The Constitution <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/constitution.congress.gov\/browse\/amendment-14\/section-3\/&#038;source=gmail&#038;ust=1656678391338000&#038;usg=AOvVaw3kvU6RwlcziTxLMoX6m1N4\" href=\"https:\/\/constitution.congress.gov\/browse\/amendment-14\/section-3\/\" target=\"_blank\" rel=\"noopener\">disqualifies<\/a> any such person who has engaged in insurrection.<\/p>\n<p>After the Democrats failed to get a conviction in the Senate, they hurriedly put into motion a desperate, secondary effort to prevent Trump from challenging them in the future: the formation of the J6 committee.<\/p>\n<p>Unlike their previous failed effort, which depended upon a bipartisan consensus, the J6 committee needed no such consensus. It was comprised exclusively of pro-impeachment, anti-Trumpers, who were all determined to see Trump convicted of a crime he didn\u2019t commit.<\/p>\n<p>The J6 committee\u2019s purpose was to create the crime they wanted to accuse Trump of having committed \u2014 inciting an insurrection \u2014 and then to create the evidence they believed would be needed to get a conviction. In other words, they weren\u2019t investigating a crime, they were manufacturing one.<\/p>\n<p>But to get a conviction, the committee would have to convince the Justice Department to bring criminal charges against Trump and this required <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.reuters.com\/world\/us\/what-charges-could-trump-face-over-efforts-overturn-2020-election-2022-06-23\/&#038;source=gmail&#038;ust=1656678391338000&#038;usg=AOvVaw0xb2bzCpOhsDf6YdKiDNFa\" href=\"https:\/\/www.reuters.com\/world\/us\/what-charges-could-trump-face-over-efforts-overturn-2020-election-2022-06-23\/\" target=\"_blank\" rel=\"noopener\">proving<\/a> that Trump had acted with \u201ccorrupt intent.\u201d Because the crime was manufactured, the J6 committee would have to manufacture evidence.<\/p>\n<p>We saw that \u2018evidence\u2019 at Tuesday\u2019s \u2018surprise hearing.\u2019<\/p>\n<p>While it may have been a \u2018surprise\u2019 to Americans, it was the culmination of months of planning by the J6 committee. They had <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/january6th.house.gov\/sites\/democrats.january6th.house.gov\/files\/20211109%2520Hutchinson.pdf&#038;source=gmail&#038;ust=1656678391339000&#038;usg=AOvVaw0n8BAYaGeT7HJACs23-j2x\" href=\"https:\/\/january6th.house.gov\/sites\/democrats.january6th.house.gov\/files\/20211109%20Hutchinson.pdf\" target=\"_blank\" rel=\"noopener\">issued<\/a> a subpoena for testimony from their star witness, Cassidy Hutchinson, on November 9, 2021.\u00a0<\/p>\n<p>Hutchinson\u2019s \u2018bombshell\u2019 testimony on Tuesday was a carefully rehearsed and scripted performance. Her intended audience was federal prosecutors working for Attorney General Merrick Garland.<\/p>\n<p>As promised, Hutchinson\u2019s testimony was a \u2018bombshell,\u2019 but not because it made a compelling case against Trump; rather, because it revealed both the Democrats&#8217; entire contrived strategy and the source of their inspiration: a 1969 Supreme Court case.<\/p>\n<p>Warning: it\u2019s as desperate and stupid as you\u2019d expect.<\/p>\n<p>Clarence Brandenburg, a Ku Klux Klan leader, had been <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.mtsu.edu\/first-amendment\/article\/189\/brandenburg-v-ohio&#038;source=gmail&#038;ust=1656678391339000&#038;usg=AOvVaw1oArTu9JuzxWG1dFS0QNnk\" href=\"https:\/\/www.mtsu.edu\/first-amendment\/article\/189\/brandenburg-v-ohio\" target=\"_blank\" rel=\"noopener\">convicted<\/a> in Ohio after he gave a speech to other Democrats, in which he alluded to the possibility of \u201c<em>revengeance<\/em>\u201d if the federal government continued to \u201csuppress the white, Caucasian race,\u201d and announced a plan for the Klan members to march on Washington D.C.<\/p>\n<p>The Supreme Court <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.oyez.org\/cases\/1968\/492&#038;source=gmail&#038;ust=1656678391339000&#038;usg=AOvVaw3PUPsJsyMQh3SkF_IErAg5\" href=\"https:\/\/www.oyez.org\/cases\/1968\/492\" target=\"_blank\" rel=\"noopener\">ruled<\/a> that the Ohio law, which made illegal advocating &#8220;crime, sabotage, violence, or unlawful methods of terrorism as a means of accomplishing industrial or political reform,\u201d violated Brandenburg\u2019s right to free speech.\u00a0<\/p>\n<p>While the SCOTUS ruled that Ohio\u2019s law was unconstitutional, the opinion also <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.oyez.org\/cases\/1968\/492&#038;source=gmail&#038;ust=1656678391339000&#038;usg=AOvVaw3PUPsJsyMQh3SkF_IErAg5\" href=\"https:\/\/www.oyez.org\/cases\/1968\/492\" target=\"_blank\" rel=\"noopener\">defined<\/a> when free speech <em>could be<\/em> prohibited: if it is &#8220;directed at inciting or producing imminent lawless action\u201d and is &#8220;likely to incite or produce such action.\u201d<\/p>\n<p>Hutchinson\u2019s entire testimony appears to have been literally crafted to fulfill that requirement, which the J6 committee hopes will give the Justice Department enough confidence to prosecute Trump.<\/p>\n<p>Using the SCOTUS case as a blueprint, the J6 committee set out to prove that Trump knew an \u2018insurrection\u2019 was imminent and that his actions were directed at inciting it.