Louie Gohmert says &#8216;if you have evidence that\u2019s of an exonerating nature for the defendant, you have to turn that over.&#8217;<\/p>\n<div>\n<p>As Jan. 6 prisoners continue to languish in jail without trials, without bond and in subhuman conditions, two Jan. 6 attorneys are claiming the government is manufacturing evidence to arrest and incarcerate them. Rep. Louie Gohmert (R-Texas) says the government is also \u201chiding evidence\u201d that could possibly exonerate some of them.<\/p>\n<p>This is not the first time Democrats have manufactured evidence to support their allegations in a legal proceeding.<\/p>\n<h2>A History of Fabricating Evidence<\/h2>\n<p><a href=\"https:\/\/www.theepochtimes.com\/fisa-spying-records-prove-use-of-clinton-funded-dossier_2600587.html\">In July of 2018<\/a>, the infamous Steele dossier was revealed to be little more than a collection of unverified opposition research funded by Hillary Clinton\u2019s presidential campaign and the Democratic National Committee (DNC), to obtain a warrant to spy on former Trump campaign volunteer Carter Page and to derail the Trump campaign.<\/p>\n<p>During a Sept. 26, 2019, Intelligence Committee hearing, Rep. Adam Schiff (D-Calif.) read a\u00a0<a href=\"https:\/\/www.theepochtimes.com\/adam-schiff-fabricates-trump-transcript-during-house-hearing-claims-it-was-a-parody_3097379.html\">fabricated transcript of a phone call<\/a> between former\u00a0President Donald Trump\u00a0and Ukrainian President Volodymyr Zelenskyy. When he was caught, he claimed it was \u201ca parody.\u201d<\/p>\n<p>During the <a href=\"https:\/\/www.theepochtimes.com\/impeachment-managers-present-no-new-evidence-of-incitement_3692792.html\">first impeachment trials<\/a> in February 2021, Rep. Eric Swalwell (D-Calif.)\u00a0used a photoshopped version\u00a0of a Twitter post Trump re-tweeted about supporters \u201cfighting\u201d for the country to make it seem more ominous.<\/p>\n<p>After being caught and being forced to admit they\u00a0<a href=\"https:\/\/www.theepochtimes.com\/house-jan-6-committee-confirms-it-altered-text-message-between-meadows-and-jordan_4159470.html\" target=\"_blank\" rel=\"noopener\">doctored a text message<\/a>\u00a0between Rep. Jim Jordan (R-Ohio) and former White House chief of staff Mark Meadows during the December 2021 Jan. 6 hearings, and also excluded content\u00a0about how they had wanted former Vice President Mike Pence to handle electoral votes during the Joint Session of Congress, Jordan further opined that their statement saying \u201cWe regret the error,\u201d is really government-speak for, \u201cWe got caught lying.\u201d<\/p>\n<p>At the televised House committee hearing related to the protests that took place at the U.S. Capitol in Washington, D.C., on Jan. 6, 2021\u2014Jordan\u00a0said\u00a0members of the House select committee <a href=\"https:\/\/www.theepochtimes.com\/rep-jordan-says-house-jan-6-committee-altered-evidence-showing-nothing-new_4530723.html?utm_source=mr_recommendation&amp;utm_medium=left_sticky\">had altered a text message<\/a> exchange between him and former\u00a0White House chief of staff Mark Meadows \u201cand lied to the American people about it.\u201d<\/p>\n<h2>J-6 Cases: \u2018Manipulating Evidence\u2019<\/h2>\n<p>Joseph McBride, an attorney for multiple Jan. 6 prisoners and defendants, is certain the government is \u201cmanipulating evidence.\u201d<\/p>\n<p>\u201cIn terms of attorneys,\u201d McBride told The Epoch Times, \u201cI\u2019m probably the most outspoken attorney in the United States of America who is representing Jan. 6 defendants.\u201d<\/p>\n<p>McBride said he has \u201cfive, going on six\u201d criminal defendants related to Jan. 6 and three civil rights cases. He also represented five Jan. 6 defendants before the Jan. 6 committee. Considering the depth of his involvement, McBride believes he\u2019s \u201cfar and away\u201d the most eligible and outspoken attorney among those attached to the Jan. 6 legal battles.<\/p>\n<p>\u201cYou are not allowed to punish a pre-trial detainee in the United States of America because you are innocent until proven guilty\u201d McBride stated. \u201cIt is only <em>after<\/em> you have been convicted of a crime or plead through a crime that you can be punished for a crime. Punishment for a crime is deprivation of freedom. \u2026\u00a0My clients and others like them have been brutally assaulted. They\u2019ve been locked away in cells for months at a time. They\u2019ve been denied medical care and have had their human rights, their civil rights, and their constitutional rights violated by the staff at the D.C. gulag, by the staff at the Northern Neck jail because they have been green-lighted by the Biden machine to harm anybody who showed up at the Capitol on January 6 to speak out about the election results. It is unconstitutional. It is immoral. It is un-American. It is wrong.