Marjorie Taylor Greene<\/a>\u00a0(R-GA) on Tuesday posted a video of her asking <a href=\"https:\/\/www.dailywire.com\/topic\/lindsey-graham\">Sen. Lindsey Graham<\/a> (R-SC) about any potential so-called red flag legislation and his commitment to due process.<\/p>\n<p>Red flag laws permit a judge to temporarily seize a person\u2019s guns without a trial, based on a written complaint that the person in question might be a danger to themselves or others. Critics have <a href=\"https:\/\/www.dailywire.com\/news\/red-flag-laws-and-unintended-consequences\">argued<\/a> such legislation eliminates due process protections, while <a href=\"https:\/\/www.washingtonpost.com\/outlook\/2022\/06\/07\/red-flag-gun-laws-constitution-due-process\/\">proponents<\/a> state that due process is not violated.<\/p>\n<p>\u201cIn 2019, Lindsey Graham promised he wouldn\u2019t support gun confiscation without due process. In 2022, he\u2019s ready to help Biden and the Democrats pass all of their gun control bills,\u201d Greene charged in a <a href=\"https:\/\/gettr.com\/post\/p1d2qb7ac2c\">post<\/a> published on her Gettr account.<\/p>\n<p>\u201cLindsey Graham needs to hear from you. Tell him to vote NO on gun control, especially red flag gun confiscation,\u201d she added.<\/p>\n<p>In the accompanying video, Greene tells Graham she\u2019s concerned about red flag legislation as a \u201cgun owner\u201d and a \u201cbusiness owner,\u201d and asks the senator to protect due process on any such legislation.<\/p>\n<p>\u201cI ask if you guys will consider a way to put in this bill, where it doesn\u2019t violate due process,\u201d she told Graham.<\/p>\n<p>\u201cWe will,\u201d the senator responded. \u201cThere won\u2019t be a bill without that.\u201d<\/p>\n<p>\u201cOh, thank you so much, sir,\u201d Greene told Graham.<\/p>\n<p>The Georgia representative then again told the senator she was \u201cconcerned,\u201d to which Graham said, \u201cI promise you there will not be,\u201d seemingly referring to infringement on due process protections.<\/p>\n<p>In an <a href=\"https:\/\/www.dailywire.com\/news\/red-flag-laws-and-unintended-consequences\">op-ed<\/a> for The Daily Wire,\u00a0<a href=\"https:\/\/www.foxnews.com\/opinion\/nikki-goeser-my-husband-was-shot-dead-in-a-gun-free-zone-now-his-imprisoned-killer-sends-me-love-letters\">Nikki Goeser<\/a>, the executive director for the <a href=\"http:\/\/crimeresearch.org\/\">Crime Prevention Research Center<\/a>, warned that red flag laws \u201cremove all these due process protections.\u201d<\/p>\n<p>\u201cThese laws allow judges to seize a person\u2019s guns without a trial, based solely on a written complaint that the person might be a danger to themselves or others,\u201d she wrote. \u201cAll a judge needs is \u2018reasonable suspicion.&#8217;\u201d<\/p>\n<p>\u201cIt has always been possible to take a dangerous person\u2019s guns away,\u201d Goeser continued. \u201cAll 50 states and the federal government have involuntary commitment laws that go by various names: the Baker Act in Florida, for example, or the 5150 code in California. They all require a mental health expert to testify before a judge, but hearings can occur quickly in urgent cases. If those facing a hearing can\u2019t afford a lawyer, the judge provides them with one. Judges have a lot of flexibility when ruling.
