Jackson Women\u2019s Health Organization<\/em><\/a>\u00a0righted a 50-year wrong that resulted in the death of over 60 million unborn children.\u00a0<em>Roe v. Wade<\/em>\u00a0was premised on egregious legal errors, and its reversal is a tremendous victory for life and for the Constitution. Just as importantly \u2014 and contrary to what some have argued in these last few weeks \u2014 the\u00a0<em>Dobbs<\/em>\u00a0decision gives America the opportunity to reconceptualize motherhood and, in doing so, empower women.<\/p>\n<p>To begin,\u00a0<em>Roe<\/em>\u00a0was terrible constitutional law. It invented a right to abortion from thin air, and even pro-abortion scholars believed it was wrongly decided.\u00a0<em>Roe<\/em>\u00a0took from the democratic branches one of the most consequential issues of our time. In so doing, it profoundly damaged the ability of states to protect unborn life, usurping the people\u2019s role in \u201c<a href=\"http:\/\/landmarkcases.c-span.org\/pdf\/Roe_White_Dissent.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">an exercise of raw judicial power<\/a>.\u201d But the Supreme Court\u2019s job is to interpret the Constitution, which, as the\u00a0<em>Dobbs<\/em>\u00a0majority\u00a0<a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/19-1392_6j37.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">explained<\/a>, nowhere contains a right to an abortion.<\/p>\n<p><em>Roe<\/em>\u00a0was as wrong about motherhood as it was about the Constitution. Its seven male authors\u00a0<a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/410\/113\" target=\"_blank\" rel=\"noreferrer noopener\">believed<\/a>\u00a0that motherhood \u201cmay force upon the woman a distressful life and future.\u201d The Supreme Court\u2019s\u00a0<a href=\"https:\/\/www.oyez.org\/cases\/1991\/91-744\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Planned Parenthood v. Casey<\/em><\/a>\u00a0decision in 1992 did nothing to improve upon this view of womanhood, explaining that abortion was necessary for women to achieve social and economic equality. That view is still heard today. U.S. Rep. Sean Casten recently\u00a0<a href=\"https:\/\/www.reuters.com\/world\/us\/us-abortion-rights-activists-start-summer-rage-with-saturday-protests-2022-05-14\/\" target=\"_blank\" rel=\"noreferrer noopener\">claimed<\/a>\u00a0that overturning\u00a0<em>Roe<\/em>\u00a0would \u201ccondemn women to [a] lesser status.\u201d<\/p>\n<p>But the reality is that abortions are not necessary for women to flourish. While abortions have steadily declined, women continue to succeed professionally and financially. Additionally, motherhood and a fulfilling life are not mutually exclusive. Many mothers believe that children make life\u00a0<em>more\u00a0<\/em>fulfilling. And there is evidence that\u00a0<em>Roe<\/em>\u00a0has made it\u00a0<em>more<\/em>\u00a0difficult for mothers to achieve their career goals by requiring women to be more like men and\u00a0<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/19\/19-1392\/185366\/20210804180314919_19-1392%20Brief%20of%20240%20Women%20Scholars%20et%20al%20In%20Support%20of%20Petitioners.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">promoting<\/a>\u00a0a \u201cmale childless norm in educational and employment settings.\u201d<\/p>\n<p>Further, there are indications that\u00a0<a href=\"https:\/\/www.usatoday.com\/story\/opinion\/2020\/08\/09\/covid-19-creates-desperation-women-turn-pregnancy-centers-column\/3316935001\/\" target=\"_blank\" rel=\"noreferrer noopener\">the vast majority<\/a>\u00a0of women seeking abortions say they would have chosen life if circumstances were different. And in one study,\u00a0<a href=\"https:\/\/medscimonit.com\/abstract\/index\/idArt\/11784.\" target=\"_blank\" rel=\"noreferrer noopener\">a majority of women<\/a>\u00a0were unsure of their decision to obtain an abortion. These unwanted abortions take an enormous toll on the physical, spiritual, and emotional health of women.