She did note, however, that the first-degree murder charge would move forward and suggesting there was enough evidence to charge Russell with mayhem, the Associated Press <a href=\"https:\/\/www.kxly.com\/judge-drops-cannibalism-charge-in-northern-idaho-murder-case\/\">reported<\/a>.<\/p>\n<p>\u201cMayhem\u201d is <a href=\"https:\/\/legislature.idaho.gov\/statutesrules\/idstat\/title18\/t18ch50\/sect18-5001\/#:~:text=Idaho%20Statutes&#038;text=18%2D5001.,lip%2C%20is%20guilty%20of%20mayhem.\">defined under Idaho law<\/a> as maliciously depriving another person of their body, or who disables, disfigures, or renders that body useless. It also specifically includes putting out someone\u2019s eye and slitting their nose, ear, or lip.<\/p>\n<p>Law &#038; Crime <a href=\"https:\/\/lawandcrime.com\/crime\/judge-dismisses-cannibalism-charge-in-case-of-idaho-man-who-allegedly-murdered-a-property-caretaker-and-microwaved-body-parts\/\">reported<\/a> that Russell is believed to have been the first true use of Idaho\u2019s anti-cannibalism statute since it was adopted in 1990. If the charge had remained, Russell faced up to an additional 14 years in prison, though the murder charge alone carries the possibility of life in prison or the death penalty, the outlet noted.<\/p>\n<p>On September 13, 2021, the Bonner County Sheriff\u2019s Office published <a href=\"https:\/\/www.facebook.com\/bonnercountysheriff1\/photos\/a.1456242128014115\/2676556949315954\/\">a press release<\/a> on Facebook saying that three days earlier, sheriff\u2019s deputies \u201cresponded to a call of a suspicious death\u201d in Clark Fork, Idaho. At the scene, deputies found Flaget\u2019s body wrapped in plastic inside a vehicle and had to break a window to gain entry. Inside the truck, allegedly, were bloody clothes. The AP reported that Flaget apparently died due to blunt force trauma to his head, noting that investigators found blood dripping from his truck when they arrived.<\/p>\n<p>Investigators quickly located Russell, who was living on Flaget\u2019s property at the time. An investigation \u201cestablished probable cause\u201d that Russell had killed Flaget and he was arrested and charged with the crime.<\/p>\n<p>Subsequent reporting from Law &#038; Crime indicated that Russell was charged \u201cthanks in part to observations and statements by his own aunt and uncle.\u201d<\/p>\n<p>The original police affidavit noted \u201cpost mortum [sic] mayhem . . . along the right thigh, anus and genitalia,\u201d according to Law &#038; Crime. Inside Russell\u2019s home on the property, \u201cinvestigators found suspected human flesh, latex gloves, bloody newspapers, bloody duct tape pieces, cutting implements with suspected blood, [and] several areas of blood,\u201d the affidavit said.<\/p>\n<p>Another affidavit explained that investigators seized \u201ca bowl and microwave containing apparent blood and tissue\u201d from insider Russell\u2019s apartment. Those items were tested and found to contain Flaget\u2019s DNA.<\/p>\n<p>The cannibalism charge stemmed from Russell allegedly telling authorities that he thought he could \u201ccure his brain\u201d if he ate Flaget\u2019s remains,\u201d Law &#038; Crime <a href=\"https:\/\/lawandcrime.com\/crime\/idaho-man-charged-with-murder-cannibalism-thought-eating-the-victim-would-cure-his-brain-reports\/\">reported<\/a>. He also reportedly got into an argument with his uncle, Mark, on the day of Flaget\u2019s murder and later apologized in a voicemail, telling his uncle \u201cSorry . . .