\u201d<\/p>\n<h2>Suspicious Affidavits<\/h2>\n<p>McBride also says the government\u2019s use of lengthy and extravagantly detailed affidavits is \u201cmuch different than your normal cases and they\u2019re frontloading these complaints with facts that aren\u2019t proven\u00a0and these allegations are subsequently being weaponized in the court of public opinion.\u201d<\/p>\n<p>According to McBride, complaint affidavits are generally written as hastily as possible because the only purpose of a complaint affidavit is to initiate the legal process by establishing probable cause. Complaint affidavits are normally followed quickly by the return of an indictment by a grand jury.<\/p>\n<p>But the Jan. 6 complaint affidavits can run in excess of 20, 30, 40, and even 50 pages long, which begs the question of \u201cwhy?\u201d<\/p>\n<p>For McBride, the answer is simple. Because Department of Justice (DOJ) policy only allows the government to make public comments about matters that are already a matter of public record, making sure all of that detail is part of the public record enables the government to release this information to the public to destroy the reputations of the accused ahead of a trial.<\/p>\n<p>Another Jan. 6 attorney, Bill Shipley, is equally convinced the government is manufacturing evidence to support a narrative.<\/p>\n<p>Shipley has called into question the validity of photo and video screenshot \u201cevidence\u201d used in three of his cases. Two of them are outlined below.<\/p>\n<p>According to the 14-page Criminal Complaint (<a href=\"https:\/\/americangulag.org\/wp-content\/uploads\/2021\/08\/1-SEALED-COMPLAINT-as-to-BRIAN-CHRISTOPHER-MOCK.pdf\">pdf<\/a>), Brian Christopher Mock has been charged with: \u201cAssaulting, Resisting, or Impeding Certain Officers, Knowingly Entering or Remaining in any Restricted Building or Grounds Without Lawful Authority; Disorderly and Disruptive Conduct in a Restricted Building or Grounds, Obstruction of Law Enforcement During Civil Disorder, Acts of Physical Violence in any of the Capitol Buildings or Grounds.\u201d<\/p>\n<p>However, all of the charges are based on screen grabs from videos that do not confirm the allegations.<\/p>\n<p>Shipley told The Epoch Times \u201cboth the government and the court have acknowledged that video 1 does not show any actual assault by defendant Mock as alleged in the indictment.\u201d<\/p>\n<p>\u201cIf video 1 showed Mr. Mock kicking the fallen officer it would have been simple to write, \u2018The video shows Mr. Mock kicking the fallen officer,&#8217;\u201d Shipley said. \u201cJudge Howell didn\u2019t write that because video 1 doesn\u2019t show that.\u00a0 The government knows it, Mr. Mock knows it, and Judge Howell knew it.<\/p>\n<p>\u201cThe simple reality is that video 1 shows the unidentified victim officer already on the ground when Mr. Mock is first seen on camera. There are two other protesters\u2014one wearing camouflage and the other wearing a red hat\u2014on the ground with the victim officer at the moment defendant Mock is first seen. Defendant Mock is standing in close proximity to the three of them.\u00a0 He is not seen shoving the fallen officer to the ground.\u201d<\/p>\n<p>According to Shipley, the entire segment of video 1, which is relevant to the first alleged assault, lasts only four seconds. At no point during those four seconds does video 1 show Mock\u2019s foot making contact with any part of the Officer\u2019s body.<\/p>\n<p>\u201cNevertheless, the government made a proffer in its emergency motion (<a href=\"https:\/\/americangulag.org\/wp-content\/uploads\/2021\/08\/6-Emergency-MOTION-to-Stay-MOTION-to-Review-Release-Order-by-USA-as-to-BRIAN-CHRISTOPHER-MOCK.pdf\">pdf<\/a>) that the video showed defendant Mock shoving the officer to the ground and then kicking the officer\u201d and \u201crelied heavily on a single screenshot from the video that appears to show defendant Mock\u2019s right foot off the ground.\u201d<\/p>\n<p>\u201cIf the government had video of Mr. Mock\u2019s right foot striking the victim officer, it is quite certain it would have included a screenshot of that particular moment instead of the one it choose,\u201d Shipley argued. \u201cThe obvious conclusion is the government has no such video.\u00a0 It hasn\u2019t produced one in discovery.