<\/p>\n<p>In another lie to American women,\u00a0<em>Roe<\/em><a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/410\/113\" target=\"_blank\" rel=\"noreferrer noopener\"> told them<\/a>\u00a0that their baby is merely \u201cpotential life.\u201d Scientific evidence establishes that life begins at conception and that a baby is both fully human and fully alive, no matter how small. At 15 weeks, when Mississippi\u2019s law applies, a baby can move and stretch, hiccup, open and close her fingers, and quite likely feel pain. She has fully taken on the human physiological form.<\/p>\n<p>Yet, without a hint of irony, pro-abortion activists\u00a0<a href=\"https:\/\/www.reuters.com\/world\/us\/us-abortion-rights-activists-start-summer-rage-with-saturday-protests-2022-05-14\/\" target=\"_blank\" rel=\"noreferrer noopener\">posit<\/a>\u00a0that the reversal of\u00a0<em>Roe<\/em>\u00a0\u201ctreats women as objects, as less than full human beings.\u201d But it is abortion that treats babies, including\u00a0<em>female<\/em>\u00a0babies, as mere objects and less than full human beings, even while science establishes that babies are both fully alive and fully human.<\/p>\n<p><em>Roe<\/em>\u00a0was not the pro-woman opinion that some imagine. In a patriarchal passage the pro-abortion left would rather forget,\u00a0<em>Roe<\/em>\u00a0gave to a woman\u2019s\u00a0<em>doctor<\/em>\u00a0the authority to choose abortion. It stated that \u201cthe attending\u00a0<em>physician<\/em>, in consultation with\u00a0<em>his<\/em>\u00a0patient, is free to determine, without regulation by the State, that, in\u00a0<em>his<\/em>\u00a0medical judgment, the patient\u2019s pregnancy should be terminated.\u201d This was the money line from\u00a0<em>Roe<\/em>. <\/p>\n<p>As the late-Justice Ruth Bader Ginsburg\u00a0<a href=\"https:\/\/www.law.uchicago.edu\/recordings\/justice-ruth-bader-ginsburg-and-geoffrey-stone-roe-40\" target=\"_blank\" rel=\"noreferrer noopener\">noted<\/a>,\u00a0<em>Roe<\/em>\u00a0was \u201cphysician-centered,\u201d focusing on \u201ca doctor\u2019s freedom to practice his profession as he thinks best.\u201d \u201cThe picture that I got from [<em>Roe<\/em>],\u201d Justice Ginsburg said, \u201cwas tall doctor and little woman needing . . . his advice and care.\u201d<\/p>\n<p><em>Roe<\/em>\u00a0was premised on the lie that bodily autonomy always wins. Yet the law has always recognized that one\u2019s right to autonomy does not exist in isolation. One\u2019s right to swing his arm \u201c<a href=\"https:\/\/www.supremecourt.gov\/opinions\/13pdf\/13-354_olp1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ends just where the other man\u2019s nose begins<\/a>.\u201d Thus, none of us has the right to injure another person in the exercise of our own bodily autonomy. That\u2019s why murder is a crime in every state. Yet\u00a0<em>Roe<\/em>\u00a0placed bodily autonomy over everything else, allowing for the purposeful destruction of a second life.<\/p>\n<p><em>Roe<\/em>\u00a0also lied to women by telling them their children were the enemy. As Ryan Anderson\u00a0<a href=\"https:\/\/www.goodreads.com\/book\/show\/59805658-tearing-us-apart\" target=\"_blank\" rel=\"noreferrer noopener\">explains<\/a>, \u201cA mother\u2019s womb should be the safest place in the world, a sanctuary where the unborn child can grow and develop for nine months before emerging into the community of his or her family.\u201d <\/p>\n<p>Abortion distorts that relationship. It tells a pregnant woman that she must destroy an innocent life \u2014 her child \u2014 to live a fulfilling life. And it deemphasizes the fact that contraception is widely available with a median failure and cost approaching zero, and that thousands of families in America are waiting to adopt a child. In so doing, abortion terribly corrupts culture.<\/p>\n<p>The\u00a0<em>Dobbs<\/em>\u00a0decision allows women to have a say in what abortion policy should be. It returns the profoundly moral question to the states, giving them the authority to protect life through the democratic process and the ability to empower pregnant women by providing them with the resources they need to flourish.
