A Pentagon spokesperson denied the claim.<\/p>\n<p><span><strong>Fact Check:<\/strong><\/span><\/p>\n<p>Sussmann was indicted in 2021 on charges of lying to the FBI about a tip he passed to the agency about former President Donald Trump\u2019s alleged ties to Russia, according to <a href=\"https:\/\/www.cnn.com\/2022\/05\/31\/politics\/sussmann-verdict\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\">CNN<\/a>. He was unanimously acquitted by a jury May 31, the outlet reported.<\/p>\n<p>The Facebook image features a photo of Sussmann with text on the left-hand side that reads, \u201cMilitary Arrests Michael Sussman for Treason!\u201d The claim also <a href=\"https:\/\/twitter.com\/leggsharon0\/status\/1534356631345045508\" target=\"_blank\" rel=\"noopener noreferrer\">appeared<\/a> on <a href=\"https:\/\/twitter.com\/ArmageddonGC\/status\/1533898415511314433\" target=\"_blank\" rel=\"noopener noreferrer\">Twitter<\/a>. <strong><a href=\"https:\/\/checkyourfact.com\/2022\/06\/03\/fact-check-did-military-arrest-white-house-chief\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Did The US Military Arrest White House Deputy Chief Of Staff Jen O\u2019Malley Dillion?)<\/a><\/strong><\/p>\n<p>There is no evidence that Sussmann has been arrested for such a crime or will be facing a new trial. Neither <a href=\"https:\/\/www.defense.gov\/News\/releases\/\" target=\"_blank\" rel=\"noopener noreferrer\">the Pentagon<\/a> nor the <a href=\"https:\/\/search.justice.gov\/search?query=michael+sussmann&#038;op=Search&#038;affiliate=justice\" target=\"_blank\" rel=\"noopener noreferrer\">Department of Justice<\/a> has issued any press releases or put out any <a href=\"https:\/\/twitter.com\/search?q=Michael%20Sussman%20(from%3A%40TheJusticeDept%20AND%20%40DeptofDefense)&#038;src=typed_query&#038;f=top\" target=\"_blank\" rel=\"noopener noreferrer\">social<\/a> <a href=\"https:\/\/www.facebook.com\/profile\/100064654872564\/search\/?q=Michael%20Sussman\" target=\"_blank\" rel=\"noopener noreferrer\">media<\/a> <a href=\"https:\/\/www.facebook.com\/profile\/100064688230749\/search\/?q=Michael%20Sussman\" target=\"_blank\" rel=\"noopener noreferrer\">posts<\/a> regarding Sussmann\u2019s alleged detainment. The last statement about the lawyer appears to be from the Justice Department\u2019s original September 2021 <a href=\"https:\/\/www.justice.gov\/sco\/pr\/grand-jury-indicts-dc-attorney-making-false-statements-fbi-2016-regarding-alleged\" target=\"_blank\" rel=\"noopener noreferrer\">announcement<\/a> about indicting him for false statements.<\/p>\n<p>\u201cThat claim is completely false,\u201d a Pentagon spokesperson said in an email to Check Your Fact. The spokesperson further pointed Check Your Fact to the <a href=\"https:\/\/www.brennancenter.org\/our-work\/research-reports\/posse-comitatus-act-explained\" target=\"_blank\" rel=\"noopener noreferrer\">Posse Comitatus Act<\/a>, which \u201climits the powers of the federal government in the use of federal military personnel to enforce domestic policies with the U.S.\u201d This includes barring federal troops from participating in civilian law enforcement except when \u201cexpressly authorized by law.\u201d<\/p>\n<p>The claim appears to stem from a June 6 article <a href=\"https:\/\/realrawnews.com\/2022\/06\/military-arrests-michael-sussmann\/\" target=\"_blank\" rel=\"noopener noreferrer\">published<\/a> on Real Raw News, which documents an early-morning raid on a beachfront property allegedly belonging to Sussmann. Real Raw News includes a <a href=\"https:\/\/realrawnews.com\/about-us\/\">disclaimer<\/a> on its website that reads in part, \u201cThis website contains humor, parody, and satire.\u201d<\/p>\n<p>This is not the first time a false claim about a high-profile individual being arrested has circulated on social media.
