He was just defending himself.\u201d<\/p>\n<p>But police sources said prosecutors refused to charge the woman because they felt she was justified because she was helping her boyfriend as he was being slashed.<\/p>\n<figure class=\"wp-block-image size-large\"><a href=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/07\/jose-alba-258.jpg\"><\/a><figcaption>The DA\u2019s office hasn\u2019t charged the gal pal of the ex-convict killed by bodega worker Jose Alba, even though she stabbed Alba three times.<\/figcaption><\/figure>\n<p>\u201cThe DA\u2019s office looked at the tape, and they felt she was defending her boyfriend,\u201d a cop with knowledge of the situation told The Post. \u201cThey didn\u2019t feel charges were necessary.\u201d <\/p>\n<p>But defense lawyer and former Bronx prosecutor Michael Discioarro said he\u2019s in the Alba camp on this one.<\/p>\n<p>\u201cI have no idea why she\u2019s not charged,\u201d Discioarro said. \u201cHer boyfriend was the aggressor. Discioarro said he believes the woman should be charged.<\/figcaption><\/figure>\n<p>The woman later claimed to cops that she never stabbed Alba, despite the surveillance <a href=\"https:\/\/nypost.com\/2022\/07\/10\/video-shows-how-nyc-bodega-worker-jose-alba-may-have-been-stabbed\/\">footage suggesting otherwise, sources said<\/a>. She could not be reached for comment.<\/p>\n<p>Manhattan prosecutors declined to comment Monday, saying the office does not discuss details of pending criminal cases.<\/p>\n<p>Earlier Monday, <a href=\"https:\/\/nypost.com\/2022\/07\/11\/nyc-bodega-worker-jose-alba-is-very-sad-over-fatal-stabbing-please-forgive-me\/\">Alba spoke out for the first time<\/a> since the deadly incident.<\/p>\n<p>\u201cI\u2019m very sad. I didn\u2019t think this would happen,\u201d he said in Spanish. \u201cAt the moment I was in shock.