<\/p>\n<p>Hutchinson\u2019s <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.npr.org\/2022\/06\/29\/1108573335\/hutchinsons-bombshell-jan-6-testimony-sways-legal-experts-and-conservative-media&#038;source=gmail&#038;ust=1656678391339000&#038;usg=AOvVaw0by3WErGYshafn2kmF6trl\" href=\"https:\/\/www.npr.org\/2022\/06\/29\/1108573335\/hutchinsons-bombshell-jan-6-testimony-sways-legal-experts-and-conservative-media\" target=\"_blank\" rel=\"noopener\">testimony<\/a> that Trump ordered security to &#8220;take the effing [magnetometers] away and let [his] people in,\u201d was intended to demonstrate that Trump knew supporters were \u2018armed,\u2019 and thus <em>wanted\u00a0<\/em>them armed, because Trump planned to incite them to lawless activity later.<\/p>\n<p>Had the partisan J6 committee\u2019s purpose been to investigate the facts, rather than sell a pre-planned case for conviction, it might have <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.nydailynews.com\/news\/politics\/trump-press-secretary-claims-inauguration-grew-largest-crowd-article-1.2952666&#038;source=gmail&#038;ust=1656678391339000&#038;usg=AOvVaw3wMJrMgsoct1Hea8ipUiPC\" href=\"https:\/\/www.nydailynews.com\/news\/politics\/trump-press-secretary-claims-inauguration-grew-largest-crowd-article-1.2952666\" target=\"_blank\" rel=\"noopener\">pointed out<\/a>, for example, that there were no \u2018magnetometers\u2019 present at the mall on Trump\u2019s inauguration day.<\/p>\n<p>Even still, Hutchinson\u2019s own <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.npr.org\/2022\/06\/28\/1108396692\/jan-6-committee-hearing-transcript&#038;source=gmail&#038;ust=1656678391339000&#038;usg=AOvVaw3rSYVEz0G0mIvsoQnKSC01\" href=\"https:\/\/www.npr.org\/2022\/06\/28\/1108396692\/jan-6-committee-hearing-transcript\" target=\"_blank\" rel=\"noopener\">testimony<\/a> undermined the committee\u2019s narrative. She acknowledged that Trump\u2019s motivation for removing the magnetometers was born from a motivation to ensure that the Ellipse, where Trump would give his speech, was fully packed, and the magnetometers were hampering some supporters from entering.<\/p>\n<p>Despite this, the committee and media are using this testimony about magnetometers to make their case that Trump was conspiring to incite imminent lawless action.<\/p>\n<p>Then there\u2019s the infamous \u2018steering wheel story,\u2019 which Hutchinson didn\u2019t even witness. While secondhand hearsay isn\u2019t considered admissible evidence in a court of law, it was welcomed in the J6 committee\u2019s court of lawlessness.\u00a0<\/p>\n<p>Hutchinson <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.npr.org\/2022\/06\/29\/1108573335\/hutchinsons-bombshell-jan-6-testimony-sways-legal-experts-and-conservative-media&#038;source=gmail&#038;ust=1656678391339000&#038;usg=AOvVaw0by3WErGYshafn2kmF6trl\" href=\"https:\/\/www.npr.org\/2022\/06\/29\/1108573335\/hutchinsons-bombshell-jan-6-testimony-sways-legal-experts-and-conservative-media\" target=\"_blank\" rel=\"noopener\">testified<\/a> that she had been told by Tony Ornato, the then-White House deputy chief of staff, that after Trump had been told he wouldn\u2019t be taken to the Capitol to meet the protestors, he furiously lunged from the backseat of the SUV, attempted to grab the steering wheel from the driver, assaulted the driver, and was stopped by Bobby Engel, another secret service agent.<\/p>\n<p>This improbable tall-tale was met with no skepticism but was accepted as fact, because the \u2018surprise hearing\u2019 was a Soviet style show trial, in which propaganda and uncorroborated hearsay were accepted as admissible evidence. In fact, those were the criteria for admissible evidence.<\/p>\n<p>Both the driver and Bobby Engel have categorically <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.vice.com\/en\/article\/7k89ea\/hutchinson-testimony-secret-service-bobby-engel&#038;source=gmail&#038;ust=1656678391339000&#038;usg=AOvVaw0tJIvCcTze5lcN8p8eHrIP\" href=\"https:\/\/www.vice.com\/en\/article\/7k89ea\/hutchinson-testimony-secret-service-bobby-engel\" target=\"_blank\" rel=\"noopener\">denied<\/a> Hutchinso <wbr \/>n\u2019s claims, and Tony Ornato <a data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.foxnews.com\/politics\/tony-ornato-did-not-brief-cassidy-hutchinson-trump-tried-lunge-secret-service-agent-sources&#038;source=gmail&#038;ust=1656678391339000&#038;usg=AOvVaw2kGIfLRjRuoifnmyrHdVFz\" href=\"https:\/\/www.foxnews.com\/politics\/tony-ornato-did-not-brief-cassidy-hutchinson-trump-tried-lunge-secret-service-agent-sources\" target=\"_blank\" rel=\"noopener\">denied<\/a> briefing Hutchinson on her hearsay allegation.<\/p>\n<p>Nor did the J6 committee corroborate Hutchinson\u2019s story before the hearing.\u00a0<\/p>\n<p>The J6 committee isn\u2019t searching for truth. They\u2019re selling a lie; a lie they\u2019re desperately hoping will put Trump in jail.<\/p>\n<p>But like Trump-Russia collusion, Stormy Daniels, and Quid Pro Quo, this too will fail. While the media will continue to claim the committee delivered a bombshell, all they delivered was another dud.<\/p>\n<p>Once again, the Democrats have over promised and under delivered.
