According to a <a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2022\/06\/lynch-tesla-complaint-usdc-texas.pdf\">class action complaint<\/a> filed by John Lynch and Daxton Hartsfield \u2014 who worked at Tesla\u2019s Gigafactory 2 plant in Sparks, Nevada \u2014 the company violated the Worker Adjustment and Retraining Notification (WARN) Act by failing to provide 60 days of advance written notice regarding the mass layoff.<\/p>\n<p>\u201cPlaintiffs and all similarly situated employees have been damaged by Tesla\u2019s conduct constituting violations of the WARN Act,\u201d the lawsuit argues, \u201cand are entitled to damages for their back pay and associated benefits for each day of the violation because Tesla has not acted in good faith nor with reasonable grounds to believe their acts and omissions were not a violation of the WARN Act.\u201d<\/p>\n<p>Lynch and Hartsfield were allegedly informed of their dismissals on June 10 and 15, respectively, and laid off on the same days. They believe that \u201cmore than 500\u201d coworkers were placed in the same situation.<\/p>\n<p>\u201cIt\u2019s pretty shocking that Tesla would just blatantly violate federal labor law by laying off so many workers without providing the required notice,\u201d Shannon Liss-Riordan, a lawyer representing the workers, <a href=\"https:\/\/www.reuters.com\/business\/tesla-sued-by-former-employees-over-mass-layoff-2022-06-20\/\">told<\/a> Reuters.<\/p>\n<p>The Nevada employees are not the only ones affected by the layoffs. A Monday <a href=\"https:\/\/electrek.co\/2022\/06\/20\/tesla-lay-off-head-lgbtq-diversity-elon-musk-woke-mind-virus\/\">report<\/a> from electric vehicle news outlet Electrek showed that two employees involved in volunteer LGBTQ and diversity roles at the automaker also <a href=\"https:\/\/www.dailywire.com\/news\/lgbtq-diversity-officials-heads-roll-at-elon-musks-tesla\">lost their jobs<\/a>. Electrek made clear that both separations were part of the \u201cbroader wave of layoffs,\u201d but repeated that both employees had received multiple promotions in their relatively short tenures, seemingly indicating that their performance was not a cause for concern.<\/p>\n<p>Regarding Tesla\u2019s overall layoff plans, Musk has since clarified that he intends to decrease salaried headcount by 10% while increasing hourly staffing \u2014 ultimately affecting 3.5% of the overall workforce. \u201cA year from now, I think our head count will be higher in both salaried and obviously in hourly,\u201d Musk <a href=\"https:\/\/www.cnbc.com\/2022\/06\/21\/elon-musk-clarifies-tesla-layoffs-after-ex-employees-sue-company.html\">said<\/a> at a Bloomberg conference on Tuesday, per CNBC.<\/p>\n<p>According to CNBC, Musk, the world\u2019s richest man, also said that Lynch and Hartsfield\u2019s lawsuit has \u201cno standing.\u201d<\/p>\n<p>\u201cThat is a small lawsuit of minor consequence,\u201d he commented. \u201cAnything that relates to Tesla gets big headlines, whether it is a bicycle accident or something much more serious.\u201d<\/p>\n<p>Meanwhile, at SpaceX \u2014 which Musk also leads \u2014 multiple <a href=\"https:\/\/www.dailywire.com\/news\/get-woke-go-broke-spacex-fires-employees-who-wrote-a-letter-blasting-elon-musks-behavior-and-values\">employees were fired<\/a> for drafting and circulating a letter blasting the billionaire for his \u201cbehavior\u201d and \u201cvalues.\u201d<\/p>\n<p>\u201cElon\u2019s behavior in the public sphere is a frequent source of distraction and embarrassment for us, particularly in recent weeks,\u201d the letter asserted. \u201cAs our CEO and most prominent spokesperson, Elon is seen as the face of SpaceX \u2014 every tweet that Elon sends is a de facto public statement by the company.\u201d<\/p>\n<p>SpaceX President and COO Gwynne Shotwell said in an email that the employees had been fired. \u201cWe have too much critical work to accomplish and no need for this kind of overreaching activism,\u201d she wrote.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Two former Tesla employees filed suit against the automaker on Sunday for allegedly violating federal law through its decision to lay off much of its staff.
