Gretchen Whitmer in the November general election.<\/p>\n<p>The lawsuit (<a href=\"https:\/\/progressmichigan.org\/wp-content\/uploads\/2022\/07\/Kelley-Verified-Cplt-PDF.pdf?akid=30587.197674.C9mlM8&#038;rd=1&#038;t=7\">pdf<\/a>) was\u00a0filed in the Michigan Court of Appeals on July 14 by Michigan resident Lee Estes, with the support of the Democratic advocacy organization Progress Michigan.<\/p>\n<p>Kelley was arrested on June 9 and charged with four misdemeanor offenses related to the Capitol breach on Jan. 6, 2021, according to court documents (<a href=\"https:\/\/www.justice.gov\/usao-dc\/case-multi-defendant\/file\/1511811\/download\">pdf<\/a>).<\/p>\n<p>The charges include\u00a0knowingly entering or remaining in a restricted area without lawful authority, disorderly conduct, knowingly engaging in physical violence in a restricted area, and willfully injuring or committing depredation against federal government property.<\/p>\n<p>He has pleaded not guilty to the charges.<\/p>\n<p>The lawsuit filed on June 14 states that\u00a0Kelley\u2019s participation in the events of Jan. 6 makes him \u201cineligible\u00a0to serve as a candidate for Governor for the State of Michigan,\u201d adding that he presents a \u201cclear and present danger to democracy in Michigan.\u201d<\/p>\n<p>The lawsuit cites section three of the 14th Amendment, which prohibits individuals who have \u201cengaged in insurrection or rebellion against the [United States], or given aid or comfort to the enemies thereof\u201d from serving as a senator or representative in Congress, an elector of the president and vice president, or any other position in government.<\/p>\n<p>The lawsuit also cites an\u00a0oath to \u201csupport the Constitution of the United States,\u201d which Kelley took in 2019 when he was appointed to his local planning commission.<\/p>\n<p> Kelley Remains Top Candidate <\/p>\n<p>In the suit, Estes asks Michigan Secretary of State\u00a0Jocelyn Benson, a Democrat,\u00a0and the Board<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A\u00a0Michigan man has filed a lawsuit against\u00a0Republican gubernatorial candidate Ryan Kelley aiming to prevent Kelley from appearing on the ballot in November over his alleged participation in the Jan. 6 Capitol breach.
