It is unlikely that a single liberal voter is going to turn on Murphy for convincing 10 Republican senators to concede that guns, rather than underlying cultural and societal forces, are driving mass shootings. <\/p>\n<p>It\u2019s not as if Murphy agreed to negotiate for <a href=\"https:\/\/www.cornyn.senate.gov\/content\/news\/cornyn-hagerty-grassley-inhofe-senate-gop-introduce-concealed-carry-reciprocity-bill\" target=\"_blank\" rel=\"noreferrer noopener\">concealed carry reciprocity<\/a> or the <a href=\"https:\/\/twitter.com\/johncornyn\/status\/973220873061662720\" target=\"_blank\" rel=\"noreferrer noopener\">funding<\/a> programs that train teachers to defend themselves and their students \u2014 ideas that lead Republican negotiator Sen. John Cornyn allegedly supports. He gave up nothing. Murphy is already re-tweeting The New York Times\u2019 <a href=\"https:\/\/twitter.com\/ChrisMurphyCT\/status\/1536313579066081286\" target=\"_blank\" rel=\"noreferrer noopener\">claim<\/a> that Democrats got more than they had \u201choped for.\u201d The bipartisan deal, says The Washington Post, is just a \u201c<a href=\"https:\/\/www.washingtonpost.com\/opinions\/2022\/06\/12\/senates-bipartisan-gun-deal-is-an-encouraging-first-step\/\" target=\"_blank\" rel=\"noreferrer noopener\">first step<\/a>.\u201d In a day or two, if that, liberals will be back to accusing legal gun owners of being abettors of terrorism and child murder.<\/p>\n<p>How bad is the deal? We won\u2019t really know until we see the specifics of the legislation.<\/p>\n<p><a href=\"https:\/\/twitter.com\/ChrisMurphyCT\/status\/1536013606365569024\">According<\/a> to Murphy \u2014 who not ago long was <a href=\"https:\/\/thefederalist.com\/2022\/05\/25\/dont-surrender-to-do-somethingism-on-guns\/\" target=\"_blank\" rel=\"noreferrer noopener\">telling<\/a> reporters, \u201c[s]pare me the bullsh-t about mental illness\u201d \u2014 there will be \u201cbillions in new funding for mental health and school safety,\u201d including money for \u201ccommunity mental health clinics.\u201d I\u2019m skeptical that more spending is any kind of remedy for mass shootings, but there\u2019s no downside with bringing more focus on mental health concerns. In virtually every recent shooting, from Parkland to Uvalde, the murderer exhibited violent antisocial behavior that was crying out for intervention. Certainly, enhancing programs to spot these troubled kids doesn\u2019t intrude on the Second Amendment. Presumably this is a component everyone wants. <\/p>\n<p>After that it gets more <a href=\"https:\/\/twitter.com\/ChrisMurphyCT\/status\/1536013605132505093\" target=\"_blank\" rel=\"noreferrer noopener\">complicated<\/a>. <\/p>\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"761\" height=\"703\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/06\/image-1.png\" alt=\"\" class=\"wp-image-273972\" srcset=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/06\/image-1.png 761w, https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/06\/image-1-300x277-1.png 300w\" \/><\/figure>\n<p>\u201cRed flag laws\u201d \u2014 perhaps the only measure within the senators\u2019 framework that could, conceivably, stop mass shootings \u2014 are beyond the federal government\u2019s scope. So, 10 Republican senators have agreed to bribe states into participating in passing emergency risk-protection legislation that allows courts to take guns from those deemed a threat to themselves or others.<\/p>\n<p>When carefully written, red flag laws may have merit, but prudence is rare. In states like California, Connecticut, and Maryland, authorities can confiscate weapons merely on the strength of an uncorroborated allegation by family members, coworkers, law enforcement officers, or others without any kind of genuine due process. Will Senate Republicans guarantee that funding for state laws is contingent on laws that have protections for basic due process rights, penalties for bringing frivolous or false charges against gun owners, and assurances that those who receive the proper mental health treatment get their weapons returned, because in many places a \u201ctemporary\u201d petition means a lifetime ban? Seems unlikely.