-check-christopher-steeles-leaks-press\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> at The Federalist, \u201cIt is now public knowledge that Christopher Steele was the \u2018well-placed Western intelligence\u2019 source of Michael Isikoff\u2019s September 2016 Yahoo News article. He admitted as much in a deposition to a United Kingdom court in May 2017.\u201d<\/p>\n<p>This apparent contradiction between what the FISA applications represented and what Steele testified to in his deposition led Sens. Chuck Grassley and Lindsey Graham to refer \u201cSteele to the FBI and Justice Department in January 2018 for <a href=\"https:\/\/dailycaller.com\/2021\/01\/17\/christopher-steele-michael-gaeta-dossier-fbi-untrustworthy\/\" target=\"_blank\" rel=\"noreferrer noopener\">possible criminal investigation<\/a> into whether he made false statements to the FBI regarding his contacts with journalists.\u201d Nothing known, however, has come of the request for the DOJ and FBI to launch a criminal investigation into whether Steele lied to agents.<\/p>\n<p>Conversely, Durham\u2019s prosecutor Andrew DeFilippis revealed during the unsuccessful prosecution of former Clinton campaign attorney Michael Sussmann that another former CHS connected to the Russia-collusion hoax, Rodney Joffe, <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/durham-team-raises-possibility-tech-exec-1-in-sussmann-case-committed-fraud\" target=\"_blank\" rel=\"noreferrer noopener\">remains<\/a> the \u201csubject\u201d of an \u201congoing\u201d investigation.\u00a0<\/p>\n<p>Joffe\u2019s name first made headlines in September of 2016, when Durham indicted Sussmann with \u201cone count of lying to FBI General Counsel James Baker when Sussmann provided Baker information purporting to show a secret communication channel between the Trump organization and the Russian-based Alfa Bank. Specifically, the indictment <a href=\"https:\/\/thefederalist.com\/2022\/03\/04\/spygate-figure-whose-attorney-outed-him-to-the-new-york-times-now-wants-his-name-hidden-in-court-documents\/\" target=\"_blank\" rel=\"noreferrer noopener\">charged<\/a> that \u2018Sussmann lied about the capacity in which he was providing the allegations to the FBI,\u2019 with Sussmann falsely stating \u2018he was not doing his work on the aforementioned allegations for any client.\u2019\u201d\u00a0<\/p>\n<p>The indictment charged that when Sussmann shared the Alfa Bank data with Baker, he really represented both the Hillary Clinton campaign and \u201cTech Executive-1,\u201d with an internet sleuth later <a href=\"https:\/\/twitter.com\/FOOL_NELSON\/status\/1438214296035545088\" target=\"_blank\" rel=\"noreferrer noopener\">fingering<\/a> Joffe as the unnamed tech executive and Joffe\u2019s attorney then <a href=\"https:\/\/thefederalist.com\/2022\/03\/04\/spygate-figure-whose-attorney-outed-him-to-the-new-york-times-now-wants-his-name-hidden-in-court-documents\/\" target=\"_blank\" rel=\"noreferrer noopener\">confirming<\/a> that fact. <a href=\"https:\/\/thefederalist.com\/2022\/05\/27\/why-the-jury-should-convict-michael-sussmann-of-lying-to-the-fbi-but-probably-wont\/\" target=\"_blank\" rel=\"noreferrer noopener\">While<\/a> a <a href=\"https:\/\/thefederalist.com\/2022\/05\/31\/jury-acquits-clinton-campaign-attorney-but-prosecutors-prove-corporate-media-guilty\/\" target=\"_blank\" rel=\"noreferrer noopener\">jury<\/a> acquitted Sussmann, the trial <a href=\"https:\/\/thefederalist.com\/2022\/06\/06\/9-big-things-we-learned-from-the-michael-sussmann-prosecution\/\" target=\"_blank\" rel=\"noreferrer noopener\">revealed<\/a> that Joffe, beyond being behind the peddling of the Alfa Bank hoax, had served as a CHS for the FBI. Yet rather than providing his handler with the supposed Alfa Bank data, Joffe gave it to both Sussmann and another FBI agent, Tom Grasso.