Thomas filled Marshall\u2019s seat with an appointment from President George H.W. Bush after the senior justice retired. Marshall died in 1993. <\/p>\n<p>While two black justices were confirmed to the high court before her, Justice Jackson\u2019s appointment marks the first time a <em>black woman<\/em> will serve on the bench to replace retiring Justice Stephen Breyer, whose last day came as the final opinions were handed down for the court\u2019s latest term Thursday. President Joe Biden made Jackson\u2019s identity as a black woman a <a href=\"https:\/\/thefederalist.com\/2022\/01\/28\/bidens-pledge-to-nominate-a-black-woman-for-scotus-is-racist-and-sexist\/\">prerequisite<\/a> for nomination just as he pledged to select a female running mate in 2020. At her Senate confirmation hearings, however, Justice Jackson was unable to define a \u201cwoman.\u201d<\/p>\n<p>\u201cI\u2019m not a biologist,\u201d Jackson said in response to the question from Tennessee Republican Sen. Marsha Blackburn.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-embed-handler wp-block-embed-embed-handler wp-embed-aspect-16-9 wp-has-aspect-ratio\">\n<div class=\"wp-block-embed__wrapper\">\n<span class=\"geNiSO6HD1JxVZQjko0yA\"><\/p>\n[embedded content]\n<p><\/span>\n<\/div>\n<\/figure>\n<p>Justice Jackson also captured scrutiny from senators who questioned the federal judge\u2019s jurisprudence following <a href=\"https:\/\/thefederalist.com\/2022\/03\/31\/democrats-are-overlooking-the-seriousness-of-child-sex-crimes-to-protect-jackson\/\">sentences<\/a> below federal guidelines in every child pornography case for which records are available. <\/p>\n<p>Three Republicans in the upper chamber ultimately joined Democrats to confirm Judge Jackson to the Supreme Court, including Maine\u2019s Susan Collins, Alaska\u2019s Lisa Murkowski, and Utah\u2019s Mitt Romney. Romney had <a href=\"https:\/\/thefederalist.com\/2022\/04\/05\/after-opposing-ketanji-brown-jackson-on-lower-court-romney-flip-flops-to-support-her-for-scotus\/\">previously voted no<\/a> on Judge Jackson\u2019s nomination less than a year prior for a seat on the D.C.
