According to experts, one believes the activity itself may have been against the law. The other contends it was done for the purpose of entrapment.<\/p>\n<p> Against the Law? <\/p>\n<p>Speaking as a former prosecutor and three-term District Judge, <a href=\"https:\/\/gohmert.house.gov\/biography\/\">Rep. Louie Gohmert<\/a> (R-Texas) told The Epoch Times, \u201cif you\u2019re going to have electronic surveillance of people there has to be warrants.\u201d<\/p>\n<p>As Gohmert explained, \u201cFISA courts have granted warrants,\u201d with \u201cno particular clarity\u201d and \u201cno probable cause that a crime\u2019s been committed or that this person engaged in a crime.\u201d<\/p>\n<p>The Foreign Intelligence Surveillance Court (FISC) was established under the\u00a01978 Foreign Intelligence Surveillance Act (FISA). \u201cPursuant to FISA,\u201d the FISC <a href=\"https:\/\/www.fisc.uscourts.gov\/about-foreign-intelligence-surveillance-court\">website<\/a>\u00a0explains, \u201cthe Court entertains applications submitted by the United States Government for approval of electronic surveillance, physical search, and other investigative actions for foreign intelligence purposes.\u201d<\/p>\n<p>Regarding domestic electronic surveillance, the Department of Justice (DOJ) <a href=\"https:\/\/www.justice.gov\/jm\/jm-9-7000-electronic-surveillance\">website<\/a>, \u201cBecause of the well-recognized intrusive nature of many types of electronic surveillance, especially wiretaps and \u2018bugs,\u2019 and the Fourth Amendment implications of the government\u2019s use of these devices in the course of its investigations, the relevant statutes (and related Department of Justice guidelines) provide restrictions on the use of most electronic surveillance, including the requirement that a high-level Department official specifically approve the use of many of these types of electronic surveillance prior to an Assistant United States Attorney obtaining a court order authorizing interception.\u201d<\/p>\n<p>Furthermore, \u201cwhen court authorization for video surveillance is deemed necessary, it should<\/p>\n","protected":false},"excerpt":{"rendered":"<p>As previously reported in an exclusive June 20 report, evidence proves that \u201cplainclothes\u201d members of a special Electronic Surveillance Unit (ESU) were embedded among Jan. 6, 2021, protesters for the purposes of conducting video surveillance.
