This <a href=\"https:\/\/www.federalregister.gov\/documents\/2022\/07\/12\/2022-13734\/nondiscrimination-on-the-basis-of-sex-in-education-programs-or-activities-receiving-federal\">proposal<\/a> would force public schools to allow biological men to participate in women\u2019s sports and access facilities such as locker rooms and bathrooms in order to receive federal funding.<\/p>\n<p>The rule would define sex-based discrimination to specifically include actions taken on the basis of \u201csex stereotypes, sex characteristics, pregnancy or related conditions, sexual orientation and gender identity.\u201d It also requires a \u201cstreamline [of] administrative requirements\u201d characterized by newly \u201cadopting grievance procedures and record keeping\u201d of sexual harassment claims.<\/p>\n<p>The proposal will go through a two-month review process and comment period, in accordance with the <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/5\/553\">Administrative Procedures Act<\/a>. Comments must be received by Sept. 12, 2022, according to the Federal Register.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">As expected, the Biden admin is proposing that schools must consider \u201cwomen\u201d to include men who say they\u2019re women.<\/p>\n<p>The administration is threatening to cut off federal funding for schools who don\u2019t comply with that definition. <a href=\"https:\/\/t.co\/mEpEmEOgXE\">https:\/\/t.co\/mEpEmEOgXE<\/a><\/p>\n<p>\u2014 Vince Coglianese (@VinceCoglianese) <a href=\"https:\/\/twitter.com\/VinceCoglianese\/status\/1546852429425262592?ref_src=twsrc%5Etfw\">July 12, 2022<\/a><\/p>\n<\/blockquote>\n<p>The regulations would \u201cdefine sex-based harassment to include but not be limited to sexual harassment; provide and clarify, as appropriate, definitions of various terms related to a recipient\u2019s obligations to address sex discrimination, including sex-based harassment; clarify how a recipient is required to take action to end any sex discrimination that has occurred in its education program or activity, prevent its recurrence, and remedy its effects; and clarify a recipient\u2019s obligations related to the grievance procedures and other necessary steps when it receives a complaint of sex discrimination,\u201d the document said.<\/p>\n<p>The document follows the department\u2019s proposed changes announced in a June 23 <a href=\"https:\/\/www.ed.gov\/news\/press-releases\/us-department-education-releases-proposed-changes-title-ix-regulations-invites-public-comment\" target=\"_blank\" rel=\"noopener noreferrer\">press release<\/a>. The regulations would \u201cstrengthen the framework, improve clarity for recipients to facilitate their compliance, and better align the Title IX regulations with the nondiscrimination mandate of Title IX,\u201d the proposed rule says. <strong><a href=\"https:\/\/dailycaller.com\/2022\/03\/30\/biden-admin-just-weeks-away-from-extending-title-ix-to-trans-students-report\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Biden Admin Just Weeks Away From Extending Title IX To Trans Students: REPORT)\u00a0<\/a><\/strong><\/p>\n<p>These proposed changes followed Biden\u2019s March 2021 <a href=\"https:\/\/dailycaller.com\/2021\/03\/08\/joe-biden-womens-rights-gender-policy-council-title-ix-review-klein-reynoso\/\" target=\"_blank\" rel=\"noopener noreferrer\">executive order<\/a> directing the DOE to review Title IX regulations implemented by former President Donald Trump\u2019s administration. Those rules addressed the handling of sexual assault and harassment claims by colleges and universities.<\/p>\n<p>Erika Sanzi, director of outreach for Parents Defending Education, <a href=\"https:\/\/dailycaller.com\/2022\/06\/23\/joe-biden-education-department-title-ix-transgender-identity\/\" target=\"_blank\" rel=\"noopener noreferrer\">told<\/a> the Daily Caller News Foundation in June that these changes will cause women to lose protections guaranteed to them under Title IX.<\/p>\n<p>\u201cTitle IX has always guaranteed single sex space restrooms, locker rooms, and interscholastic athletics. A shift from biological sex to gender identity means that girls and women will be forced to accept the presence of biological males in what have always been single-sex spaces,\u201d she said. \u201cIt means that female students will be forced to use the same restroom as biologically male classmates and staff members, who identify as girls and women, and will likely be forced to compete in the same athletic events.\u201d<\/p>\n<p>The proposed revisions come as <a href=\"https:\/\/www.si.com\/more-sports\/2022\/07\/06\/transgender-athletes-bans-policies-ioc-ncaa\" target=\"_blank\" rel=\"noopener noreferrer\">18 states<\/a> have currently passed legislation banning biological men from competing in women\u2019s sports.
