When Title IX was passed half a century ago, it was meant to protect the rights of women and girls in educational settings. Since then, it has been interpreted to apply to other protected classes, including LGBTQ people.<\/p>\n<p>\u201cOver the last 50 years, Title IX has paved the way for millions of girls and women to access equal opportunity in our nation\u2019s schools and has been instrumental in combating sexual assault and sexual violence in educational settings,\u201d said Education Secretary Miguel Cardona said in a statement.<\/p>\n<p>\u201cAs we celebrate the 50th Anniversary of this landmark law, our proposed changes will allow us to continue that progress and ensure all our nation\u2019s students \u2013 no matter where they live, who they are, or whom they love \u2013 can learn, grow, and thrive in school,\u201d Cardona said.<\/p>\n<p>Along with the changes on transgender students, the proposed rules would also overhaul the process by which schools handle sexual assault and sexual harassment allegations. The overhaul would nix changes made by the Trump administration that were intended to make the process more fair for accused students. While campaigning for president, President Joe Biden said the Trump administration\u2019s changes \u201cshame and silence survivors\u201d and vowed to scrap them.<\/p>\n<p>The new rules will \u201crestore vital protections for students in our nation\u2019s schools which were eroded by controversial regulations implemented during the previous Administration,\u201d the education department said Thursday in a <a href=\"https:\/\/www2.ed.gov\/about\/offices\/list\/ocr\/docs\/t9nprm-factsheet.pdf\">fact sheet<\/a> accompanying the proposed rule.<\/p>\n<p>\u201cThose regulations weakened protections for survivors of sexual assault and diminished the promise of an education free from discrimination,\u201d the department said.<\/p>\n<p>The new rules would rollback constitutional protections for students accused of heinous crimes, including the right to a live hearing, to cross-examine their accuser and the witnesses against them, and allowing a \u201csingle investigator\u201d model that allows a single person to act as investigator, judge, jury, and executioner. This model would also prevent accused students from learning the evidence against them, such as what the accuser and witnesses are specifically accusing them of, and allow schools to keep individual testimonies hidden, making it more difficult for wrongly accused students to file a lawsuit to protect their civil rights.<\/p>\n<p>Courts have consistently upheld civil rights for accused students in recent years, and legal challenges to the Trump administration\u2019s regulations all failed.<\/p>\n<p>In 2016, the Obama administration <a href=\"https:\/\/www.politico.com\/story\/2016\/05\/obama-administration-title-ix-transgender-student-rights-223149\">issued<\/a> guidance saying Title IX protections also apply to a transgender student\u2019s bathroom preference. The next year, however, the Trump administration <a href=\"https:\/\/www.npr.org\/sections\/thetwo-way\/2017\/02\/22\/516664633\/trump-administration-rescinds-obama-rule-on-transgender-students-bathroom-use\">reversed<\/a> that guidance, saying the issue should not have been dealt with at the federal level and that there\u00a0\u201cmust be due regard for the primary role of states and local school districts in establishing educational policy.\u201d<\/p>\n<p>Over the last year, parents have raised the alarm about biological males in girls bathrooms at school. In some cases, even elementary schools have <a href=\"https:\/\/abcnews4.com\/news\/nation-world\/parents-push-back-against-elementary-schools-trans-bathroom-policy-olentangy-school-district-gender-inclusive-restroom-title-ix-lgbtq-transgender-students-single-sex-spaces\">adopted<\/a> policies allowing transgender-identifying boys to use the girls bathrooms, prompting parents to complain at school board meetings.<\/p>\n<p>The Biden administration did not address what the new rules would mean for transgender students competing on the college sports team of their preferred gender, an issue that has <a href=\"https:\/\/www.dailywire.com\/news\/lia-thomas-teammate-competitor-blast-title-as-illegitimate-in-wake-of-fina-transgender-restrictions\">sparked<\/a> national debate in recent months.<\/p>\n<p>The proposed rule is slated to be\u00a0published in the Federal Register and\u00a0will be\u00a0open for public comment for 60 days afterwards.