<\/p>\n<p>Not that long ago, Democrats <a href=\"https:\/\/www.nbcnews.com\/storyline\/orlando-nightclub-massacre\/no-fly-no-buy-has-political-support-may-have-little-n593186\" target=\"_blank\" rel=\"noreferrer noopener\">wanted<\/a> to pass a bill that would have stripped anyone on terror watch and no-fly lists \u2014 some 40 percent of whom have nothing <a href=\"https:\/\/www.techdirt.com\/2014\/08\/05\/nearly-40-those-governments-terrorist-watchlist-have-no-affiliation-with-recognized-terrorism-groups\/\">even tangentially<\/a> to do with terrorism \u2014 of both their Fifth and Second Amendment rights. Republicans have no reason to trust their devotion to due process.<\/p>\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"753\" height=\"353\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/06\/image-2.png\" alt=\"\" class=\"wp-image-273974\" srcset=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/06\/image-2.png 753w, https:\/\/thefederalist.com\/wp-content\/uploads\/2022\/06\/image-2-300x141.png 300w\" \/><\/figure>\n<p>The\u00a0<a href=\"https:\/\/www.justice.gov\/archives\/jm\/criminal-resource-manual-1117-restrictions-possession-firearms-individuals-convicted\" target=\"_blank\" rel=\"noreferrer noopener\">Domestic Violence Offender Gun Ban<\/a>, an amendment to the Gun Control Act of 1968, already prohibits anyone convicted of a domestic violence misdemeanor, or anyone under a restraining order, from possessing a firearm. The definition of a partner is somewhat opaque.\u00a0If the new law merely\u00a0includes boyfriends under the law, that\u2019s great. In the past, however, Democrats have not only tried to expand the definition of partner, but also the reasons for losing your gun rights to\u00a0<a href=\"https:\/\/www.nytimes.com\/2019\/04\/01\/us\/politics\/nra-domestic-violence-congress.html\" target=\"_blank\" rel=\"noreferrer noopener\">include<\/a>\u00a0many types of non-violent misdemeanors. Not so great.<\/p>\n<p>It is also somewhat unclear whether the bipartisan deal is aimed at those convicted of a crime, rather than merely accused of it. Murphy says \u201c<a href=\"https:\/\/twitter.com\/ChrisMurphyCT\/status\/1536013607590322176?s=20&#038;t=_0yVQEJwKmNlXFTvfDj4Jg\">convicted<\/a>\u201d but the Times\u2019 news story says the law will harder for those \u201c<a href=\"https:\/\/www.nytimes.com\/2022\/06\/12\/us\/gun-deal-democrats.html\">accused<\/a>\u201d of domestic violence to obtain guns \u2014 obviously, an important distinction. <\/p>\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"760\" height=\"385\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/06\/image-3.png\" alt=\"\" class=\"wp-image-273976\" srcset=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/06\/image-3.png 760w, https:\/\/thefederalist.com\/wp-content\/uploads\/2022\/06\/image-3-300x152.png 300w\" \/><\/figure>\n<p><a href=\"https:\/\/twitter.com\/ChrisMurphyCT\/status\/1536314676954398722\" target=\"_blank\" rel=\"noreferrer noopener\">Straw purchases<\/a>, buying a gun legally on behalf of a person who can\u2019t, and gun trafficking are both already illegal. The Feds <a href=\"https:\/\/www.atf.gov\/news\/pr\/10-people-indicted-scheme-%E2%80%9Cstraw-purchase%E2%80%9D-firearms\" target=\"_blank\" rel=\"noreferrer noopener\">prosecute<\/a> people on both counts <a href=\"https:\/\/www.google.com\/search?q=gun+trafficking+charged+in&#038;rlz=1C5CHFA_enUS913US913&#038;sxsrf=ALiCzsY6TbECqu5AhlsRgd7-Sf6AZ1Z_4w:1655145323715&#038;source=lnms&#038;tbm=nws&#038;sa=X&#038;ved=2ahUKEwjIicnoiKv4AhVwg3IEHUodBd0Q_AUoAXoECAEQAw&#038;biw=1267&#038;bih=877&#038;dpr=2\">every single day<\/a>. Democrats, unable to pass \u201cuniversal\u201d background checks, have been looking to make it so prohibitively difficult for individuals, non-dealers, to sell or gift a gun that they abandon the practice altogether. This would be a good means of achieving that goal. <\/p>\n<p>The framework <a href=\"https:\/\/twitter.com\/JakeSherman\/status\/1536010845917954048\/photo\/2\">released<\/a> by senators also promises enhanced background checks for those under 21. It\u2019s unclear how that would have stopped any mass shooting. Most of these murderers have no record. Do we think they won\u2019t just wait a few more days? Senators also promise to \u201ccrack[] down on criminals who illegally evade licensing requirements.\u201d What does that even mean? It\u2019s already illegal. Will the law say that it\u2019s super-duper illegal, or will there be new regulations that make it easier for the federal government to target dealers and revoke Federal Firearms Licenses over innocent paperwork errors? <\/p>\n<p>We don\u2019t know yet.
