And if something happens after birth where there is some sort of malpractice or homicide or anything to that nature after the baby is born, then they can certainly be investigated by investigators.\u201d<\/p>\n<p class=\"p1\">Melendez asked how an investigation could be carried out if the bill specifically says an investigation cannot happen by a coroner.<\/p>\n<p class=\"p1\">\u201cYour bill says that the cause of death can be placed on the death certificate, but it cannot be investigated. The coroner may not start an inquest,\u201d Melendez pressed.<\/p>\n<p class=\"p1\">Wicks added, \u201cAfter a baby is born, if some sort of malpractice happens, that can be investigated. If something happens in utero, and there\u2019s a stillbirth, then a doctor would have to determine\u2026\u201d<\/p>\n<p class=\"p1\">Melendez continued to push Wicks, questioning, \u201cWhere in your bill does it say it can still be investigated?\u201d<\/p>\n<p class=\"p1\">Wicks later mentioned women who have been put in jail for a stillbirth, and Melendez pointed out that they were released after several years. According to <a href=\"https:\/\/www.californiafamily.org\/2022\/07\/assemblywoman-faces-questions-on-whether-her-bill-allows-killing-infants-who-survive-abortions\/\">reporting<\/a> by the California Family Council, as well as <a href=\"https:\/\/calmatters.org\/justice\/criminal-justice\/2022\/02\/stillbirth-prison-manslaughter\/\">CalMatters<\/a>, these cases concerned women who took methamphetamines during their pregnancies.<\/p>\n<p class=\"p1\">\u201cBut your bill doesn\u2019t talk about criminalizing someone just on the basis of being penalized for a stillbirth. You have gone far beyond the boundaries of that,\u201d Melendez pushed. \u201cAnd you are talking about in any circumstance you cannot investigate the death of an infant, under any circumstances, as long as it was a self-managed abortion, or miscarriage, stillbirth, and you can\u2019t even investigate the person who helped her do it.\u201d<\/p>\n<p class=\"p1\">Wicks interrupted, saying it wasn\u2019t true and then repeated her claim that \u201cfull investigations can take place\u201d after a baby is born. \u201cIf something happens in utero, we\u2019re trying to clarify the language,\u201d she added.<\/p>\n<p class=\"p1\">\u201cYour bill says otherwise,\u201d Melendez pressed.<\/p>\n<p>In a later hearing, Melendez noted that the information about the cause of death cannot be utilized for a reason to bring forward a criminal case.<\/p>\n<p>Melendez added that the bill makes it so that a baby does not need to be given care if it survives and was injured during an abortion, due to the \u201comissions\u201d wording in the bill\u2019s language that states \u201ca person shall not be subject to civil or criminal liability or penalty, or otherwise deprived of their rights under this article, based on their actions or omissions with respect to their pregnancy.\u201d<\/p>\n<p>A recess was called after Melendez asked the question.<\/p>\n<p class=\"p1\">Melendez later <a href=\"https:\/\/twitter.com\/senatormelendez\/status\/1543420421738881024\">tweeted<\/a>, \u201cAB 2223 is the worst bill I\u2019ve seen.
