Judge Charles Atchley for the Eastern District of Tennessee temporarily <a href=\"https:\/\/www.courtlistener.com\/docket\/60323194\/86\/tennessee-v-united-states-department-of-education\/\" target=\"_blank\" rel=\"noopener noreferrer\">blocked<\/a> the proposal Friday after a lawsuit brought forward by 20 Republican attorneys general challenged the rule\u2019s constitutionality.\u00a0<strong><a href=\"https:\/\/dailycaller.com\/2022\/06\/23\/tulsi-gabbard-title-ix-women-sports\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: \u2018Essentially Erase Women\u2019: Tulsi Gabbard Slams Biden Admin\u2019s Overhaul Of Key Civil Rights Law)<\/a><\/strong><\/p>\n<p>The DOE\u2019s proposed revisions to Title IX \u00a0\u201cdirectly interferes with and threatens Plaintiff States\u2019 ability to continue enforcing their state laws,\u201d Atchley said in his opinion. (Photo by Anna Moneymaker\/Getty Images)<\/p>\n<\/div>\n<p>The attorneys general say their states are in danger of losing federal funding for education because their policies and laws keep them from complying with Title IX, which applies to federally-funded institutions, the lawsuit <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.tned.101294\/gov.uscourts.tned.101294.1.0.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">states.<\/a>\u00a0They argue the proposed revisions force <a href=\"https:\/\/dailycaller.com\/2022\/05\/25\/biden-usda-department-of-agriculture-transgender-gender-discrimination-lunch-money\/\" target=\"_blank\" rel=\"noopener noreferrer\">schools<\/a> to call transgender students by their pronouns, violating the First Amendment, and infringe on powers given to the states, violating the Tenth Amendment.<\/p>\n<p>The <a href=\"https:\/\/dailycaller.com\/2022\/07\/12\/title-ix-schools-biological-men-womens-sports-gender-identity\/\" target=\"_blank\" rel=\"noopener noreferrer\">rule<\/a> will be finalized by Sept. 12, 2022.<\/p>\n<p>The Department of Education and Atchley did not immediately respond to the Daily Caller News Foundation\u2019s request for comment.<\/p>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
