Then in 1998, Disney lobbied for an extension that expanded their rights to 95 years.<\/p>\n<p>\u201cThe most recent extension came through the Copyright Term Extension Act in 1998, known to many as the Mickey Mouse Protection Act because of Disney\u2019s heavy lobbying in support of the bill,\u201d <a href=\"https:\/\/www.latimes.com\/business\/story\/2022-05-11\/mickey-mouse-copyright-expiration-disney-under-attack-republicans\">The Los Angeles Times<\/a> noted, adding:<\/p>\n<p><em>From 1987 to 1990 \u2014 around the time the legislation was being voted on \u2014 the Disney Political Action Committee donated $146,519 to federal candidates, while Disney employees gave $474,083 to candidates, plus an additional $133,382 to political parties and other PACs, according to a 1991\u00a0<a href=\"https:\/\/www.latimes.com\/archives\/la-xpm-1991-09-02-mn-1110-story.html\">analysis by The Times<\/a>.<\/em><\/p>\n<p>\u201cYou can use the Mickey Mouse character as it was originally created to create your own Mickey Mouse stories or stories with this character,\u201d Daniel Mayeda, the \u200b\u200bassociate director of the Documentary Film Legal Clinic at UCLA School of Law, explained to <a href=\"https:\/\/www.theguardian.com\/film\/2022\/jul\/03\/mickey-mouse-disney-copyright-expiry?utm_term=Autofeed&#038;CMP=fb_us&#038;utm_medium=Social&#038;utm_source=Facebook#Echobox=1656854906\">The Guardian.<\/a>\u00a0 \u201cBut if you do so in a way that people will think of Disney \u2013 which is kind of likely because they have been investing in this character for so long \u2013 then in theory, Disney could say you violated my copyright.\u201d<\/p>\n<p>The original version of Mickey Mouse debuted in \u201cSteamboat Willie,\u201d appearing premiered at the Colony Theatre on Broadway on November 18, 1928. Since then the character has appeared in over 130 films.<\/p>\n<p>\u201cWhile this first rat-like iteration of Mickey will be stripped of its copyright, Mayeda said Disney retains its copyright on any subsequent variations in other films or artwork until they reach the 95-year mark,\u201d The Guardian noted.<\/p>\n<p>\u201cCopyrights are time-limited,\u201d Mayeda said. \u201cTrademarks are not. So Disney could have a trademark essentially in perpetuity, as long as they keep using various things as they\u2019re trademarked, whether they\u2019re words, phrases, characters or whatever.\u201d<\/p>\n<p>Suzanne Wilson, the head of the U.S. Copyright Office, served as the deputy general counsel for the Walt Disney Company for nearly ten years.<\/p>\n<p>\u201cDisney has been very active in trying to extend copyright terms,\u201d Mayeda concluded. \u201cSuccessfully, they have had their term for Mickey and so forth extended, but I doubt that they\u2019re going to be able to get additional extensions.
