Hodges<\/em> \u2014 the 2015 case that ruled states were prohibited from banning same-sex marriage \u2014 as it compared to <em>Roe v. Wade<\/em>. Wheeler asked Cruz to pretend he was an advocate of the Court and explain the vulnerability of <em>Obergefell<\/em> and what it would take to overturn that precedent.<\/p>\n<p><em>\u201cObergefell<\/em>, like <em>Roe v. Wade<\/em>, ignored two centuries of our nation\u2019s history,\u201d Cruz told Wheeler. \u201cMarriage was always an issue that was left to the states. We saw states before <em>Obergefell<\/em>, some states were moving to allow gay marriage, and other states were moving to allow civil partnerships. There were different standards that the states were adopting.\u201d<\/p>\n<p>In <em>Obergefell<\/em>, the Court <a href=\"https:\/\/www.oyez.org\/cases\/2014\/14-556\">ruled<\/a> 5-4 that state laws banning same-sex marriage were unconstitutional under the due process and equal protection clauses of the Fourteenth Amendment.<\/p>\n<p>\u201cAnd had the Court not ruled in <em>Obergefell<\/em>, the democratic process would have continued to operate; if you believed gay marriage was a good idea, the way the Constitution set up for you to advance that position is to convince your fellow citizens,\u201d Cruz explained. \u201cAnd if you succeeded in convincing your fellow citizens, then your state would change the laws to reflect those views. In <em>Obergefell<\/em>, the Court said, \u2018No, we know better than you guys do and now every state \u2026 must sanction and permit gay marriage.&#8217;\u201d<\/p>\n<p>The former presidential candidate added that he believed that the Court was \u201coverreaching\u201d in that decision, but that it was a \u201cfundamentally\u201d different question than abortion.<\/p>\n<p>\u201cI think that decision was clearly wrong when it was decided,\u201d Cruz added of same-sex marriage. \u201cIt was the court overreaching.\u201d<\/p>\n<p>In June, the SCOTUS emphasized in its <em>Dobbs v. Jackson Women\u2019s Health Organization<\/em>\u00a0decision, which led to the <a href=\"https:\/\/www.dailywire.com\/news\/united-states-supreme-court-overturns-roe-v-wade-leaves-abortion-restrictions-to-states\">overturning<\/a> of <em>Roe, <\/em>that the abortion issue was not the same as marriage.<\/p>\n<p>\u201c\u2026 so in <em>Dobbs<\/em>, what the Supreme Court said is <em>Roe<\/em> is different because it\u2019s the only one of the cases that involve the taking of a human life and that\u2019s qualitatively different\u201d than <em>Obergefell<\/em>, he explained.<\/p>\n<p>\u201cI agree with that proposition,\u201d Cruz added.<\/p>\n<p>In reaction to an edited clip of his answer, some leftists like Ron Filipkowski claimed that Cruz was calling on the Supreme Court to overturn <em>Obergefell <\/em>completely. As Cruz\u2019s senior communications advisor Steve Guest pointed out, the full context of Cruz\u2019s remarks proves otherwise.<\/p>\n<p>Guest quipped, \u201cNoticed you only clipped 18 seconds,\u201d while linking to a longer version of Cruz\u2019s response.<\/p>\n<p lang=\"en\" dir=\"ltr\">Noticed you only clipped 18 seconds.<\/p>\n<p>Here&#8217;s Sen.
