Wade<\/em>, the landmark 1973 decision that declared abortion a constitutionally protected right for Americans. But that never happened.<\/p>\n<p>Although the court\u2019s calendar did not have another day on which the release of opinions was scheduled, the high court on Thursday updated its calendar to indicate decisions would be handed down on Monday and Wednesday.<\/p>\n<p>In all, the court has still nearly 30 opinions to be delivered within the next month before it takes its traditional summer break.<\/p>\n<p>Last month, a draft of a Supreme Court opinion that would overturn\u00a0<em>Roe v. Wade<\/em>\u00a0was leaked to Politico. In the 98-page majority opinion, Justice Samuel Alito said, \u201cRoe was egregiously wrong from the<\/p>\n<p>\u201cWe hold that\u00a0<em>Roe<\/em>\u00a0and\u00a0<em>Casey<\/em>\u00a0must be overruled,\u201d Alito writes, a move that would invalidate the landmark 1973 decision that declared abortion constitutional.<\/p>\n<p>There are several theories about\u00a0<em>why<\/em>\u00a0the opinion was leaked.<\/p>\n<p>\u201cI think it\u2019s plainly an attempt by the Left to try and change the outcome in this case and corrupt the process, and the court must not allow that to happen,\u201d Sen. Josh Hawley (R-MO)\u00a0<a href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/hawley-supreme-court-leak-an-attempt-by-left-to-change-decision\">said<\/a>\u00a0on Fox News.<\/p>\n<p>Harvard Law professor emeritus Alan Dershowitz later <a href=\"https:\/\/video.foxnews.com\/v\/6305539087112#sp=show-clips\">proffered<\/a>\u00a0a theory.<\/p>\n<p>\u201cI have a theory, and it\u2019s only a theory,\u201d Dershowitz said on Fox News. \u201cI think this was leaked by a liberal law clerk who was trying to change the outcome of the case, either by putting pressure on some of the justices to change their mind, or by getting Congress to pack the court even before June, which is very unlikely, or to get Congress to pass a national right-to-abortion law, which would apply to all the states, and that would have to come to the Supreme Court to see whether that could be upheld under the Commerce Clause.\u201d<\/p>\n<p>\u201cBut I think this is real, and \u2026 my theory is that it was leaked by somebody who wants to change the outcome,\u201d the attorney said. \u201cLook, I\u2019ve been watching Supreme Court for 55 years. And this has all the hallmarks of reality and it does not have the hallmark of a decision that\u2019s likely to be changed. Maybe Chief Justice Roberts will go with the minority, but I think they seem to have five votes at this point to overrule\u00a0<em>Roe vs. Wade<\/em>.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Will it happen today?
