The Environmental Protection Agency that the EPA lacked the authority to curb greenhouse gases in order to bring about a transition away from <a href=\"https:\/\/www.dailywire.com\/topic\/coal\">coal energy<\/a> throughout the country because it was not specifically granted that power by <a href=\"https:\/\/www.dailywire.com\/topic\/congress\">Congress<\/a>. Alexandria Ocasio-Cortez (D-NY)\u00a0<a href=\"https:\/\/www.dailywire.com\/news\/aoc-melts-down-over-supreme-court-doing-its-job-do-away-with-the-whole-thing\">said<\/a> that the decision was \u201ccatastrophic.\u201d Fellow \u201cSquad\u201d member Rep. Rashida Tlaib (D-MI) <a href=\"https:\/\/twitter.com\/RashidaTlaib\/status\/1542567044339666946\">added<\/a>, \u201cFascist SCOTUS guts the EPA\u2019s ability to regulate carbon emissions, fight climate change.\u201d <\/p>\n<p>\u201cThe federal government will be restricted from regulating anything of significance in the absence of a clear Congressional directive to do so,\u201d she added, apparently understanding the decision yet failing to understand Congress is clearly in control of future regulations.<\/p>\n<p>Senator Majority Leader\u00a0 Chuck Schumer (D-NY) also lamented the decision. The plan never went into effect, however: Several states and private plaintiffs challenged it in federal court, and a divided Supreme Court <a href=\"https:\/\/www.scotusblog.com\/2016\/02\/carbon-pollution-controls-put-on-hold\/\">put it on hold in February 2016<\/a>.\u201d<\/p>\n<p>Once President Donald Trump came into power, his administration repealed the Clean Power Plan and instituted a different set of rules known as the \u201cACE Rule.\u201d<\/p>\n<p>In January 2021, \u201cthe U.S. Court of Appeals for the District of Columbia Circuit\u00a0<a href=\"https:\/\/casetext.com\/case\/am-lung-assn-v-envtl-prot-agency\">vacated<\/a>\u00a0the repeal of the Clean Power Plan, vacated the ACE Rule, and sent the issue back to the EPA for more proceedings. The Supreme Court then granted a request by Republican-led states and coal companies to review that ruling; meanwhile, the Biden administration EPA has indicated that it will not reinstate the Clean Power Plan and is instead drafting its own rules on greenhouse-gas emissions from power plants,\u201d\u00a0<a href=\"https:\/\/www.scotusblog.com\/2022\/02\/in-climate-change-case-justices-grapple-with-epas-role-congressional-intent-and-their-own-jurisdiction\/\">according<\/a>\u00a0to SCOTUSblog.<\/p>\n<p>That was challenged by a handful of conservative states, resulting in the ruling against the EPA><\/p>\n<p>\u201cCongress, not the EPA, has the lawmaking power under the United States Constitution,\u201d Bakst said. \u201cThe EPA forgot this.
