Wade<\/em> after the actual decision was revealed on Friday.<\/p>\n<p>The draft opinion, authored by Justice Samuel Alito and leaked to the public on Monday evening, May 2, by Politico, referred to <em>Dobbs v. Mississippi\u00a0<\/em>(2022), the case considering whether or not\u00a0<em>Roe v. Wade<\/em>\u00a0(1973), which created out of nothing a Constitutional right to abortion, ought to be overruled. The draft stated that\u00a0<em>Roe<\/em>\u00a0\u201cwas egregiously wrong from the start\u201d and \u201cwe hold that\u00a0<em>Roe<\/em>\u00a0and\u00a0<em>Casey<\/em>\u00a0must be overruled.\u201d<\/p>\n<p>Kelly wrote at the time, \u201cThe pathetic spineless leak of a draft SCOTUS opinion has the feel of something a sad little woke 20-something-year-old would do. We can\u2019t be an institution that can be bullied into giving you just the outcomes you want. The events from earlier this week are a symptom of that.\u201d<\/p>\n<p>Former Attorney General William Barr <a href=\"https:\/\/dailywire.com\/news\/bill-barr-says-scotus-may-need-special-counsel-to-out-leaker-floats-criminal-charges\/\">appeared<\/a> on Kelly\u2019s <a href=\"https:\/\/www.youtube.com\/watch?v=G_1TFY4O0VA\">podcast<\/a>, where he stated, \u201cI was flabbergasted. It really is unprecedented. Our institutions have become increasingly politicized, but I never imagined this could happen to the Supreme Court, which has always protected its confidentiality.
