The United States is in a \u201cGreat Race,\u201d battling China to be the leader in technological development, and our values regarding privacy and free speech are at the center of the fight.\u00a0<\/p>\n<p>Regrettably, antitrust legislation currently being considered in Congress threatens American values on privacy and free speech. Indeed, there are multiple pieces of misguided antitrust legislation currently in front of Congress that pose a threat to our national security, privacy, and technological edge.\u00a0<\/p>\n<p>Antitrust laws are meant to protect American consumers and regulate how companies operate. Yet the proposed laws in front of Congress would instead harm American consumers and bolster Chinese interests. Moreover, antitrust laws would handcuff American innovators and hinder American technology companies\u2019 ability to challenge China\u2019s influence on global technology. \u00a0<\/p>\n<p>Make no mistake about it: Chinese officials are looking to position their country as the global technology leader and to use that position to extend their influence and values throughout the world. Earlier this year, <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.state.gov\/the-administrations-approach-to-the-peoples-republic-of-china\/&#038;source=gmail&#038;ust=1658270548804000&#038;usg=AOvVaw282pl3HawwBJp5sWaSIIQk\" href=\"https:\/\/www.state.gov\/the-administrations-approach-to-the-peoples-republic-of-china\/\" target=\"_blank\" title=\"https:\/\/www.state.gov\/the-administrations-approach-to-the-peoples-republic-of-china\/\" rel=\"noopener\">Secretary of State Blinken warned<\/a> that Chinese officials are going to great lengths to increase the world\u2019s dependence on their country\u2019s technology. He speaks of a Chinese government that has become \u201cmore repressive at home and more aggressive abroad,\u201d as the government has ramped up its mass surveillance and data collection efforts. The Chinese government is technologically advanced, and its rapid advancements pose a serious threat to freedom, safety, and privacy across the world. \u00a0<\/p>\n<p>One particularly troubling bill before Congress would directly attack certain American companies and innovators. Meanwhile, Chinese companies would not be subject to this legislation and would continue to operate unchecked, <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/punchbowl.news\/wp-content\/uploads\/Open-Letter-Cyber-Intel-Defense-HS-1.pdf&#038;source=gmail&#038;ust=1658270548804000&#038;usg=AOvVaw3kSF1BZId4faReMP9x8x5k\" href=\"https:\/\/punchbowl.news\/wp-content\/uploads\/Open-Letter-Cyber-Intel-Defense-HS-1.pdf\" target=\"_blank\" title=\"https:\/\/punchbowl.news\/wp-content\/uploads\/Open-Letter-Cyber-Intel-Defense-HS-1.pdf\" rel=\"noopener\">accessing Americans\u2019 data<\/a>. Meanwhile Chinese companies, many with ties to the Chinese government, have been accused of stealing American\u2019s data \u2013 everything from our personal healthcare and financial data to military technologies. In fact, reports have <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.nbcnews.com\/tech\/security\/china-spent-years-collecting-americans-personal-information-u-s-just-n1134411&#038;source=gmail&#038;ust=1658270548804000&#038;usg=AOvVaw0Y-lluVOr0lug-dxxXbkyH\" href=\"https:\/\/www.nbcnews.com\/tech\/security\/china-spent-years-collecting-americans-personal-information-u-s-just-n1134411\" target=\"_blank\" rel=\"noopener\">indicated<\/a> that China has been stealing sensitive information for years, \u201cBeginning around 2014, a host of American organizations that store personal identifying information have been hacked, with either the government or major private cybersecurity firms identifying China&#8217;s Ministry of State Security as the culprit each time.\u201d The proposed antitrust legislation handcuffs America\u2019s tech companies which act as a strong line of defense against Chinese companies attempting to steal Americans\u2019 data. Without the protection by our tech companies, Chinese companies can expand these alarming efforts to collect our data unchecked.<\/p>\n<p>People who understand the importance of the battle with China for technological influence have spoken in opposition of antitrust legislation currently before Congress. For example, Frances Townsend, former Homeland Security Advisor under President George W. Bush, recently stated, \u201cIf our leaders don\u2019t change course, American citizens and businesses will become more dependent on authoritarian regimes for our technology.