The bill is now in the House, where it is expected to pass, after which it would still have to go back to the Senate for a final vote before it could be signed into law.<\/p>\n<p>\u201cThe package extends current prohibitions on gun sales to those who have disqualifying juvenile records and those convicted of misdemeanor violent crimes against \u2018dating partners,\u2019\u201d The Reload <a href=\"https:\/\/thereload.com\/senate-gun-bill-extends-gun-prohibitions-to-juvenile-records-misdemeanor-violence-committed-by-dating-partners\/\">reported<\/a>. \u201cThe bill also includes a new background check process for those 18 to 20 years old, funding for \u2018Red Flag\u2019 laws or other state crisis intervention programs, the reclassification of who must obtain federal gun dealing licenses, and several other proposals.\u201d<\/p>\n<p>Some of the more troubling aspects of the bill were <a href=\"https:\/\/www.firearmspolicy.org\/gop_senate_gun_control_splainer\">highlighted<\/a> in an analysis conducted by the Firearms Policy Coalition (FPC):<\/p>\n<p><em><strong>Red Flag Laws<\/strong><\/em><\/p>\n<p><em>Incentivizes local disarmament proceedings, of which many states currently employ secret ex-parte hearings.<\/em><em>Calls only for standards equivalent only to civil court.<\/em><em>For all the bluster in the measure about protecting due process and the constitutional rights of the subjects of the hearings during the\u00a0\u201cappropriate phase,\u201d it implies that states will still be able to hold secret ex-parte hearings to deprive the People of their rights.<\/em><em>Entitles the subject to an attorney \u201cat the appropriate phase,\u201d but it must be at the subject\u2019s expense.<\/em><\/p>\n<p><em><strong>Private Sales<\/strong>\u00a0<\/em><\/p>\n<p><em>Expands the definition of \u201cengaged in the business\u201d by striking\u00a0\u201cwith the\u00a0principal objective of livelihood and profit\u201d\u00a0in the current definition and replacing it with\u00a0\u201cto predominantly earn a profit.\u201d<\/em><em>This confusion could lead to new and successful prosecutions of private sellers who may fall under the broad and vague definition of \u201cengaged in business\u201d and therefore the need to be licensed.<\/em><\/p>\n<p><em><strong>New Misdemeanor Firearms Prohibitions<\/strong><\/em><\/p>\n<p><em>By expanding the definition of a prohibiting misdemeanor domestic violence in such a vague, broad, and subjective way it invites confusion, and potential firearms prohibitions.<\/em><\/p>\n<p><em><strong>Transfers and Straw Purchases<\/strong><\/em><\/p>\n<p><em>Prohibits the government from arming drug cartels, unless the government exercises more oversight on said drug cartels, thus allowing the free flow of arms to these cartels to continue in perpetuity.<\/em><\/p>\n<p><em><strong>Employer Background Checks<\/strong><\/em><\/p>\n<p><em>Allows all employers to ask for a firearms background check prior to employment or during current employment, regardless of its connection to job duties.<\/em><\/p>\n<p>\u201cThe proposal seeks to chill the right to keep and bear arms by incentivizing local disarmament proceedings, of which many states currently employ secret ex-parte hearings, massive penalties and enhancements reminiscent of the mass incarceration of the so-called war on drugs, naked discrimination against young adults, and an aggressive assault on peaceable conduct,\u201d FPC <a href=\"https:\/\/www.firearmspolicy.org\/fpc-statement-on-senate-gun-control-agreement\">said<\/a> in a separate statement. \u201cShould this package be adopted, it will result in the imprisonment, injury, and death of peaceable people.\u201d<\/p>\n<p>Erich Pratt, Gun Owners of America\u2019s senior vice president, <a href=\"https:\/\/www.dailywire.com\/news\/gun-control-bill-advances-in-the-senate-with-help-from-14-republicans\">slammed<\/a> the Republican lawmakers who caved on the bill, saying that the senators \u201chave NO AUTHORITY to compromise with our rights, and we will not tolerate legislators who are willing to turn gun owners into second-class citizens.\u201d<\/p>\n<p>The <a href=\"https:\/\/www.dailywire.com\/topic\/national-rifle-association-nra\">National Rifle Association<\/a> (NRA) <a href=\"https:\/\/home.nra.org\/statements\/nra-announces-opposition-to-senate-gun-control-legislation\/\">said<\/a> that while it supported the aspects of the bill that help bolster school security, boost mental health services, and reduce violent crime, the organization will not support the bill because it infringes on American\u2019s <a href=\"https:\/\/www.dailywire.com\/topic\/second-amendment\">Second Amendment<\/a> rights.<\/p>\n<p>\u201cThis legislation can be abused to restrict lawful gun purchases, infringe upon the rights of law-abiding Americans, and use federal dollars to fund gun control measures being adopted by state and local politicians,\u201d they said in a statement. \u201cThis bill leaves too much discretion in the hands of government officials and also contains undefined and overbroad provisions \u2013 inviting interference with our constitutional
