Jackson on Friday launched a racial attack against <a href=\"https:\/\/www.dailywire.com\/videos\/created-equal-clarence-thomas-in-his-own-words\">Supreme Court Justice Clarence Thomas<\/a> after the\u00a0court\u00a0overruled abortion decisions in\u00a0<em>Roe v. Wade<\/em> and Planned Parenthood v. Casey, effectively kicking abortion restrictions back to the states.<\/p>\n<p id=\"id__jkgsk78d759\" class=\"css-901oao r-18jsvk2 r-37j5jr r-1blvdjr r-16dba41 r-vrz42v r-bcqeeo r-bnwqim r-qvutc0\" dir=\"auto\" lang=\"en\" data-testid=\"tweetText\">\u201cHow\u2019s Uncle Clarence feeling about Overturning Loving v Virginia??!!\u201d Jackson posted to Twitter.<\/p>\n<p dir=\"auto\" lang=\"en\" data-testid=\"tweetText\">\u201cUncle Clarence\u201d seems to be a reference to \u201cUncle Tom,\u201d a racial term often used to slander black Americans who buck the mainstream narrative. Merriam-Webster <a href=\"https:\/\/www.merriam-webster.com\/dictionary\/Uncle%20Tom\">defines<\/a> \u201cUncle Tom\u201d as \u201ca Black person who is overeager to win the approval of whites.\u201d<\/p>\n<p dir=\"auto\" lang=\"en\" data-testid=\"tweetText\">In the same tweet, Jackson took another racial shot at Thomas, apparently for marrying a white woman, Ginni Thomas. <em>Loving v. Virginia, <\/em>decided in 1967, struck down state laws banning interracial marriages.<\/p>\n<p lang=\"en\" dir=\"ltr\">How\u2019s Uncle Clarence feeling about Overturning Loving v Virginia??!!<\/p>\n<p>\u2014 Samuel L. Jackson (@SamuelLJackson) <a href=\"https:\/\/twitter.com\/SamuelLJackson\/status\/1540550316977885184?ref_src=twsrc%5Etfw\">June 25, 2022<\/a><\/p>\n<p>Thomas notably wrote in his\u00a0concurrence to Justice Samuel Alito\u2019s majority opinion in <em>Dobbs v. Jackson Women\u2019s Health Organization<\/em> that the high court \u201cshould reconsider all of this Court\u2019s substantive due process precedents, including <em>Griswold<\/em>, <em>Lawrence<\/em>, and Obergefell,\u201d <a href=\"https:\/\/www.dailywire.com\/news\/correct-the-error-clarence-thomas-says-scotus-should-reconsider-decisions-on-contraception-same-sex-marriage\">The Daily Wire<\/a>\u00a0reported.<\/p>\n<p>\u201cWe have a duty to \u2018correct the error\u2019 established in those precedents,\u201d Thomas said. \u201cAfter overruling these demonstrably erroneous decisions, the question would remain whether other constitutional provisions guarantee the myriad rights that our substantive due process cases have generated.\u201d<\/p>\n<p><em><a href=\"https:\/\/www.dailywire.com\/news\/ellis-originalists-would-overturn-roe-obergefell-jenna-ellis\">Obergefell v. Hodges<\/a>, <\/em>decided in\u00a02015, found that the right to marry was guaranteed to same-sex couples.<\/p>\n<p>Lawyer <a href=\"https:\/\/www.dailywire.com\/news\/ellis-originalists-would-overturn-roe-obergefell-jenna-ellis\">Jenna Ellis<\/a> argued in 2018 that \u201coriginalist\u201d judges\u00a0would find that both\u00a0<em>Roe<\/em>\u00a0and <em>Obergefell<\/em>\u00a0should be overturned \u2014 which seems to jive with Thomas\u2019 latest concurrence.<\/p>\n<p>\u201cIt should be obvious to anyone who actually reads the Constitution\u2019s text, <a href=\"https:\/\/www.nationalreview.com\/2017\/02\/ninth-circuit-travel-ban-decision-united-states-constitution-unalienable-rights-privileges-alexander-hamilton\/\">rights do not come from the Constitution<\/a>,\u201d Ellis wrote at <a href=\"https:\/\/www.dailywire.com\/news\/ellis-originalists-would-overturn-roe-obergefell-jenna-ellis\">The Daily Wire<\/a>. \u201cBut neither <em>Roe<\/em> nor <em><a href=\"https:\/\/www.oyez.org\/cases\/1991\/91-744\">Planned Parenthood v. Casey<\/a><\/em> found a \u2018right to abortion\u2019 in the Constitution anyway. These abortion cases didn\u2019t even suggest this, but rather the Court found that the \u2018right to privacy\u2019 covers some abortions in <em>some<\/em> circumstances. Since these decisions, the Court has sought to \u2018balance\u2019 this right to privacy versus the state\u2019s compelling interest in protecting human life. This was established as the \u2018undue burden\u2019 test in <em>Casey<\/em>.\u201d<\/p>\n<p>\u201cThis was judicial \u2018finessing\u2019 to cover up the inherent incongruency of these opinions with the Constitution \u2014 <em>Casey <\/em>and <em>Roe<\/em> (and later, <em>Obergefell<\/em>) were about finding things that aren\u2019t in the Constitution to advance a specific policy agenda rather than faithfully applying the law,\u201d she argued. \u201cThese cases are about imposing the opinion and preferences of a majority of activist judges over the rule of law.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Actor Samuel L.
