Wade<\/em> is so radically out of step with the American public that it is an undemocratic, minoritarian power grab. Not only is the argument based on the unconstitutional notion that justices should weigh the vagaries of public opinion before ruling, but it also relies on the irreconcilable claim that empowering the public to vote on an issue unmentioned in the Constitution is an attack on \u201cdemocracy.\u201d<\/p>\n<p>Now, that\u2019s all bad enough, but the thing is, even the underlying claim isn\u2019t true. Take, for instance, <a href=\"https:\/\/www.monmouth.edu\/polling-institute\/reports\/MonmouthPoll_US_062822\/\">this new poll by Monmouth<\/a>, headlined, \u201cMajority Disapprove of Reversing Roe.\u201d Yes, a majority of 60 percent disapprove of overturning <em>Roe v. Wade<\/em>. And after 50 years of cultural and political indoctrination about abortion \u201crights,\u201d it\u2019s almost surely the case that a large part of that 60 percent of voters barely have any idea what <em>Roe<\/em> entailed, or any legal arguments for why it shouldn\u2019t be overturned, or much understanding of what its demise means.<\/p>\n<p>A deeper look at the poll shows that 46 percent say Congress should pass a national law \u201callowing abortions\u201d \u2014 what a ridiculously vague phrase \u2014 but \u201c44% say let states decide and 7% say pass a national ban.\u201d So, even with the purposely opaque wording of the poll, Monmouth could have headlined the findings: \u201c54 Percent of Americans Oppose A National Law Codifying Roe.\u201d<\/p>\n<p>How could that be? Does anyone believe that among the same 60 percent who support upholding abortion by judicial decree are those opposed to codifying the same exact rights through the democratic process? Or is the public confused about what <em>Roe<\/em> meant?<\/p>\n<p>Pollsters have been highlighting these irrelevant questions about abortion, a practice that most Americans probably have complicated feelings about, for decades. And it probably isn\u2019t going to get any better. Not long ago, Politico\u00a0asked voters about the <a href=\"https:\/\/www.politico.com\/newsletters\/playbook\/2022\/05\/11\/inside-scotus-and-trumps-first-2022-loss-00031684\">prospect<\/a> of\u00a0<em>prison for women<\/em>\u00a0who obtain abortions, which <em>Dobbs<\/em> has nothing to do with and the pro-life movement has always opposed. Abortion laws in place punish abortionists, not pregnant women. The Texas law everyone was freaking out about specifically exempts women from homicide charges for abortions.<\/p>\n<p>Then there is NPR, which <a href=\"https:\/\/www.npr.org\/2022\/06\/27\/1107733632\/poll-majorities-oppose-supreme-courts-abortion-ruling-and-worry-about-other-righ\">reports<\/a>, \u201cPoll: Majorities oppose Supreme Court\u2019s abortion ruling and worry about other rights.\u201d The NPR\/PBS NewsHour\/Marist, a transparent push poll, doesn\u2019t even bother asking about policy. It offers no context for why anyone should believe their \u201crights\u201d would be imperiled \u2014 and abortion, of course, isn\u2019t a right. (Even with all this, a majority in the NPR poll oppose packing the court.)<\/p>\n<p>When Monmouth asks if voters support Democrats\u2019 plan \u201callowing abortions\u201d they too are misleading the public. We already know what the Democrats\u2019 national <a href=\"https:\/\/thefederalist.com\/2022\/05\/11\/bipartisan-majority-rejects-radical-abortion-bill-pushed-by-senate-democrats\/\">bill<\/a> would do. So a more honest question would be: \u201cDo you support the Democratic Party\u2019s efforts to legalize abortion through\u00a0<a href=\"https:\/\/www.nationalreview.com\/2021\/09\/house-democrats-unite-to-advance-barbaric-abortion-bill\/\" target=\"_blank\" rel=\"noreferrer noopener\">all nine months of pregnancy<\/a>\u00a0on demand for any reason, paid for by taxpayers, in all 50 states?\u201d<\/p>\n<p>For that matter, why don\u2019t pollsters ask voters if they agree with the Biden administration that abortions\u00a0<a href=\"https:\/\/www.politico.com\/news\/2022\/05\/10\/yellen-banning-abortion-damaging-to-economy-00031339\" target=\"_blank\" rel=\"noreferrer noopener\">are vital<\/a>\u00a0in keeping down the poor population, increasing labor-force participation, and helping the economy? Why don\u2019t they ask voters if they support the Democrats\u2019 efforts to force states to allow abortions after viability and <a href=\"https:\/\/www.nationalreview.com\/2022\/05\/how-the-democrats-abortion-bill-enshrines-a-right-to-abort-baby-girls-because-they-are-girls\/\" target=\"_blank\" rel=\"noreferrer noopener\">sex-selective abortions<\/a>, and strip parental or guardian notification for minors? These are real-life policy proposals that Democrats want to pass. The only national bill Republicans in Congress\u00a0have forwarded in recent years has been a \u201cheartbeat\u201d bill. And guess what? It polls <a href=\"https:\/\/thehill.com\/hilltv\/what-americas-thinking\/443879-poll-majority-of-voters-think-6-week-abortion-bans-arent-too\/\">very well<\/a>. \u00a0<\/p>\n<p>Then again, <em>Dobbs<\/em> finally allows us to find out what people really think.  <\/p>\n<hr class=\"wp-block-separator\" \/>\n<div class=\"article-author-description fst-italic\">\n  David Harsanyi is a senior editor at The Federalist.
