Riot? That\u2019s quaint, compared to what the pro-abortion group calling itself \u201cRuth Sent Us\u201d did when it\u00a0<a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.nationalreview.com\/news\/pro-choice-group-ruth-sent-us-suggests-targeting-amy-coney-barretts-children\/&#038;source=gmail&#038;ust=1657980036930000&#038;usg=AOvVaw2bg8jIdf6MF9f-uzOlcgQk\" href=\"https:\/\/www.nationalreview.com\/news\/pro-choice-group-ruth-sent-us-suggests-targeting-amy-coney-barretts-children\/\" target=\"_blank\" rel=\"noopener\">tweeted<\/a> information identifying Justice Amy Coney Barrett\u2019s church and the school her children attend, and suggested protesters should \u201cvoice your anger\u201d there.<\/p>\n<p>Then there\u2019s a group calling itself \u201cJane\u2019s Revenge,\u201d apparently a reference to the pseudonym \u201cJane Roe\u201d from\u00a0<em>Roe v. Wade\u00a0<\/em>infamy, which has\u00a0<a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/twitter.com\/LilaGraceRose\/status\/1536184639101861888?s%3D20%26t%3D1_ScOPXtAd6ULKrJ8gONyQ%255d&#038;source=gmail&#038;ust=1657980036930000&#038;usg=AOvVaw2F4C4-KnBZDx8zIpDuRJQD\" href=\"https:\/\/twitter.com\/LilaGraceRose\/status\/1536184639101861888?s=20&#038;t=1_ScOPXtAd6ULKrJ8gONyQ%5d\" target=\"_blank\" rel=\"noopener\">firebombed<\/a> crisis pregnancy centers around the country. \u201cIf abortions aren\u2019t safe, then neither are you,\u201d reads the graffiti spray painted on a vandalized interior wall.<\/p>\n<p>Let me be clear \u2013 I am a strong supporter of free speech, and, more than that, I am a strong supporter of peaceably assembling for public demonstrations. For more than a decade, I have led an organization that has made its name by hosting gatherings, large and small, of citizen activists determined to make their voices heard on the issues of concern to them. I take a back seat to no one on the issue of speaking out and speaking up.<\/p>\n<p>That said, I have never, ever protested outside the home of a justice or a political leader, nor would I. It goes without saying that I have never firebombed a leftist\u2019s office, or threatened her children, either.<\/p>\n<p>There\u2019s a time and a place for everything. State legislatures in Maryland and Virginia (where several of the justices live) have recognized that, and have enacted laws to protect domestic tranquility. Note \u2013 unlike a particular federal law enacted specifically to provide protection for judges and justices and court officers from being influenced while a case is pending (which Attorney General Merrick Garland failed to enforce for more than a month), these laws are not written specifically to protect judges or justices, or political leaders, for that matter; they are, rather, general laws written for the purpose of ensuring domestic tranquility in residential neighborhoods.<\/p>\n<p>The <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/law.justia.com\/codes\/maryland\/2016\/criminal-law\/title-3\/subtitle-9\/section-3-904\/&#038;source=gmail&#038;ust=1657980036930000&#038;usg=AOvVaw3r62OeQ8nDJukUqBCoRusO\" href=\"https:\/\/law.justia.com\/codes\/maryland\/2016\/criminal-law\/title-3\/subtitle-9\/section-3-904\/\" target=\"_blank\" rel=\"noopener\">Maryland statute<\/a>, \u201cUnlawful picketing and assembly,\u201d helpfully explains in its preamble: \u201cThe General Assembly declares that: the protection and preservation of the home is the keystone of democratic government,\u201d and \u201cthe public health and welfare and the good order of the community require that members of the community enjoy in their homes a feeling of well-being, tranquility, and privacy, and when absent from their homes, carry with them the sense of security inherent in the assurance that they may return to the enjoyment of their homes \u2026&#8221; The operative section of the law reads, \u201cA person may not intentionally assemble with another in a manner that disrupts a person\u2019s right to tranquility in the person\u2019s home.\u201d<\/p>\n<p>The\u00a0<a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/law.lis.virginia.gov\/vacode\/title18.2\/chapter9\/section18.2-419\/&#038;source=gmail&#038;ust=1657980036930000&#038;usg=AOvVaw1G4ooGW89OYVxEmEYf9Ruq\" href=\"https:\/\/law.lis.virginia.gov\/vacode\/title18.2\/chapter9\/section18.2-419\/\" target=\"_blank\" rel=\"noopener\">Virginia statute<\/a>, \u201cPicketing or disrupting tranquility of home,\u201d reads, \u201cAny person who shall engage in picketing before or about the residence or dwelling place of any individual, or who shall assemble with another person or persons in a manner which disrupts or threatens to disrupt any individual\u2019s right to tranquility in his home, shall be guilty of a Class 3 misdemeanor.\u201d<\/p>\n<p>Those laws came into play earlier this month, when Gail Curley, the Marshal of the Supreme Court,\u00a0<a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.washingtonpost.com\/dc-md-va\/2022\/07\/02\/supreme-court-justices-picketing-homes\/&#038;source=gmail&#038;ust=1657980036930000&#038;usg=AOvVaw3tqGCoVWXVJ2bS_0uQzyij\" href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2022\/07\/02\/supreme-court-justices-picketing-homes\/\" target=\"_blank\" rel=\"noopener\">wrote letters<\/a> to the governors of Virginia and Maryland, and to county leaders in the two states, urging them to take the steps necessary to enforce those laws.<\/p>\n<p>\u201cFor weeks on end, large groups of protesters chanting slogans, using bullhorns, and banging drums have picketed Justices\u2019 homes in Maryland,\u201d said her letter to Maryland Gov. Larry Hogan, which said \u201cthreatening activity\u201d has increased. \u201cThreatening activity\u201d? Yes, there was that small incident of the man who flew across the country to assassinate Justice Kavanaugh but was apprehended outside the justice\u2019s home before he could.<\/p>\n<p>Our Founders gave judges and justices lifetime appointments for a simple reason \u2013 so they would be insulated from public pressure. Determining what is proper in the law is not a function of what is popular, but of what is Constitutional; insulation from public pressure is a necessary precondition to the ascertainment of what is just.
