Wade<\/em> case that legalized abortion across America was \u201cstrikingly similar\u201d with \u201cbarely any changes\u201d to the leaked draft of Justice Samuel Alito\u2019s opinion earlier this spring, according to several who have compared both copies.<\/p>\n<p>On May 2, an anonymous individual <a href=\"https:\/\/www.dailywire.com\/news\/breaking-supreme-court-strikes-down-roe-v-wade-decision-in-draft-of-majority-opinion-report-says\">gave<\/a> Politico a copy of Alito\u2019s opinion, showing that the High Court was poised to strike down <em>Roe<\/em> as well as<em> Planned Parenthood v. Casey.<\/em> That leaker has not been identified. As <a href=\"https:\/\/www.cnn.com\/2022\/06\/24\/politics\/dobbs-mississippi-supreme-court-abortion-roe-wade\/index.html\">flagged<\/a> by CNN, a cursory glance shows that Alito\u2019s language at the heart of the matter was nearly identical in both the official as well as the draft opinion.<\/p>\n<p>The line, \u201cWhat sharply distinguishes the abortion right from the rights recognized in the cases on which <em>Roe<\/em> and <em>Casey<\/em> rely is something that both those decisions acknowledged: Abortion destroys what those decisions call \u2018potential life\u2019 and what the law at issue in this case regards as the life of an \u2018unborn human being,\u201d a line that the draft also included.<\/p>\n<p>Likewise, the line, \u201c<em>Roe<\/em> was egregiously wrong from the start. Its reasoning was exceptionally weak, and the decision has had damaging consequences,\u201d was included in both versions.<\/p>\n<p lang=\"en\" dir=\"ltr\">Alito&#8217;s opinion appears very similar to the leaked draft. This line is in both. <\/p>\n<p>&#8220;Roe was egregiously wrong from the start. Its reasoning was exceptionally weak, and the decision has had damaging consequences.&#8221; <a href=\"https:\/\/twitter.com\/hashtag\/RoeVsWade?src=hash&#038;ref_src=twsrc%5Etfw\">#RoeVsWade<\/a><\/p>\n<p>\u2014 Jay O&#8217;Brien (@jayobtv) <a href=\"https:\/\/twitter.com\/jayobtv\/status\/1540339755887607808?ref_src=twsrc%5Etfw\">June 24, 2022<\/a><\/p>\n<p>Alito\u2019s response to the three dissenting justices, however, was not included in the leaked draft.<\/p>\n<p>\u201cThe dissent is very candid that it cannot show that a constitutional right to abortion has any foundation, let alone a \u2018deeply rooted\u2019 one, \u2018in this Nation\u2019s history and tradition.&#8217;\u201d Alito <a href=\"https:\/\/www.cnn.com\/2022\/06\/24\/politics\/dobbs-mississippi-supreme-court-abortion-roe-wade\/index.html\">said<\/a>. \u201cThe dissent does not identify any pre-<em>Roe<\/em> authority that supports such a right \u2014 no state constitutional provision or statute, no federal or state judicial precedent, not even a scholarly treatise.\u201d<\/p>\n<p>As explained by Ethics and Public Policy Center president Ryan T. Anderson, \u201cThere are barely any changes\u2013apart from responses to the dissent and the concurrence\u2013in the Alito majority opinion. That shows 1) how strong the leaked draft was, and 2) how pathetic the various criticisms of it were, and are. <em>Roe<\/em> and <em>Casey<\/em> are simply indefensible.\u201d<\/p>\n<p lang=\"en\" dir=\"ltr\">There are barely any changes\u2013apart from responses to the dissent and the concurrence\u2013in the Alito majority opinion.
