Wade<\/a>,<\/em> suggesting that the justices should face an <a href=\"https:\/\/www.dailywire.com\/topic\/impeachment\">impeachment<\/a> inquiry.<\/p>\n<p>\u201cThey lied,\u201d said Democratic New York Rep. <a href=\"https:\/\/www.dailywire.com\/topic\/alexandria-ocasio-cortez\">Alexandria Ocasio-Cortez<\/a> of Justices <a href=\"https:\/\/www.dailywire.com\/topic\/neil-gorsuch\">Neil Gorsuch<\/a> and <a href=\"https:\/\/www.dailywire.com\/topic\/brett-kavanaugh\">Brett Kavanaugh<\/a> during a Sunday interview with \u201cMeet the Press.\u201d\u00a0\u201cThere must be consequences for such a deeply destabilizing action and hostile takeover of our democratic institutions.\u201d<\/p>\n<p>The only problem \u2014 neither justice promised to uphold <em>Roe<\/em>.<\/p>\n<p>Both Kavanaugh and Gorsuch declined to directly address questions about <em>Roe v. Wade<\/em> during their confirmation hearings: Kavanaugh <a href=\"https:\/\/www.nytimes.com\/2018\/09\/06\/us\/politics\/kavanaugh-hearing-confirmation.html\">referred<\/a> to the case as \u201cimportant precedent of the Supreme Court that has been reaffirmed many times,\u201d while Gorsuch <a href=\"https:\/\/www.nytimes.com\/2022\/06\/27\/us\/aoc-roe-abortion-scotus.html\">called<\/a> <em>Roe<\/em> \u201ca precedent of the U.S. Supreme Court that had been reaffirmed.\u201d<\/p>\n<p>\u201cFor a judge to start tipping his or her hand about whether they like or dislike this or that precedent would send the wrong signal,\u201d Gorsuch said at the time. \u201cIt would send the signal to the American people that the judge\u2019s personal views have something to do with the judge\u2019s job.\u201d<\/p>\n<p>Mark Paoletta, the former general counsel for the Office of Management &#038; Budget who\u00a0worked on Justice Kavanaugh\u2019s, Gorsuch\u2019s, and Clarence Thomas\u2019s confirmations, told The Daily Wire that Gorsuch and Kavanaugh recognizing <em>Roe<\/em> as precedent was a\u00a0statement of fact \u2014 \u201cnot a promise never to overturn it.\u201d<\/p>\n<p>\u201cThat\u2019s absurd,\u201d he said, emphasizing that nothing in the justices\u2019 testimony was inconsistent with their actions. \u201cAnd to make such a commitment would be unethical and a violation of the judicial code of ethics. They testified truthfully in every way. These clams by the Left are ridiculous.\u201d<\/p>\n<p>Both West Virginia Sen. <a href=\"https:\/\/www.dailywire.com\/topic\/joe-manchin\">Joe Manchin<\/a>\u00a0(D-WV) and Sen. <a href=\"https:\/\/www.dailywire.com\/topic\/susan-collins\">Susan Collins<\/a>\u00a0(R-ME), who voted to confirm the justices, expressed concerns following the overturn of <em>Roe<\/em> that the justices had lied to them.<\/p>\n<p lang=\"en\" dir=\"ltr\">Incredibly poor judgment by \u2066<a href=\"https:\/\/twitter.com\/SenatorCollins?ref_src=twsrc%5Etfw\">@SenatorCollins<\/a>\u2069 \u2066to attack Justices Gorsuch and Kavanaugh over the recent abortion ruling, including this \u2066<a href=\"https:\/\/twitter.com\/nytimes?ref_src=twsrc%5Etfw\">@nytimes<\/a>\u2069 hit piece.<\/p>\n<p>They appropriately answered questions on precedent like all judicial nominees do. <a href=\"https:\/\/t.co\/x9JW0XtB8Q\">https:\/\/t.co\/x9JW0XtB8Q<\/a><\/p>\n<p>\u2014 \ud83c\uddfa\ud83c\uddf8 Mike Davis \ud83c\uddfa\ud83c\uddf8 (@mrddmia) <a href=\"https:\/\/twitter.com\/mrddmia\/status\/1541207243605024768?ref_src=twsrc%5Etfw\">June 26, 2022<\/a><\/p>\n<p>\u201cI trusted Justice Gorsuch and Justice Kavanaugh when they testified under oath that they also believed\u00a0Roe v. Wade\u00a0was settled legal precedent and I am alarmed they chose to reject the stability the ruling has provided for two generations of Americans,\u201d Manchin <a href=\"https:\/\/www.manchin.senate.gov\/newsroom\/press-releases\/manchin-statement-on-scotus-decision-to-overturn-roe-v-wade\">said<\/a> in a statement on Friday that expressed support for legislation codifying <em>Roe v. So I hope there\u2019s an investigation.\u201d<\/p>\n<p>American Enterprise Institute fellow Marc Thiessen <a href=\"https:\/\/www.washingtonpost.com\/opinions\/2022\/06\/28\/kavanaugh-gorsuch-roe-kagan-supreme-court\/\">wrote in a Washington Post op-ed<\/a> that \u201cnone of the conservative justices promised to uphold\u00a0Roe,\u201d noting that if they had done so, \u201cthat\u00a0would be an impeachable offense.\u201d<\/p>\n<p class=\"font--article-body font-copy gray-darkest ma-0 pb-md font--article-body gray-darkest ma-0 pb-md\" data-el=\"text\">\u201cIt would be a serious violation of judicial ethics for a nominee to the federal bench to say how they would vote in a case before hearing the facts and evidence,\u201d wrote Thiessen.<\/p>\n<p data-el=\"text\">During Ruth Bader Ginsburg\u2019s 1993 confirmation hearings, Ginsberg <a href=\"https:\/\/timesmachine.nytimes.com\/timesmachine\/1993\/07\/21\/997393.html?pageNumber=2\">explained<\/a>\u00a0that \u201cit would be wrong for me to say or preview in this legislative chamber how I would cast my vote on questions the Supreme Court may be called upon to decide.\u201d<\/p>\n<p data-el=\"text\">\u201cA judge sworn to decide impartially can offer no forecasts, no hints, for that would show not only disregard for the specifics of the particular case, it would display disdain for the entire judicial process,\u201d the late justice added.<\/p>\n<p data-el=\"text\">\u201cIt is perfectly understandable for senators to try to divine<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Democratic lawmakers are falsely accusing two Supreme Court justices of lying under oath about Roe v.