\u201d<\/p>\n<figure id=\"attachment_4550230\" class=\"wp-caption alignnone\"><figcaption class=\"wp-caption-text\"><noscript><img decoding=\"async\" class=\"size-full wp-image-4550230\" src=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2022\/06\/22\/Mock1.png\" alt=\"Screengrab from video used by the FBI to prove their allegation that Bryan Mock \" kicked \/><\/noscript><\/figcaption>&nbsp;<\/p>\n<p>Screengrab from video used by the FBI to prove their allegation that Bryan Mock \u201ckicked\u201d a police officer, who was laying on the ground. (FBI criminal complaint for Bryan Mock)<\/figure>\n<p>In another incident, Mock is accused of shoving an officer to the ground, causing and injury to the officer\u2019s right elbow.<\/p>\n<p>According to the 14-page criminal complaint (<a href=\"https:\/\/americangulag.org\/wp-content\/uploads\/2021\/08\/1-SEALED-COMPLAINT-as-to-BRIAN-CHRISTOPHER-MOCK.pdf\">pdf<\/a>), filed June 10, 2021, by Special Agent Beth Alvarez, \u201cOfficer [SK] recalled being shoved onto his back by one of the rioters. During the melee, Officer [SK\u2019s] right\u00a0elbow was hit\u00a0right in the area where two protective pads on his arm meet.\u201d<\/p>\n<p>When Mock was arrested, Alvarez\u2014the affiant on the complaint affidavit\u2014wrote the following statement under oath:<\/p>\n<blockquote><p>\u201cAccording to Victim 2,\u00a0his right elbow hit the ground\u00a0right in the area where two pads come together after the shove, causing excruciating pain at the time of impact.\u201d<\/p><\/blockquote>\n<p>The complaint affidavit is dated June 10, 2021, precisely one month after the interview of the officer. During the 30 days between those two documents, the mechanics of how the officer injured his elbow changed. She first wrote he suffered the injury to his elbow \u201cduring the melee,\u201d without reference to Mock or his actions. However, one month later, Alvarez wrote that his right elbow hit the ground right in the area where the two pads come together as a result of Mock\u2019s shove.<\/p>\n<p>Brian Mock has created a <a href=\"https:\/\/www.givesendgo.com\/freebrianmock\">GiveSendGo account<\/a> to help offset his ongoing legal expenses.<\/p>\n<p>According to a 42-page criminal complaint (<a href=\"https:\/\/americangulag.org\/wp-content\/uploads\/2022\/04\/1-Criminal-Complaint-1.pdf\">pdf<\/a>), Denny is charged with: \u201cAssaulting, Resisting, or Impeding Certain Officers with a Deadly or Dangerous Weapon, Civil Disorder, Obstruction of an Official Proceeding, Conspiracy to Obstruct an Official Proceeding, Entering and Remaining in a Restricted Building or Grounds with a Deadly or Dangerous Weapon, Disorderly and Disruptive Conduct in a Restricted Building or Grounds with a Deadly or Dangerous Weapon, Engaging in Physical Violence in a Restricted Building or Grounds with a Deadly or Dangerous Weapon, and an Act of Physical Violence in the Capitol Building.\u201d<\/p>\n<p>On page 27, Special Agent James P. Farris swore under oath:<\/p>\n<blockquote><p>\u201cOfficer K.K. then deployed a crowd-control spray and Denney retreated into the crowd.<\/p>\n<p>Less than a minute later, Denney picked up a long\u00a0metal pole\u00a0from the ground which he swung towards Officer K.K., as depicted below.\u201d<\/p><\/blockquote>\n<figure id=\"attachment_4563957\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large\" src=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2022\/06\/28\/Page27DennyCompplaint.jpg\" width=\"826\" height=\"784\" \/><figcaption class=\"wp-caption-text\"><noscript><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-4563957\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/07\/Page27DennyCompplaint-600x569-1.jpg\" alt=\"Page 27 from the Criminal Complaint filed by James. (FBI criminal complaint)<\/figure>\n<p>Shipley said when the government presented this case to the grand jury on the morning of March 7, 2022, the single-count grand jury indictment that was returned charged Denney with \u201cusing a dangerous or deadly weapon, that is, a long\u00a0gray-in-color pole,\u00a0did forcibly assault\u201d Officer K.K. of the Metropolitan Police Department.<\/p>\n<p>However, the body-worn camera footage from Officer K.K.\u2019s camera showed that the pole was flexed in a manner inconsistent with metal.