\u00a0<\/p>\n<p>Grasso <a href=\"https:\/\/thefederalist.com\/2022\/05\/26\/court-testimony-shows-spygate-conspirators-deceived-the-fbi-using-same-strategy-twice\/\" target=\"_blank\" rel=\"noreferrer noopener\">testified<\/a> at Sussmann\u2019s trial that while he was not Joffe\u2019s handler, he \u201cknew Joffe was a CHS,\u201d and \u201chad a long working relationship with Joffe and believed Joffe had provided credible information in the past.\u201d Grasso further explained that he passed on Joffe\u2019s Alfa Bank \u201ctip\u201d to the agents working the case in Chicago, but without informing them that Joffe had provided the data. Consequently, Joffe\u2019s same Alfa Bank \u201cintel\u201d ended up coming to the FBI from two apparently different sources.\u00a0<\/p>\n<h2>Circular Reporting<\/h2>\n<p>Fusion GPS also peddled the Alfa Bank hoax formulated by Joffe to the media \u2014 with Clinton \u201c<a href=\"https:\/\/thefederalist.com\/2022\/06\/06\/9-big-things-we-learned-from-the-michael-sussmann-prosecution\/\" target=\"_blank\" rel=\"noreferrer noopener\">personally<\/a> okay[ing] her campaign minions [to give] the press the fake story about a Trump-Russia secret communication network.\u201d Thus, as was the case with Steele, the Alfa Bank allegations spun from the media to the FBI and around to the media again. The press then interpreted the FBI\u2019s investigation as confirming their sources, while the FBI thought (or pretended to believe), that the press\u2019s reporting confirmed its sources\u2019 intel.\u00a0<\/p>\n<p>This circular <a href=\"https:\/\/thefederalist.com\/2022\/05\/26\/court-testimony-shows-spygate-conspirators-deceived-the-fbi-using-same-strategy-twice\/\" target=\"_blank\" rel=\"noreferrer noopener\">reporting<\/a> even found its way into the <a href=\"https:\/\/thefederalist.com\/2018\/07\/23\/10-key-takeaways-released-fisa-warrants-carter-page\/\" target=\"_blank\" rel=\"noreferrer noopener\">Carter Page FISA application<\/a>, with the DOJ relying on two media reports to falsely represent Page as responsible for a supposedly more-conciliatory-to-Russia change in the Republican platform. In fact, so dizzying was the circular reporting related to Steele that the FBI even appeared <a href=\"https:\/\/thefederalist.com\/2022\/05\/19\/handwritten-notes-from-2017-show-fbi-agents-mislead-doj-on-the-trump-russia-investigation\/\" target=\"_blank\" rel=\"noreferrer noopener\">confused<\/a> by whether the \u201cintel\u201d came from the media or from Steele, as recently released notes show former FBI agent Peter Strzok telling the acting attorney general \u201cthat, based on \u2018CROWN reporting,\u2019 the FBI had \u2018looked at [the Republican convention]\u2019 and allegations that the Trump campaign had caused the convention to \u2018soften [its] stance on Crimea and NATO\u2019 in exchange for \u2018Russian energy stocks.\u2019\u201d <\/p>\n<p>However, Steele, whose code name was CROWN, had not included these <a href=\"https:\/\/thefederalist.com\/2022\/05\/19\/handwritten-notes-from-2017-show-fbi-agents-mislead-doj-on-the-trump-russia-investigation\/\" target=\"_blank\" rel=\"noreferrer noopener\">accusations<\/a> \u2014 which were false \u2014 in his dossier. So, either Strzok lied to the acting attorney general, or the FBI agent had wrongly attributed \u201cintel\u201d to Steele that had come from reporting by media outlets.