Josh Hawley pressed President Joe Biden\u2019s judicial nominee for commissioner and vice chair of the U.S. Sentencing Commission on whether rape should have mandatory minimums.<\/p>\n<p><a href=\"https:\/\/dailycaller.com\/2022\/03\/21\/josh-hawley-abc-news-reporter-judges-child-porn\/\" target=\"_blank\" rel=\"noopener noreferrer\">Hawley<\/a> cited nominee Laura Mate calling for the commission to change its guidelines to allow judges to \u201cdepart\u201d from mandatory minimum sentencing guidelines. He asked if there is any crime, namely rape, in which a mandatory minimum should be implemented.<\/p>\n<p>\u201cMy understanding is this body decides whether there are mandatory minimums and as a commissioner, my job would be\u2014\u201d she said.<\/p>\n<p>\u201cYou make recommendations, I\u2019m asking you if you think there\u2019s any crime \u2014 rape \u2014 in which there ought to be a mandatory minimum. Because you said earlier there shouldn\u2019t be, I\u2019m astounded by that,\u201d Hawley said.<\/p>\n<p><strong>WATCH:<\/strong><\/p>\n<p>Mate said she would make an \u201cinformed\u201d recommendation on mandatory minimums after consulting with her colleagues. The senator called her alleged position \u201cradical\u201d and suggested that her nomination is a reflection on the Biden administration\u2019s stance on crime. <strong><a href=\"https:\/\/dailycaller.com\/2022\/05\/19\/sen-josh-hawley-energy-secretary-grahholm-putin-gas-prices\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: \u2018Utter Nonsense\u2019: Sen. Hawley Grills Energy Secretary After Pinning Putin For Gas Prices)\u00a0<\/a><\/strong><\/p>\n<p>\u201cHow can I make an informed judgement on voting for you if you won\u2019t tell me what your positions are?\u201d the senator asked. \u201cI don\u2019t know if you\u2019ve changed them or not. It sounds like you have changed them. You signed a letter, you took, very frankly, radical policy positions and now you won\u2019t answer me, what am I to draw from that?\u201d<\/p>\n<p>\u201cSenator, I hope that what you draw is that I\u2019m open to listening to this diverse\u2014\u201d Mate began.<\/p>\n<p>\u201cNo, I think what I draw from it is that you don\u2019t want to answer my questions,\u201d Hawley interjected. \u201cBecause the positions that you took were radical, and frankly I think wrong. And in light of the dangers that children and people all over this country are facing, I think [is] deeply, deeply wrongheaded. I can\u2019t possibly support your nomination. I can\u2019t support the nomination of someone that wants to do away with mandatory minimums. I think it\u2019s a radical position and I think, frankly, your nomination is indicative of where this administration is on its soft-on-crime policies.\u201d<\/p>\n<p>In March, <a href=\"https:\/\/dailycaller.com\/2022\/03\/17\/alarming-pattern-josh-hawley-supreme-court-nominee-ketanji-brown-jackson-record-child-porn\/\" target=\"_blank\" rel=\"noopener noreferrer\">Hawley<\/a> raised concerns with then-Supreme Court nominee Ketanji Brown Jackson about sentencing child pornography offenders inconsistent with mandatory minimum guidelines. In the case <em>United States v. Hawkins<\/em>, Jackson sentenced a convicted child porn offender 3 months imprisonment despite guidelines recommending up to 10 years.<\/p>\n<p>Jackson, who <a href=\"https:\/\/dailycaller.com\/2022\/03\/22\/ketanji-brown-jackson-child-pornography-sentencing-supreme-court\/\" target=\"_blank\" rel=\"noopener noreferrer\">defended<\/a> her record, <a href=\"https:\/\/dailycaller.com\/2022\/03\/22\/josh-hawley-judge-jackson-child-porn-offender-scotus-hearing\/\" target=\"_blank\" rel=\"noopener noreferrer\">said<\/a> during a hearing before the Senate Judiciary Committee that the sentencing decision must be based on the various circumstances and factors of the case.
