The case could force justices to address an issue they explicitly avoided when they <a href=\"https:\/\/www.theepochtimes.com\/supreme-court-allows-biden-administration-to-end-trumps-remain-in-mexico-asylum-policy_4565236.html\">recently said<\/a> Biden could end the Trump-era \u201cRemain in Mexico\u201d program, which forced many asylum seekers to wait in Mexico until their claims were heard.<\/p>\n<p>In the majority opinion, justices said they \u201cneed not and do not decide\u00a0whether the detention requirement\u201d outlined in federal law \u201cis subject to principles of law enforcement discretion, as the Government argues, or whether the Government\u2019s current practices simply violate that provision.\u201d<\/p>\n<div class=\"author_wrapper\">\n<div class=\"one_author_block round\">\n<div class=\"top_row\">\n\t\t\t\t\t<a href=\"https:\/\/www.theepochtimes.com\/author-zachary-stieber\"><\/a><\/p>\n<p>Follow<\/p>\n<\/div>\n<p>Zachary Stieber covers U.S. and world news.
