With life\u2019s stresses comes a void that can sometimes be overwhelming. That void for me was my loss of love for baking and the joy that came with that. I\u2019m here to say it never went away but it was a struggle to fall in love with it again,\u201d Melissa wrote in her fundraising description.<\/p>\n<p><span data-preserver-spaces=\"true\">\u201cAlmost 2yrs ago we moved to Montana. I had said I was never going to open a bakery again, but God has seemed to change my heart with this. It\u2019s been 10 years since having my shop in Oregon and I greatly miss it along with all my sweet customers, she added.<\/p>\n<p><span data-preserver-spaces=\"true\">The Kleins are seeking $50,000 to fund the downpayment of a new location in Montana. More than $17,000 has already been donated toward the goal.<\/p>\n<p><span data-preserver-spaces=\"true\">\u201cShowing resilience and faith that God is the rock we stand on and His love will conquer all fears,\u201d Melissa wrote in thanking supporters for their help.<\/p>\n<p><span data-preserver-spaces=\"true\">The Kleins faced a government mandate from the Oregon Bureau of Labor and Industries (BOLI) over refusing to bake a cake for a same-sex wedding in 2013, claiming doing so would violate their religious beliefs.<\/p>\n<p><span data-preserver-spaces=\"true\">In January, the BOLI reversed a previous attempt to stop the fine.<\/p>\n<p><span data-preserver-spaces=\"true\">\u201cWe adhere to our prior decision upholding BOLI\u2019s determinations that Aaron unlawfully discriminated against the Bowman-Cryers based on sexual orientation,\u201d\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.christianpost.com\/news\/christian-bakers-punished-for-not-baking-gay-wedding-cake-to-relaunch-business.html\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">wrote<\/a><span data-preserver-spaces=\"true\">\u00a0Circuit Judge Erin Lagesen, the author of the panel opinion. \u201cWe reach a different conclusion with respect to our prior affirmance of BOLI\u2019s noneconomic damages award,\u201d ruled Lagesen.<\/p>\n<p><span data-preserver-spaces=\"true\">Earlier this year, however, an Oregon Court of Appeals upheld its original finding and threw out the fine over a claim of subtle bias against the religious beliefs of the Kleins.<\/p>\n<p><span data-preserver-spaces=\"true\">\u201cThe court was right five years ago and is still right today,\u201d attorney Jennifer Pizer, who represented the lesbian couple, said in a\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.opb.org\/article\/2022\/01\/26\/oregon-appeals-court-sweet-cakes-bakery-same-sex-discrimination-ruling\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">statement<\/a><span data-preserver-spaces=\"true\">. \u201cThe Kleins\u2019 faith does not give them a pass to ignore Oregon\u2019s Public Accommodation Law.\u201d<\/p>\n<p><span data-preserver-spaces=\"true\">\u201cThe court adhered to the position that the Oregon courts had previously taken that nondiscrimination laws can be taken to protect same sex couples, regardless of religious beliefs,\u201d Jim Oleske, a law professor at Lewis &#038; Clark,\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/twitter.com\/JimOleske\/status\/1486376826754592776\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">said<\/a><span data-preserver-spaces=\"true\">\u00a0on Twitter.\u00a0<\/p>\n<p lang=\"en\" dir=\"ltr\">7\/ The Court then concludes that the hostility potentially evidenced by the prosecutor&#8217;s statement may have influenced the agency&#8217;s decision to award damages: <a href=\"https:\/\/t.co\/vNtlUtnPMB\">pic.twitter.com\/vNtlUtnPMB<\/a><\/p>\n<p>\u2014 Jim Oleske (@JimOleske) <a href=\"https:\/\/twitter.com\/JimOleske\/status\/1486388815472173057?ref_src=twsrc%5Etfw\">January 26, 2022<\/a><\/p>\n<p><span data-preserver-spaces=\"true\">Oleske noted that the court\u2019s conclusion in the ruling emphasized \u201cthat the hostility potentially evidenced by the prosecutor\u2019s statement may have influenced the agency\u2019s decision to award damages.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Melissa and Aaron Klein, the Christian bakers who faced $135,000 in penalties that were later dropped for refusing to make a wedding cake for a lesbian couple, are working on relaunching a new business.
