Under federal law, only federal agents are empowered to enforce immigration law.<\/p>\n<p>\u201cWhile President Biden refuses to do his job and enforce the immigration laws enacted by Congress, the State of Texas is once again stepping up and taking unprecedented action to protect Americans and secure our southern border,\u201d Abbott said in a <a href=\"https:\/\/gov.texas.gov\/news\/post\/governor-abbott-authorizes-texas-national-guard-texas-department-of-public-safety-to-return-illegal-immigrants-to-border\">statement<\/a>. \u201cThe cartels have become emboldened and enriched by President Biden\u2019s open border policies, smuggling in record numbers of people, weapons, and deadly drugs like fentanyl.\u201d<\/p>\n<p>Abbott stopped short of declaring the immigration crisis an \u201cinvasion,\u201d a declaration sought by some Texas counties along the border and other critics of the Biden administration\u2019s border policies. Abbott\u2019s order makes reference to the federal government\u2019s constitutional duty to resist \u201cinvasion,\u201d however.<\/p>\n<p>\u201cPresident Biden\u2019s failure to faithfully execute the immigration laws enacted by Congress confirms that he has abandoned the covenant, in Article IV, \u00a7 4 of the U.S. Constitution, that \u2018[t]he United States \u2026 shall protect each [State in this Union] against Invasion,\u2019\u201d the order says.<\/p>\n<p>Two immigration hawks pushing Abbott to declare an invasion, Center for Renewing America\u2019s Russ Vought and Ken Cuccinelli, reacted critically to Abbott\u2019s Thursday announcement.<\/p>\n<p>The executive order \u201cdoes not appear to formally declare an invasion\u201d or \u201cdirect [state law enforcement] to remove illegals across the border directly to Mexico,\u201d Vought and Cuccinelli told <a href=\"https:\/\/www.texastribune.org\/2022\/07\/07\/texas-greg-abbott-state-police-border\/\">The Texas Tribune<\/a>.<\/p>\n<p>\u201cThat is critical,\u201d they said. \u201cOtherwise this is still catch and release.\u201d<\/p>\n<p>Abbott launched <a href=\"https:\/\/www.dailywire.com\/news\/greg-abbott-launches-operation-lone-star-to-combat-crisis-caused-by-biden-administration-policies\">Operation Lone Star<\/a> in March 2021 as migration across the southern border began to rise. The Texas governor has assigned thousands of state troopers and national guardsmen to patrol the border to combat drug smuggling and human trafficking.<\/p>\n<p>The Texas initiative is reportedly under investigation by the Department of Justice\u2019s Civil Rights Division over potential violations of migrants\u2019 civil rights.