<\/p>\n<figure id=\"attachment_4550224\" class=\"wp-caption alignnone\"><a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2022\/06\/22\/LukeDennyMetalPoleFlexing.png\"><img decoding=\"async\" class=\"lazy size-medium wp-image-4550224\" src=\"https:\/\/www.theepochtimes.com\/assets\/themes\/eet\/images\/white.png\" alt=\"Screengrab from video used in Criminal Complaint by the FBI to show Lucas Denny was using a metal pole, classified as a dangerous or deadly weapon, to strike police officers. Lucas Denny is currently incarcerated for his participation in the Capitol protest in Washington on\u00a0Jan. 6, 2021. (FBI criminal complaint)<\/figure>\n<p class=\"v1MsoNormal\">\u201cThis is not a circumstance where Special Agent Farris was acting under time pressure,\u201d Shipley contends. \u201cHis affidavit in support of the complaint was signed on December 7, 2021, 11 months after the incident. The fact that Farris would be so careless\u2014at best\u2014as to describe the object as a \u2018metal pole\u2019 when the video clearly shows it was not\u2014a fact conceded by the government when it was unwilling to go on the record with the grand jury that the pole in question as made of metal\u2014is more than sufficient reason to adopt a cautious approach to any of the other conclusions drawn by Farris in his affidavit.\u201d<\/p>\n<p><a href=\"https:\/\/www.mylawquestions.com\/what-is-a-false-affidavit.htm\">According to My Law Questions<\/a>: \u201cA false\u00a0affidavit\u00a0is one in which a person signs it and swears that the statements attested to in the document are true, complete, and accurate when the statements are in fact misleading or false. Submitting a false affidavit is a criminal offense and constitutes\u00a0perjury\u00a0in most jurisdictions.\u201d<\/p>\n<p>According to a 17-page criminal complaint (<a href=\"https:\/\/americangulag.org\/wp-content\/uploads\/2021\/08\/worrell_-_statement_of_facts_redacted_0.pdf\">pdf<\/a>),\u00a0Christopher Worrell is charged with: \u201cEntering and Remaining in a Restricted Building or Grounds with a Deadly or Dangerous Weapon, Disorderly and Disruptive Conduct in a Restricted Building or Grounds with a Deadly or Dangerous Weapon, Engaging in Physical Violence in a Restricted Building or Grounds Using a Deadly or Dangerous Weapon, Act of Physical Violence in the Capitol Grounds or Buildings, Civil Disorder, Assaulting, Resisting, or Impeding Certain Officers Using a Dangerous Weapon.\u201d<\/p>\n<p>Despite the repeated allegations of using\/possessing a \u201cdeadly or dangerous weapon,\u201d specifically spraying \u201cpepper gel\u201d at Capitol Hill police, there is no evidence of Worrell actually spraying pepper gel at police officers.<\/p>\n<p>The FBI Task Manager who filed the report admits from the beginning, he did \u201cnot currently know with certainty the target at which WORRELL was spraying.\u201d<\/p>\n<p>In the criminal complaint is a photo, supplied by an unnamed photographer, that shows two Capitol Police officers (circled in green) standing atop a staircase near a dark statue wrapped in plastic. Both are leaning forward, spraying the people below\u2014who are standing peacefully and posing no threat to them\u2014in the face with pepper gel. Multiple people in the crowd can be seen covering their faces and reacting in pain. Worrell (circled in red) can be seen standing a sizeable distance away, recording the incident like several others with his cell phone.<\/p>\n<p>Then, using a screenshot from a video that \u201cappears to show\u201d Worrell \u201cat the time\u201d of the pepper gel assault, we are shown there is a man dressed in black standing where the police <em>had<\/em> been standing, as well as a woman with red gloves covering her face. Worrell can be seen spraying pepper gel beyond these two people. However, it is unclear what or who he is aiming at.<\/p>\n<figure id=\"attachment_4510420\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large\" src=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2022\/06\/03\/Screenshot-2022-05-31-113635.png\" width=\"627\" height=\"421\" \/><figcaption class=\"wp-caption-text\"><noscript><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-4510420\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/07\/Screenshot-2022-05-31-113635-600x403-1.png\" alt=\"Photo of Chris Worrell spraying a canister of pepper gel while at the capitol building on January 6, 2021.\" width=\"600\" height=\"403\" \/><\/noscript><\/figcaption>&nbsp;<\/p>\n<p>Photo of Chris Worrell spraying a canister of pepper gel while at the capitol building on Jan. 6, 2021. (FBI criminal complaint)<\/figure>\n<p>In another screen grab from the video, this one considerably blurred, you can see several other people gathered at the top of the same steps near the dark statue wrapped in plastic, including another man dressed in black with a mask covering his face. But there are no police officers and Worrell does not appear to be there. Yet another pair of screen grabs from the video do show Worrell. However, he is clearly standing at a distance <em>away<\/em> from the stairs.