Sales <a href=\"https:\/\/www.cnbc.com\/2018\/07\/02\/juul-e-cigarette-sales-have-surged-over-the-past-year.html\">surged nearly 800%<\/a> between 2017 and 2018, causing Juul to gain a 68% market share in the e-cigarette category.<\/p>\n<p>The FDA\u2019s move to ban Juul products comes months after President Biden\u2019s Department of Health and Human Services planned to implement a $30 million grant program which allegedly would have involved\u00a0<a href=\"https:\/\/www.dailywire.com\/news\/jen-psaki-says-crack-pipe-plans-are-false-smoking-kits-contain-alcohol-swabs-lip-balm-other-materials\">handing out crack pipes<\/a> to drug addicts as part of safe smoking kits, according to a report from Washington Free Beacon reporter Patrick Hauf.<\/p>\n<p>The Biden administration denied the plans ever involved crack pipes and legacy fact checkers <a href=\"https:\/\/www.dailywire.com\/news\/mostly-false-free-crack-pipes-how-fact-checkers-debunked-reality-again\">critiqued<\/a> the report.<\/p>\n<p>Later, Hauf <a href=\"https:\/\/freebeacon.com\/biden-administration\/yes-safe-smoking-kits-include-free-crack-pipes-we-know-because-we-got-them\/\">obtained<\/a>\u00a0safe smoking kits from five different cities across the United States which contained crack pipes. He reported that the kits were likely similar to the ones that would be eligible to be covered under the HHS grant. It was not known if these kits were purchased with money from the HHS grant.<\/p>\n<p>Over the past four years, the FDA has been <a href=\"https:\/\/www.dailywire.com\/news\/fda-threatens-ban-vaping-products-due-teenage-use-kassy-dillon\">seeking ways to regulate<\/a> e-cigarettes \u2014 especially for young consumers.<\/p>\n<p>\u201c[We] see clear signs that youth use of electronic cigarettes has reached an epidemic proportion, and we must adjust certain aspects of our comprehensive strategy to stem this clear and present danger,\u201d then FDA Commissioner Scott Gottlieb <a href=\"https:\/\/www.fda.gov\/news-events\/press-announcements\/fda-takes-new-steps-address-epidemic-youth-e-cigarette-use-including-historic-action-against-more\">said<\/a> in 2018. \u201cWhile we remain committed to advancing policies that promote the potential of e-cigarettes to help adult smokers move away from combustible cigarettes, that work can\u2019t come at the expense of kids. We cannot allow a whole new generation to become addicted to nicotine.\u201d<\/p>\n<p>According to The Wall Street Journal, Juul \u201climited its marketing\u201d and \u201cstopped selling sweet and fruity flavors\u201d in 2019, after which the company\u2019s sales slowed.<\/p>\n<p>Today, Juul denies selling to young users. \u201cJuul Labs exists for one clear purpose: to provide adult smokers worldwide an alternative to combustible cigarettes,\u201d according to a statement from Juul Labs CEO K.C. Crosthwaithe featured prominently on the firm\u2019s <a href=\"https:\/\/www.juullabs.com\/\">website<\/a>. \u201cWe do not want any non-nicotine users, especially those underage, to try our products, as they exist only to transition adult smokers away from combustible cigarettes.\u201d<\/p>\n<p>Nevertheless, Juul has faced a deluge of lawsuits from state governments. The state of North Carolina filed suit against the company in 2019 for \u201cdesigning, marketing, and selling its e-cigarettes to attract young people and for misrepresenting the potency and danger of nicotine in its products,\u201d according to a June 28 <a href=\"https:\/\/ncdoj.gov\/attorney-general-stein-reaches-agreement-with-juul-for-40-million-and-drastic-business-changes\/\">statement<\/a> from the office of Attorney General Josh Stein. Juul agreed to pay $40 million to the state and reform its practices to ensure that no one under 21 purchases the product.<\/p>\n<p>\u201cThis win will go a long way in keeping Juul products out of kids\u2019 hands, keeping its chemical vapor out of their lungs, and keeping its nicotine from poisoning and addicting their brains,\u201d Stein said. \u201cWe\u2019re not done \u2014 we still have to turn the tide on a teen vaping epidemic that was borne of Juul\u2019s greed.\u201d<\/p>\n<p>A <a href=\"https:\/\/www.mass.gov\/doc\/juul-complaint\/download\">complaint<\/a> filed by the commonwealth of Massachusetts in 2020 argued that the company \u201cengaged in unfair and deceptive acts and practices\u201d by \u201cselling nicotine products to children, adolescents, and other consumers younger than the minimum legal sales age.\u201d<\/p>\n<p>Meanwhile, the state of California <a href=\"https:\/\/www.dailywire.com\/news\/californias-ban-on-flavored-tobacco-sales-suspended-as-big-tobacco-funds-drive-to-repeal-law\">enacted<\/a> a law that imposed penalties on retailers who sold flavored tobacco products \u2014 including flavored vape juice and menthol cigarettes \u2014 with $250 fines per violation. Products such as hookah, pipe tobacco, and some cigars were exempt.
