It\u2019s always about what message they want expressed.\u201d<\/p>\n<p>Smith said in a <a href=\"https:\/\/adfmedia.org\/case\/303-creative-v-elenis\">press conference<\/a> last Thursday that she started her own design studio, 303 Creative, so she could promote causes she believed in, including \u201ca heart for children with special needs, overseas missions, the beauty of marriage, animal shelters, and veterans.\u201d When she wanted to expand her business to include weddings, the state of Colorado would not allow her to do so unless she created websites for same-sex weddings as well.<\/p>\n<p>\u201cThe Colorado law restricts the fundamental First Amendment rights of Lorie and other business owners like her, and it doesn\u2019t just target Christians only,\u201d Sen.Ted Cruz said. \u201cConsider it this way: Should a Muslim artist be compelled by the government to draw the image of Mohammed? Should Jewish artists be forced to create art that they consider to be antisemitic? Should a Democrat political firm be forced to take on Republican clients? Should left-wing newspaper columnists be forced to write conservative columns? No, no, no, and \u2014 as fun as it might be \u2014 no.\u201d<\/p>\n<p>Cruz and other members of Congress filed an <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/21\/21-476\/198042\/20211028154029665_21-476%20303%20Creative%20Members%20Amicus%20Brief.pdf\">amici curiae brief<\/a> urging the Supreme Court to take Smith\u2019s case, 303 Creative v. Elenis, which the court did in February. Kristen Waggoner, general counsel at Alliance Defending Freedom, will argue the case before the Supreme Court.<\/p>\n<p>Waggoner said a victory in this case deals with different arguments than Jack Phillips\u2019 case, which Waggoner also argued before the Supreme Court. \u201cFree speech and free exercise were in Masterpiece, but the court\u2019s holding was based on free exercise \u2014 it didn\u2019t touch the free speech arguments,\u201d Waggoner said. \u201c303 Creative deals with those free speech arguments.\u201d<\/p>\n<p>Waggoner said the Tenth Circuit Court of Appeals rule 2-1 against Smith, in spite of facts that the court and both parties agreed on: \u201cFirst, Lorie\u2019s religious beliefs are sincere, and they guide every aspect of her life,\u201d Waggoner said. \u201cSecond, Laurie works with all people, from all walks of life, including those who identify as LGBT. Third, the parties and the lower court agreed that Lorie bases her decisions on the content of the message, not the person requesting it. And lastly, the parties have agreed, and the court below agreed, that Lorie\u2019s speech is protected by the First Amendment because she is communicating a message.\u201d<\/p>\n<p>Because the argument is about free speech, the ruling will set precedent for cases that don\u2019t involve religion at all, including the cases of people who oppose Smith\u2019s beliefs.<\/p>\n<p>\u201cA win for Lorie in this case is a win for everyone,\u201d Sen.