<\/p>\n<p>As <a href=\"https:\/\/www.theepochtimes.com\/exclusive-police-report-proves-plainclothes-electronic-surveillance-unit-members-were-embedded-among-jan-6-protesters_4527036.html\">reported by The Epoch Times<\/a>\u00a0on June 20, several reports and first-hand eyewitness accounts describe how there was a \u201ccovert cadre\u201d of \u201cprovocateurs\u201d\u2014widely suspected to be\u00a0<a href=\"https:\/\/www.nationalreview.com\/corner\/on-entrapment-instigation-and-january-6\/\" target=\"_blank\" rel=\"noopener\">federal agents<\/a>\u00a0and Capitol Police officers\u2014who were disguised to mingle among the otherwise peaceful protested for the purpose of instigating acts of violence during the protests for the purposes of entrapment. The Epoch Times further revealed evidence that now proves\u00a0that \u201cplainclothes\u201d members of a special Electronic Surveillance Unit (ESU) were also embedded among the protesters\u00a0to \u201cdocument the actions of the demonstrators and MPD\u2019s response to any civil disobedience or criminal activity.\u201d<\/p>\n<figure id=\"attachment_4550238\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large\" src=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2022\/06\/22\/WorrellPepperGel1.png\" width=\"622\" height=\"249\" \/><figcaption class=\"wp-caption-text\"><noscript><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-4550238\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/07\/WorrellPepperGel1-600x240-1.png\" alt=\"Screengrab from video used by the FBI to prove the allegation that Chris Worrell sprayed police with pepper gel. (FBI criminal complaint)<\/figure>\n<p>However, despite the multiple\u00a0photographs and screenshots from all the videos used to allege that Worrell \u201cappeared\u201d to be spraying police with pepper gel, there are <em>no<\/em> photos showing the police were actually standing there <em>when<\/em> Worrell was spraying the pepper gel or any photos showing the police being hit with or reacting to being hit with pepper gel.<\/p>\n<p>Moreover, after admitting he did not \u201ccurrently know with certainty the target at which WORRELL was spraying,\u201d and having no evidence showing the target of the pepper gel, why did the investigating agent still said he believes \u201cthe likely intended target of WORRELL\u2019s pepper pray assault was the line of law enforcement officers present in these photographs.\u201d<\/p>\n<p>As <a href=\"https:\/\/www.theepochtimes.com\/jan-6-prisoner-who-was-denied-cancer-treatment-now-in-dire-straits_4502438.html\">The Epoch Times reported<\/a> June 13, Worrell, who was released by order of a federal judge after being denied cancer treatment for eight months, is now \u201cin dire straights,\u201d according to his girlfriend.\u00a0The cost for his treatments is estimated at about $30,000. Then there is the additional chemotherapy to treat the returning symptoms. For that, he will need at least another $50,000. There is a\u00a0<a href=\"http:\/\/givesendgo.com\/flotilla\" target=\"_blank\" rel=\"noopener\">GiveSendGo account<\/a>\u00a0to raise money for Worrell\u2019s treatment.<\/p>\n<h2>Evidence Withheld<\/h2>\n<p>Machinations such as this remind Gohmert of the Ted Stevens case from back in 2008.<\/p>\n<p>According to a 28-page indictment (<a href=\"https:\/\/www.nacdl.org\/getattachment\/7b68c2c8-d043-42da-854b-cbb5b13dff31\/stevens-indictment.pdf\">pdf<\/a>), former Sen. Ted Stevens (R-Alaska) was charged with seven counts of making false statements on his Senate financial disclosure forms from 2001 to 2006 and with concealing more than $250,000 worth of gifts, including home renovations, that he received from an Alaska oil services company.<\/p>\n<p>Stevens was prosecuted and convicted and subsequently lost his reelection campaign. Shortly before his tragic <a href=\"https:\/\/newsone.com\/658605\/ted-stevens-death-gruesome-details-of-alaska-plane-crash-emerge\/\">death in a plane crash<\/a> in August 2010, Stevens was exonerated after a whistleblower revealed that prosecutors withheld critical evidence of the Senator\u2019s innocence in violation of his constitutional rights.<\/p>\n<p>\u201cIn the Ted Stevens case, we found out the FBI created evidence and hid evidence in order to get a conviction,\u201d Gohmert told The Epoch Times. \u201cHe ended up being exonerated but only after he lost his election. We also know that Project Veritas caught a Democratic leader saying we paid for people to come in and instigate violence at Trump events so we could claim Trump was violent.
