Version: 4.0.47--><div><\/div>\n<p>The Biden administration suffered a legal blow when a federal judge on Friday struck down guidelines meant to limit the number of illegal immigrants that can be arrested or deported.<\/p>\n<p>U.S. District Court Judge Drew Tipton declared the directive, issued in September, to be unlawful.<\/p>\n<p>Homeland Security (DHS) Secretary Alejandro Mayorkas issued a memorandum to Immigration and Customs Enforcement (ICE) <a href=\"https:\/\/www.ice.gov\/doclib\/news\/guidelines-civilimmigrationlaw.pdf\" target=\"_blank\" rel=\"noopener\">limiting arrests<\/a> and deportations to those posing a threat to national security and public safety or who had more recently crossed the border.<\/p>\n<p>The Mayorkas memo refers to illegal immigrants as \u201cundocumented noncitizens.\u201d<\/p>\n<p>The Washington Post reported at the time what the new directive meant: \u201cThe fact that someone is an undocumented immigrant \u2018should not alone be the basis\u2019 of a decision to detain and deport them from the United States.\u201d<\/p>\n<p>In other words, in the eyes of the administration, simply violating the laws of a sovereign nation isn\u2019t criminal enough to pursue.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">SCOOP: DHS issues new arrest and deportation guidelines to immigration agents <a href=\"https:\/\/t.co\/cgzvS4zyun\">https:\/\/t.co\/cgzvS4zyun<\/a><\/p>\n<p>\u2014 Maria Sacchetti (@mariasacchetti) <a href=\"https:\/\/twitter.com\/mariasacchetti\/status\/1443644963988856843?ref_src=twsrc%5Etfw\">September 30, 2021<\/a><\/p>\n<\/blockquote>\n<p><strong>RELATED: <a href=\"https:\/\/thepoliticalinsider.com\/texas-judge-demands-biden-admin-stop-releasing-covid-infected-illegal-immigrants-into-community\/\" target=\"_blank\" rel=\"noopener\">Texas Judge Demands Biden Admin Stop Releasing \u2018COVID Infected\u2019 Illegal Immigrants Into Community<\/a><\/strong><\/p>\n<h3>Biden Admin\u2019s Attempts to Limit Arrests of Illegal Immigrants Gets Knocked Down<\/h3>\n<div id=\"subscribe\" class=\"email-signup inarticle\">\n<h4>Support Conservative Voices!<\/h4>\n<h5><strong>Sign up to receive the latest<\/strong> political news, insight, and commentary delivered directly to your inbox.<\/h5>\n<\/div>\n<p>Judge Tipton, an appointee of former President Donald Trump, struck down the DHS directive, saying it doesn\u2019t square with federal law.<\/p>\n<p>The federal government, he said, \u201coffers an implausible construction of federal law that flies in the face of the limitations imposed by Congress.\u201d<\/p>\n<p>He went on to suggest the government has discretion on an individual basis but can\u2019t dictate such a broad counter policy to the law.<\/p>\n<p>\u201cTrue, the Executive Branch has case-by-case discretion to abandon immigration enforcement as to a particular individual,\u201d he said.<\/p>\n<p>\u201cThis case, however, does not involve individualized decision-making. Instead, this case is about a rule that binds Department of Homeland Security officials in a generalized, prospective manner\u2014all in contravention of Congress\u2019s detention mandate.\u201d<\/p>\n<p>Tipton\u2019s ruling is in response to a lawsuit filed by\u00a0Texas and Louisiana.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">The Biden Administration lost another significant court case. potentially as many as 1.4 million illegal immigrants have crossed the border into the United States since President Biden took office.<\/p>\n<p>Nearly a million had been released into the country.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Alejandro Mayorkas admits that the DHS has released at least 836,000 illegal immigrants into the U.S. since January 21. href=\"https:\/\/time.com\/6176711\/title-42-biden-judge-blocked\/\" target=\"_blank\" rel=\"noopener\">another blow<\/a> when it blocked the lifting of Title 42, a health measure first implemented under Trump that allowed for deporting of illegal immigrants based on COVID pandemic concerns.<\/p>\n<p>Local officials \u2013 Democrats and Republicans alike \u2013 had begged Biden not to end Title 42, which experts said will make the border crisis even worse.<\/p>\n<p>Instead, Biden is <a href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/bidens-options-limited-on-title-42-covid-19-migration-rule-after-court-ruling\" target=\"_blank\" rel=\"noopener\">appealing<\/a> the decision.<\/p>\n<p>For a guy who <a href=\"https:\/\/decider.com\/2022\/06\/09\/joe-biden-trump-abused-constitution-executive-orders-jimmy-kimmel-live\/\" target=\"_blank\" rel=\"noopener\">recently claimed<\/a> he doesn\u2019t want to emulate Trump\u2019s alleged \u201cabuse of the constitution and the constitutional authority,\u201d he sure does get struck down by courts that have found he has repeatedly disregarded constitutional limits an awful lot.<\/p>\n<p>Whether it is the <a href=\"https:\/\/law.stanford.edu\/2022\/01\/20\/a-look-at-the-supreme-court-ruling-on-vaccination-mandates\/\" target=\"_blank\" rel=\"noopener\">vaccine mandate<\/a> for businesses, <a href=\"https:\/\/www.americanbar.org\/groups\/business_law\/publications\/blt\/2021\/09\/eviction-moratorium\/\" target=\"_blank\" rel=\"noopener\">eviction moratoriums<\/a>, or this new ruling on limiting arrests and deportations of illegal immigrants, the true abuser of the Constitution is <em>currently<\/em>