\u00a0<\/p>\n<h2>More Confidential Human Sources<\/h2>\n<p>Not only did Joffe replicate Steele\u2019s approach in serving as a CHS, by providing supposed intel to both the media and the FBI, but Joffe went further by using his well-connected swamp lawyer, Sussmann, to sidestep both his handler and the FBI in order to feed the CIA purportedly damaging information on Trump. <\/p>\n<p>Specifically, in February of 2017, Sussmann used his connections to score a meeting with the CIA on behalf of Joffe. During that sit-down, <a href=\"https:\/\/thefederalist.com\/2022\/06\/06\/9-big-things-we-learned-from-the-michael-sussmann-prosecution\/\" target=\"_blank\" rel=\"noreferrer noopener\">in addition<\/a> to giving the CIA agents updated information pertaining to the Alfa Bank hoax, \u201cSussmann provided the agency thumb drives with separate data files for the YotaPhone by the location of the \u2018domain name system\u2019 or DNS lookups, including one for Trump\u2019s Central Park apartment, one for the [Executive Office of the President], one for Spectrum Health Care, and one for the Trump Tower.\u201d<\/p>\n<p>According to court documents, Sussmann told the CIA that the DNS data \u201cindicat[ed] that a Russian-made Yota-phone had been seen by [Sussmann\u2019s contacts] connecting to the WiFi from the Trump Tower in New York, as well as from a location in Michigan, at the same time that then-candidate Trump was believed to be at these locations.\u201d A later investigation by Durham\u2019s office \u201c<a href=\"https:\/\/thefederalist.com\/2022\/06\/06\/9-big-things-we-learned-from-the-michael-sussmann-prosecution\/\" target=\"_blank\" rel=\"noreferrer noopener\">revealed<\/a> that Joffe and his crew had obtained more complete data about the Yota phones and that data showed \u2018the DNS lookups involving the EOP began at least as early as 2014,\u2019 meaning before Trump came on the scene.\u201d Yet, \u201cthe data provided to the CIA, however, omitted those DNS lookups from the material given to the CIA, misleading the agency.\u201d<\/p>\n<p>Joffe sidestepped his handler and the FBI <a href=\"https:\/\/thefederalist.com\/2022\/06\/06\/9-big-things-we-learned-from-the-michael-sussmann-prosecution\/\" target=\"_blank\" rel=\"noreferrer noopener\">again<\/a> in March of 2017, \u201cwhen he used Sussmann to provide the Department of Justice\u2019s Inspector General information that \u2018a specific OIG employee\u2019s computer was \u201cseen publicly\u201d in \u201cInternet traffic\u201d and was connecting to a Virtual Private Network in a foreign country.\u201d\u2019\u201d Nothing else is known about this \u201ctip\u201d from Joffe \u2014 other than the fact that the Office of Inspector General remained mum about it until Sussmann\u2019s legal team alerted the Special Counsel\u2019s office of the meeting, <a href=\"https:\/\/thefederalist.com\/2022\/06\/06\/9-big-things-we-learned-from-the-michael-sussmann-prosecution\/\" target=\"_blank\" rel=\"noreferrer noopener\">revealing<\/a> the \u201cDOJ\u2019s OIG is not a team player.\u201d<\/p>\n<p>As of three months ago, special counsel prosecutor Andrew DeFilippis <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/durham-team-raises-possibility-tech-exec-1-in-sussmann-case-committed-fraud\" target=\"_blank\" rel=\"noreferrer noopener\">maintained<\/a> that Durham\u2019s team is still \u201clooking closely\u201d at Joffe, insisting there continue to be \u201congoing investigative matters.\u201d But Joffe is not the only CHS deserving a close look. And to date, it appears that Halper and Steele received, as most, a glance in their directions by the Special Counsel\u2019s team. <\/p>\n<p>If that proves to be the extent of Durham\u2019s scrutiny of these other confidential human sources, the problem Americans will see will extend beyond the government\u2019s use of CHS to target Trump: The public will see a double-standard of justice.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n  Margot Cleveland is The Federalist&#8217;s senior legal correspondent.
