Jackson Women\u2019s Health Organization<\/em> \u2014 which could result in a reversal of landmark abortion cases\u00a0<em>Roe v. Wade<\/em> and\u00a0<em>Planned Parenthood v. Casey<\/em> \u2014 and <a href=\"https:\/\/www.cnn.com\/2022\/06\/17\/politics\/iowa-supreme-court-abortion-state-constitution-ruling\/index.html?utm_medium=social&#038;utm_source=twCNN&#038;utm_content=2022-06-17T19%3A41%3A16&#038;utm_term=link\">opens the door<\/a>\u00a0for the Iowa legislature to introduce more restrictive regulations or a complete abortion ban if that occurs.<\/p>\n<p>The Iowa court, which has shifted to the Right in recent years, <a href=\"https:\/\/www.desmoinesregister.com\/story\/news\/2022\/06\/17\/iowa-supreme-court-abortion-law-ruling-planned-parenthood-kim-reynolds\/7646049001\/\">overturned<\/a> a 2018 decision stating that abortion was a protected fundamental right under the state constitution\u2019s due process clause. The ruling also struck down a law that would have imposed a 72-hour waiting period for all abortions.<\/p>\n<p>Friday\u2019s ruling came pursuant to a 2020 law that would enact a 24-hour waiting period \u2014 a statute that was blocked by a lower court until Friday.<\/p>\n<p>\u201cAlthough we overrule (the 2018 decision), and thus reject the proposition that there is a fundamental right to an abortion in Iowa\u2019s Constitution subjecting abortion regulation to strict scrutiny, we do not at this time decide what constitutional standard should replace it,\u201d Justice Edward Mansfield wrote in the majority opinion, noting that the 2018 ruling \u201cinsufficiently recognizes that future human lives are at stake.\u201d<\/p>\n<p>Governor Kim Reynolds (R-IA) issued a statement on the ruling on Friday, saying, \u201cToday\u2019s ruling is a significant victory in our fight to protect the unborn. The Iowa Supreme Court reversed its earlier 2018 decision, which made Iowa the most abortion-friendly state in the country. Kim Reynolds (@IAGovernor) <a href=\"https:\/\/twitter.com\/IAGovernor\/status\/1537805062742892545?ref_src=twsrc%5Etfw\">June 17, 2022<\/a><\/p>\n<p>Chief Justice Susan Christensen <a href=\"https:\/\/who13.com\/news\/ap-top-headlines\/iowa-court-abortion-not-protected-by-state-constitution\/\">disagreed<\/a> with overturning the 2018 decision, arguing that because the state legislature had already begun the constitutional amendment process \u2014 in order to clearly state that abortion is not a fundamental right \u2014 the court should have simply allowed the legislative process to work in its own time.<\/p>\n<p>\u201cIf the majority truly wants to leave this issue to the will of the people, it should let the people have their say through the ongoing constitutional amendment process,\u201d she said.<\/p>\n<p>As Iowa law stands, abortions are banned after 20 weeks.