\u201d The legislation is drawing bipartisan criticism, with <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.law360.com\/articles\/1457052\/online-self-preferencing-antitrust-bill-heads-to-senate-floor&#038;source=gmail&#038;ust=1658270548804000&#038;usg=AOvVaw0IW9Iczhwnn6LZjXgzFJvW\" href=\"https:\/\/www.law360.com\/articles\/1457052\/online-self-preferencing-antitrust-bill-heads-to-senate-floor\" target=\"_blank\" title=\"https:\/\/www.law360.com\/articles\/1457052\/online-self-preferencing-antitrust-bill-heads-to-senate-floor\" rel=\"noopener\">Sen. John Cornyn<\/a> (R-TX) and <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.youtube.com\/watch?v%3Dl-N7qfa1OAY%26t%3D1s&#038;source=gmail&#038;ust=1658270548804000&#038;usg=AOvVaw1sTyMXLjWdPwe4UmSTD2ok\" href=\"https:\/\/www.youtube.com\/watch?v=l-N7qfa1OAY&#038;t=1s\" target=\"_blank\" title=\"https:\/\/www.youtube.com\/watch?v=l-N7qfa1OAY&#038;t=1s\" rel=\"noopener\">Sen. Dianne Feinstein<\/a> (D-CA) both having raised concerns.\u00a0<\/p>\n<p>While some members of Congress are endeavoring to dismantle our technology companies, to bar them from doing future business, and, most damning, to compel them to publicize Americans\u2019 data and some of their intellectual property to competitors, Chinese officials are keeping their eyes on the ball and pursuing a comprehensive agenda to dominate technologies of the future. In 2020, China\u2019s Ministry of Industry and Information Technology <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.scmp.com\/tech\/policy\/article\/3085362\/china-has-new-us14-trillion-plan-seize-worlds-tech-crown-us&#038;source=gmail&#038;ust=1658270548804000&#038;usg=AOvVaw3nwe2xLMu1QRM-UwWA2Arq\" href=\"https:\/\/www.scmp.com\/tech\/policy\/article\/3085362\/china-has-new-us14-trillion-plan-seize-worlds-tech-crown-us\" target=\"_blank\" title=\"https:\/\/www.scmp.com\/tech\/policy\/article\/3085362\/china-has-new-us14-trillion-plan-seize-worlds-tech-crown-us\" rel=\"noopener\">announced plans<\/a> to contribute $1.4 trillion in investment over the next five years. Indeed, China\u2019s 14th Five-Year Plan declares it a national security objective for China to <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/americanprogress.org\/wp-content\/uploads\/2022\/06\/OnlineCompetition-report.pdf&#038;source=gmail&#038;ust=1658270548804000&#038;usg=AOvVaw2tIEOaLOXjn4KnRg1t-_gu\" href=\"https:\/\/americanprogress.org\/wp-content\/uploads\/2022\/06\/OnlineCompetition-report.pdf\" target=\"_blank\" title=\"https:\/\/americanprogress.org\/wp-content\/uploads\/2022\/06\/OnlineCompetition-report.pdf\" rel=\"noopener\">dominate next-generation technologies<\/a>.\u00a0<\/p>\n<p>The Chinese are already equipped with data from American citizens that they have stolen or accessed with their own technologies through <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.npr.org\/2020\/02\/10\/804501991\/chinese-hackers-charged-in-alleged-cyber-theft-of-145-million-americans-data&#038;source=gmail&#038;ust=1658270548804000&#038;usg=AOvVaw0MGKA8DXGoIARVoLhwMfz-\" href=\"https:\/\/www.npr.org\/2020\/02\/10\/804501991\/chinese-hackers-charged-in-alleged-cyber-theft-of-145-million-americans-data\" target=\"_blank\" title=\"https:\/\/www.npr.org\/2020\/02\/10\/804501991\/chinese-hackers-charged-in-alleged-cyber-theft-of-145-million-americans-data\" rel=\"noopener\">state entities<\/a>, and now Congress is maneuvering to hand over even more Americans\u2019 data in the name of breaking up big technology companies. Bill Evanina, former director of the U.S. National Counterintelligence Security Center, estimated that the Chinese government has stolen personally identifiable information of <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.securitymagazine.com\/articles\/94493-china-has-stolen-the-personal-data-of-80-of-american-adults&#038;source=gmail&#038;ust=1658270548804000&#038;usg=AOvVaw1lgKpqrve3TKukIGSGTz6I\" href=\"https:\/\/www.securitymagazine.com\/articles\/94493-china-has-stolen-the-personal-data-of-80-of-american-adults\" target=\"_blank\" rel=\"noopener\">80% of Americans<\/a>. Congress needs to understand the current international technology landscape, allow American tech companies to operate without undue barriers, and affirm that American tech companies can be strategic allies in keeping the Chinese in check and in maintaining American technological superiority.\u00a0<\/p>\n<p>Unfortunately, antitrust legislation before Congress would block any chance that U.S. tech companies would have at stopping China from cornering the market.
