Wade <\/em>on Friday. <\/p>\n<p>\u201cThe Constitution makes no reference to abortion, and no such right is implicitly protected by any constitutional provision, including the one on which the defenders of Roe and Casey now chiefly rely\u2014the Due Process Clause of the Fourteenth Amendment,\u201d the opinion states. <\/p>\n<p>\u201cRoe was egregiously wrong from the start. Its reasoning was exceptionally weak, and the decision has had damaging consequences.\u201d <\/p>\n<p>In deciding to uphold a Missippi law that bans abortion after 15 weeks of gestation, the court\u2019s <em>Dobbs v. Jackson Women\u2019s Health Organization<\/em> ruling will hand legislative authority on the issue of killing babies in the womb back to the states. Some states such as Texas have already implemented pro-life laws that effectively ban abortion. <\/p>\n<p>Justice Samuel Alito authored the majority opinion which was joined by Justices Clarence Thomas, Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett. In their opinion, Alito noted that \u201cNot only was there no support for such a constitutional right until shortly before Roe, but abortion had long been a crime in every single State.\u201d <\/p>\n<p>\u201cAt common law, abortion was criminal in at least some stages of pregnancy and was regarded as unlawful and could have very serious consequences at all stages. American law followed the common law until a wave of statutory restrictions in the 1800s expanded criminal liability for abortions,\u201d Alito wrote. \u201c<em>Roe <\/em>either ignored or misstated this history, and <em>Casey <\/em>declined to reconsider <em>Roe<\/em>\u2019s faulty historical analysis. It is therefore important to set the record straight.\u201d<\/p>\n<p>Instead of joining the majority opinion, Chief Justice John Roberts filed a concurring opinion. The court\u2019s three Democrat-nominated justices dissented. <\/p>\n<p>Alito berated Roberts\u2019 concurrence for doing \u201cexactly what it criticizes <em>Roe <\/em>for doing: pulling \u2018out of thin air\u2019 a test that \u2018[n]o party or <em>amicus <\/em>asked the Court to adopt.\u2019\u201d <\/p>\n<p>\u201cThe concurrence would \u2018leave for another day whether to reject any right to an abortion at all,\u2019 and would hold only that if the Constitution protects any such right, the right ends once women have had \u2018a reasonable opportunity\u2019 to obtain an abortion,\u201d Alito wrote. \u201cThere are serious problems with this approach, and it is revealing that nothing like it was recommended by either party.\u201d<\/p>\n<p>Despite facing a left-wing intimidation campaign that culminated in doxxing, an assassination attempt, and attacks on multiple pro-life centers and churches, the decision did not substantively change from May when a draft of the <em>Dobbs<\/em> opinion was prematurely leaked to Politico. <\/p>\n<p>The landmark decision was celebrated by multiple pro-life groups and organizations as a victory for all Americans, especially unborn babies. <\/p>\n<p>\u201cToday marks an historic human rights victory for unborn children and their mothers and a bright pro-life future for our nation,\u201d said\u00a0SBA Pro-Life America President Marjorie Dannenfelser. \u201cToday the Supreme Court, in line with\u00a0<strong>modern science<\/strong>\u00a0and overwhelming public consensus, recognized the truth in every mother\u2019s heart and that pro-life advocates have argued all along: unborn children are human beings, deserving of protection. Every legislature in the land, in every single state and Congress, is now free to allow the will of the people to make its way into the law through our elected representatives.\u201d<\/p>\n<p>March for Life President Jeanne Mancini praised SCOTUS for overruling \u201can unpopular and extreme abortion policy on our nation.\u201d <\/p>\n<p>\u201cToday, the ability to determine whether and when to limit abortion was returned to the American people who have every right to enact laws like Mississippi\u2019s which protect mothers and unborn babies after 15 weeks \u2013 when they have fully formed noses, can suck their thumb, and feel pain. We are so grateful to the countless pro-life people of goodwill who contributed and sacrificed to make today possible \u2013 including the millions of those who have marched for life over the years \u2013 and we recognize that this is just the beginning of our work to advance policies that protect life. We will continue to march until abortion is unthinkable because equality begins in the womb,\u201d Mancini said in a statement. <\/p>\n<p>Meanwhile, the <a href=\"https:\/\/thefederalist.com\/2022\/06\/22\/as-dobbs-decision-nears-corporate-media-abortion-propaganda-machine-is-firing-on-all-cylinders\/\" target=\"_blank\" rel=\"noreferrer noopener\">corporate media<\/a> and leftists have already started melting down on Twitter. Some groups such as Jane\u2019s Revenge have <a href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/roe-v-wade-abortion-janes-revenge-scotus-b2106168.html\" target=\"_blank\" rel=\"noreferrer noopener\">threatened more violence<\/a> against pro-lifers because of the <em>Dobbs<\/em> ruling.    <\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n  Jordan Boyd is a staff writer at The Federalist and co-producer of The Federalist Radio Hour.
