The law <a href=\"https:\/\/www.health.state.mn.us\/data\/mchs\/pubs\/abrpt\/docs\/2021abrpt.pdf\">requires<\/a> that \u201creasonable measures consistent with good medical practice shall be taken by the responsible medical personnel to preserve the life and health of the born alive infant.\u201d<\/p>\n<p>\u201cFor the calendar year of January 1, 2021, through December 31, 2021, 5 abortion procedures resulting in a born-alive infant were reported,\u201d the health department report detailed.<\/p>\n<p>In one instance, a baby with fetal \u201canomalies\u201d died \u201cshortly after delivery.\u201d The report adds that \u201cno measures taken to preserve life were reported and the infant did not survive.\u201d<\/p>\n<p>Two other born-alive babies received \u201ccomfort care measures\u201d but \u201cdid not survive.\u201d The \u201ccomfort and care measures\u201d are not defined in the account, first reported by <a href=\"https:\/\/dailycaller.com\/2022\/07\/12\/live-babies-die-botched-abortions-minnesota\/\">The Daily Caller<\/a>.<\/p>\n<p>Two more born-alive babies, described in the report as \u201cpreviable,\u201d also had no reports that they received any care in an effort to save their lives. The gestation of the babies is not reported.<\/p>\n<p>Scott Smith, a communications specialist for the Minnesota Department of Health (MDH), directed The Daily Wire to the department\u2019s Abortion Reporting System <a href=\"https:\/\/www.health.state.mn.us\/data\/mchs\/pubs\/abrpt\/reporting.html\">page<\/a>\u00a0when asked for comment on the matter. Smith said he could not further comment on the specific cases, per Minnesota law.<\/p>\n<p>\u201cAs part of that system, MDH is required by law to maintain the confidentiality of the underlying case data and does not provide any comment about cases beyond what is in the report,\u201d Smith said, citing <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/145.4134\">Minn. Ben Sasse (R-NE) has attempted to push the \u201c<a href=\"https:\/\/www.dailywire.com\/news\/democrats-stop-republicans-saving-infants-born-amanda-prestigiacomo\">Born-Alive Abortion Survivors Protection Act<\/a>\u201d through Congress.<\/p>\n<p>The legislation\u00a0would mandate doctors attempt to save born-alive infants instead of allowing them to die and criminalizes anyone who\u00a0\u201cintentionally performs or attempts to perform an overt act that kills a child born alive.\u201d<\/p>\n<p>\u201cIf an abortion results in the live birth of an infant, the infant is a legal person for all purposes under the laws of the United States, and entitled to all the protections of such laws,\u201d the legislation said, adding, \u201cAny infant born alive after an abortion or within a hospital, clinic, or other facility has the same claim to the protection of the law that would arise for any newborn, or for any person who comes to a hospital, clinic, or other facility for screening and treatment or otherwise becomes a patient within its care.\u201d<\/p>\n<p>During a vote in 2019, only three Democrats voted for the bill: Sen. Bob Casey Jr. (D-PA), Sen. Joe Manchin (D-WV), and Sen.
