A federal appeals court <a href=\"https:\/\/www.dailywire.com\/news\/breaking-federal-court-places-hold-on-juul-ban\">approved a request<\/a> from Juul to halt the agency\u2019s order.<\/p>\n<p>How did the upstart vaping brand become a regulatory pariah in such a short time?<\/p>\n<p>Crown Juul<\/p>\n<p>Juul Labs spun off from a cannabis company, Pax Labs, in 2017 and almost immediately became a business and cultural phenomenon. Like other e-cigarette companies, rather than producing tobacco products, Juul focused on <a href=\"https:\/\/www.juul.com\/learn\/device\">isolating nicotine<\/a> \u2014 the addictive compound in tobacco \u2014 and delivering it through water vapor.<\/p>\n<p>The product and others in its category were quickly replacing cigarettes as the contraband of choice for American teenagers. In 2007, over 46% of 12th graders had tried cigarettes; by 2017, 36% had tried vaping, while only 27% had tried cigarettes, according to University of Michigan data published in <a href=\"https:\/\/www.wsj.com\/articles\/schools-parents-fight-a-juul-e-cigarette-epidemic-1522677246\">The Wall Street Journal<\/a>.<\/p>\n<p>Rather than swiping cigarettes, high school teachers and administrators found themselves confiscating slim devices that looked like flash drives to the untrained eye.<\/p>\n<p>\u201cWe go for a walk. We stop in the bathroom. It\u2019s not uncommon to see a circle of kids passing it around,\u201d Steve Lehman, the principal of Northern High School in Pennsylvania, told The Wall Street Journal in 2018. \u201cThat\u2019s where we confiscate.\u201d<\/p>\n<p>By the summer of that year, Juul sales had <a href=\"https:\/\/www.cnbc.com\/2018\/07\/02\/juul-e-cigarette-sales-have-surged-over-the-past-year.html\">surged nearly 800%<\/a> \u2014 granting the company a 68% market share in the e-cigarette category. A $1.2 billion fundraising round <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2018-06-29\/e-cigarette-maker-juul-labs-is-raising-1-2-billion\">valued<\/a> Juul at a stunning $15 billion \u2014 a figure that was upgraded to $38 billion months later, once Altria, the company formerly known as Philip Morris and the manufacturer of Marlboro cigarettes, <a href=\"https:\/\/www.reuters.com\/article\/uk-juul-valuation\/e-cigarette-maker-juul-cuts-valuation-to-10-billion-memo-idUSKBN27E3B8\">snagged<\/a> a 35% stake in the company.<\/p>\n<p>Around the same time, the FDA \u2014 a federal agency under the fold of the U.S. Department of Health and Human Services \u2014 <a href=\"https:\/\/www.dailywire.com\/news\/fda-threatens-ban-vaping-products-due-teenage-use-kassy-dillon\">reported<\/a> \u201cclear signs\u201d that use of the e-cigarettes had reached \u201can epidemic proportion.\u201d<\/p>\n<p>\u201cWhile we remain committed to advancing policies that promote the potential of e-cigarettes to help adult smokers move away from combustible cigarettes, that work can\u2019t come at the expense of kids,\u201d former FDA Commissioner Scott Gottlieb <a href=\"https:\/\/www.fda.gov\/news-events\/press-announcements\/fda-takes-new-steps-address-epidemic-youth-e-cigarette-use-including-historic-action-against-more\">said<\/a> in 2018. \u201cWe cannot allow a whole new generation to become addicted to nicotine.\u201d<\/p>\n<p>At the same time, state governments began slamming Juul with lawsuits over its marketing practices, alleging that the company was intentionally peddling its devices to young people.<\/p>\n<p>The state of North Carolina <a href=\"https:\/\/ncdoj.gov\/attorney-general-stein-reaches-agreement-with-juul-for-40-million-and-drastic-business-changes\/\">sued<\/a> the company in 2019 for \u201cdesigning, marketing, and selling its e-cigarettes to attract young people and for misrepresenting the potency and danger of nicotine in its products.\u201d One year later, a <a href=\"https:\/\/www.mass.gov\/doc\/juul-complaint\/download\">complaint<\/a> from the commonwealth of Massachusetts argued that the company \u201cengaged in unfair and deceptive acts and practices\u201d by \u201cselling nicotine products to children, adolescents, and other consumers younger than the minimum legal sales age.\u201d<\/p>\n<p>Juul filed a permanent tobacco product application with the FDA \u2014 only for the agency to <a href=\"https:\/\/www.fda.gov\/news-events\/press-announcements\/fda-denies-authorization-market-juul-products\">decide<\/a> in June 2022 that the documents \u201clacked sufficient evidence regarding the toxicological profile of the products to demonstrate that marketing of the products would be appropriate for the protection of the public health.\u201d Accordingly, Juul devices and four types of pods have been served marketing denial orders and will receive the FDA\u2019s \u201chighest enforcement priorities.\u201d<\/p>\n<p>Shortly thereafter, the U.S. Court of Appeals for the D.C. Circuit approved a halt on the FDA\u2019s order \u2014 rendering the fate of Juul uncertain.<\/p>\n<p>Smoked Out<\/p>\n<p>Curiously, the regulatory treatment of e-cigarettes varies drastically across the pond.<\/p>\n<p>The United Kingdom\u2019s <a href=\"https:\/\/www.nhsinform.scot\/healthy-living\/stopping-smoking\/reasons-to-stop\/tobacco\">National Health Service<\/a> concluded that although \u201cnicotine is a very addictive substance,\u201d it is \u201crelatively harmless\u201d \u2014 because it is truly the \u201ccarbon monoxide, tar and other toxic chemicals in tobacco smoke that will cause serious damage\u201d to one\u2019s health. Nevertheless, the proportion of American adults that believe e-cigarettes are more harmful than conventional cigarettes rose substantially from 2012 to 2017, according to research from <a href=\"https:\/\/jamanetwork.com\/journals\/jamanetworkopen\/fullarticle\/2729471\">Georgia State University<\/a> and other entities.<\/p>\n<p>It is understandable for regulators to target products that could produce addiction in young people \u2014 but why do they oppose the e-cigarette category as a whole? <a href=\"https:\/\/www.heritage.org\/public-health\/commentary\/governments-war-e-cigarettes-ignores-their-benefits\">Heritage Foundation<\/a> research fellow Daren Bakst postulated in 2019 that some \u201cirrationally justify their dislike for the products based on a dislike of big tobacco companies\u201d \u2014 and thereby leverage \u201cconcern over youth usage of e-cigarettes as a way to demonize the products.\u201d<\/p>\n<p>Indeed, the Biden administration\u2019s health apparatus has by no means been clear-headed on its drug policies.
