He was then \u201cforced\u201d to unlock his phone for officers.<\/p>\n<p>\u201cFederal agents served a search warrant (Exhibit 1) on movant while movant was exiting a restaurant. Movant asked to see the warrant, but the executing officer refused. Movant was frisked. Movant\u2019s phone\u2014an iPhone Pro 12\u2014was seized. Movant was forced to provide biometric data to open said phone,\u201d reads the\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/22071050-john-eastman-court-filing\" target=\"_blank\" rel=\"noopener\">filing<\/a>\u00a0in the U.S. District Court for the District of New Mexico. \u201cHe was only given a copy of the search warrant but not the supporting affidavit referenced in it.\u201d<\/p>\n<p> \u2018Unlawful\u2019 <\/p>\n<p>The motion goes on to state that the federal agents identified themselves as\u00a0members of the FBI but that they \u201cappeared to be executing a\u00a0warrant issued at the behest of the Department of Justice\u2019s Office of the Inspector General.\u201d<\/p>\n<p>Eastman argues that the search warrant was unlawful because the Department of Justice\u2019s Office of the Attorney General \u201coutstripped its mandate<\/p>\n","protected":false},"excerpt":{"rendered":"<p>John Eastman,\u00a0the lawyer who was hired by former President Donald Trump\u00a0to look into alleged election issues, has claimed that he was \u201cfrisked\u201d by federal agents and had his cellphone seized while he was leaving a restaurant last week.
