Bremerton School District<\/em>, freedom of <a href=\"https:\/\/www.dailywire.com\/topic\/religion\">religion<\/a> is protected once again \u2014 even when you enter the public <a href=\"https:\/\/www.dailywire.com\/topic\/education\">schools<\/a>.<\/p>\n<p>In an interview with The Daily Wire, First Liberty attorney Jeremy Dys \u2014 part of the legal team representing lead plaintiff and Bremerton High School football coach Joseph Kennedy \u2014 broke down how the Court\u2019s ruling will affect Americans.<\/p>\n<p>On Monday morning, the high court <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/21-418_i425.pdf\">ruled<\/a> that Kennedy\u2019s First Amendment rights were violated after he was placed on administrative leave by the Washington state school district and was banned from participating in the football program for praying on the field in view of students.<\/p>\n<p>Dys explained that the Court\u2019s ruling \u201cstands for the principle that no one should be fired from their jobs simply because they can be seen engaged in some sort of religious activity.\u201d<\/p>\n<p>\u201cAnd more than that, this reaffirmed the promise of the First Amendment, that you don\u2019t have to choose between a job that you love and your faith,\u201d he added.<\/p>\n<p>Justice Neil Gorsuch wrote the majority decision and was joined by justices Samuel Alito, Amy Coney Barrett, Clarence Thomas, Brett Kavanaugh, and Chief Justice John Roberts.<\/p>\n<p>\u201cGorsuch was very clear here, that the school district went out of their way to discriminate against Coach Kennedy, for activity that was clearly protected under the First Amendment, the Free Exercise Clause,\u201d Dys explained.<\/p>\n<p>The attorney for First Liberty explained that the Bremerton School District was \u201cusing the Establishment Clause like some sort of cudgel to deflate his First Amendment freedoms. That\u2019s something that\u2019s unnecessary. And in this country, we\u2019re able to welcome religion even through the schoolhouse gates.\u201d<\/p>\n<p>On Twitter, leftists have been making much hoopla over the fact that Gorsuch \u2014 essentially \u2014 did away with what\u2019s called \u201cthe <em>Lemon<\/em> test\u201d in this ruling.<\/p>\n<p><a href=\"https:\/\/www.freedomforuminstitute.org\/first-amendment-center\/topics\/freedom-of-religion\/establishment-clause-overview\/\">The <em>Lemon<\/em> test<\/a>, from <a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/403\/602\"><em>Lemon v. Kurtzman,<\/em><\/a> developed three questions designed to demonstrate whether or not a political action violates the First Amendment:<\/p>\n<p>Does the government action have a secular purpose?Does the government action have the primary effect of advancing or inhibiting religion?Does the government action foster an excessive entanglement between government and religion?<\/p>\n<p>Dys explained to The Daily Wire that the <em>Lemon<\/em> test hasn\u2019t been used for quite some time and received a hefty blow in 2018 for another case which First Liberty won \u2014 <em>American Legion v. American Humanist Organization<\/em>, AKA the Bladensburg Cross case.<\/p>\n<p>\u201cThe <em>Lemon<\/em> test \u2026 was always used to sort of prevent religious activity within the public square,\u201d Dys argued. \u201cSo anytime the <em>Lemon<\/em> test was trotted out, the person who was engaging in religious activity in the public square always lost every time,\u201d he summarized.<\/p>\n<p>In the <a href=\"https:\/\/firstliberty.org\/cases\/bladensburg\/\">Bladensburg Cross case<\/a>, a group of atheists argued in court that a giant cross erected in honor of World War I veterans in 1925 ran afoul of the First Amendment while \u201calleging that the public ownership, maintenance, and display of the memorial violated the Establishment Clause.\u201d<\/p>\n<p>In 2019, the Court ruled 7-2 that the cross did not violate the First Amendment, and also widdled away the aforementioned <em>Lemon<\/em> test, Dys explained.<\/p>\n<p>With the Bladensburg Cross victory, \u201cthe Court really, more or less, put away the <em>Lemon<\/em> test in that case, without formally overruling it.\u201d<\/p>\n<p>\u201cThey took really the extra step [in <em>Kennedy<\/em>] and said again, \u2018This is not a test for us to be using,&#8217;\u201d Dys continued.<\/p>\n<p>Instead of that standard, \u201cthe Court looks to the history and tradition of our country.\u201d<\/p>\n<p>The Court asks questions like, \u201cHave we welcomed the speech and religious activity of individuals or religious paraphernalia, language, monuments, memorials \u2026 as a country? And do we welcome that in the public square historically? And if so, then they\u2019re entitled to protection and there\u2019s nothing to be feared from at all,\u201d Dys explained.<\/p>\n<p>In effect, Americans can be assured that the right to religious liberty has now returned to the public square.<\/p>\n<p>\u201cWhat the Court has basically done has been to reaffirm the importance of welcoming religion in the public square, rather than taking bulldozers to monuments that are maybe the shape of the cross, or in the case of Coach Kennedy, people who take a knee in silent prayer by themselves at the 50-yard line on a public school football field.\u201d<\/p>\n<p>\u201cWhat the Supreme Court said in this case, with regard to <em>Lemon<\/em> and other things is that school districts around the country can\u2019t close the schoolhouse gates to the constitutional rights of every American.
