It no longer even ranks in the top 10.<\/p>\n<div>\n<p>But the Biden administration is simply unwilling to let go of the emergency \u2014 and its \u201cemergency\u201d powers. The president is\u00a0<a class=\"Link  stylish-link\" href=\"https:\/\/www.bloomberg.com\/news\/articles\/2022-07-11\/white-house-to-extend-covid-public-health-emergency\" target=\"_blank\" rel=\"noopener\">reportedly planning<\/a>\u00a0on extending the pandemic emergency declaration, originally implemented in January 2020 under former President Donald Trump, yet again after it was set to expire on July 15.<\/p>\n<p>Why extend the declaration even though the \u201cemergency\u201d is clearly long over?<\/p>\n<p>Well, the White House\u00a0<i>says<\/i>\u00a0it\u2019s doing this, in part, to preserve essential regulatory exceptions implemented under emergency authorization, such as increased telehealth availability and the approval of vaccines and treatments under emergency use authorizations. And those are indeed important reforms. But,\u00a0<a class=\"Link  stylish-link\" href=\"https:\/\/www.wsj.com\/articles\/the-never-ending-covid-emergency-white-house-biden-administration-fda-vaccines-11657577450\" target=\"_blank\" rel=\"noopener\">according<\/a>\u00a0to the\u00a0<i>Wall Street Journal<\/i>, the Biden administration could preserve them all using other executive authorities even if the president did allow the emergency powers to lapse.<\/p>\n<p>The real reason this White House won\u2019t give up its \u201ctemporary\u201d emergency powers is much more sinister \u2014 and partisan. It\u2019s simple: The forever-emergency status quo is allowing them to keep millions of ineligible people on welfare programs such as Medicaid and food stamps.<\/p>\n<p>\u201cIn March 2020 Congress barred states from kicking ineligible people off Medicaid rolls during the emergency in return for more federal funding,\u201d the\u00a0<i>Wall Street Journal<\/i>\u00a0editorial board\u00a0<a class=\"Link  stylish-link\" href=\"https:\/\/www.wsj.com\/articles\/the-never-ending-covid-emergency-white-house-biden-administration-fda-vaccines-11657577450\" target=\"_blank\" rel=\"noopener\">explains<\/a>. \u201cMedicaid enrollment has ballooned to 95 million \u2014 30% of Americans are now enrolled \u2014 from 71 million in December 2019.\u201d<\/p>\n<p>\u201cAnother reason: Congress in March 2020 suspended food-stamp work requirements during the emergency and sweetened benefits in states that maintained their own declarations,\u201d it continues. \u201cAs of April, 41.2 million Americans were receiving food stamps \u2014 an average of $228 monthly per person \u2014 which is about 4.4 million more than before the pandemic.\u201d<\/p>\n<p>We can have a broader debate about the vast welfare state, but we\u2019re all supposed to agree that\u00a0<i>legally ineligible<\/i>\u00a0people shouldn\u2019t be receiving taxpayer dollars. Yet clearly, many are. According to the Foundation for Government Accountability, 20% \u2014 yes,\u00a0<a class=\"Link  stylish-link\" href=\"https:\/\/thefga.org\/paper\/ineligible-medicaid-enrollees-costing-taxpayers-billions\/\" target=\"_blank\" rel=\"noopener\">1 in 5<\/a>\u00a0\u2014 of Medicaid dollars are improperly spent. (And that was before the pandemic and all these rule removals.)<\/p>\n<p>So, it\u2019s entirely safe to say that by preserving the emergency declaration, President Joe Biden is keeping millions of legally ineligible people plugged into the welfare state. This is\u00a0<a class=\"Link  stylish-link\" href=\"https:\/\/thefga.org\/paper\/ineligible-medicaid-enrollees-costing-taxpayers-billions\/\" target=\"_blank\" rel=\"noopener\">costing taxpayers countless billions<\/a>, and the White House is only able to get away with it because of its abuse of the emergency powers.<\/p>\n<p>This is unacceptable.<\/p>\n<p>But waiting on a branch of government to cede an expansion of its powers voluntarily is often a fool\u2019s errand. As Nobel Prize-winning economist F.A. Hayek once put it, \u201c\u2018Emergencies\u2019 have always been the pretext on which the safeguards of individual liberty have been eroded \u2014 and once they are suspended it is not difficult for anyone who has assumed emergency powers to see to it that the emergency will persist.\u201d<\/p>\n<p>So, we can\u2019t simply hope for this problem to go away on its own. Biden will not cede his \u201cemergency\u201d powers any time before the end of his term unless the public rises up and demands that he does.
