And the only meaningful justification the government offered for its reprisal rested on a mistaken view that it had a duty to ferret out and suppress,\u201d Gorsuch <a href=\"https:\/\/www.foxnews.com\/politics\/high-school-football-coach-scores-big-win-supreme-court-post-game-prayer\">wrote<\/a>. \u201cReligious observances even as it allows comparable secular speech. The Constitution neither mandates nor tolerates that kind of discrimination.\u201d<\/p>\n<p>Joseph Kennedy, a Marine veteran, was an assistant football coach for the Bremerton High School (BHS) varsity team in 2008 when <a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-to-hear-case-about-football-coach-fired-over-praying\">he started a tradition of kneeling<\/a> and praying after games. Some students later volunteered to join him. In 2015, a school administrator addressed the issue with the coach after an opposing team complained.\u00a0 After an investigation, Kennedy was later placed on\u00a0<a href=\"https:\/\/firstliberty.org\/wp-content\/uploads\/2022\/01\/20200722_Kennedy_Excerpts-of-Record_ER317-18.pdf\" target=\"_blank\" rel=\"noopener\">administrative leave<\/a>\u00a0and barred from \u201cparticipating in any capacity in the BHS football program.\u201d<\/p>\n<p>Non-profit conservative legal organization First Liberty Institute took up Kennedy\u2019s case in 2016, and lost in both district court and at the 9th Circuit Court of Appeals. In 2019, the U.S. Supreme Court also denied the request, but four justices \u2013 Alito, Thomas, Gorsuch, and Kavanaugh \u2013 issued a statement expressing serious concern about how the school district and the lower courts had understood the First Amendment rights of public school teachers.<\/p>\n<p>The Supreme Court sent the case back to U.S. District Judge Ronald Leighton, who again sided with the school district in 2020, as did the 9th Circuit in mid-2021.
