In a statement posted on Instagram, her ex-husband Johnny Depp wrote: \u201cVeritas numquam perit. Truth never perishes.\u201d<\/p>\n<p>The verdict wasn\u2019t just against Heard for defaming Depp. It was a searing indictment of a sorry chapter in American justice: the illogical, unjust \u201cBelieve Her\u201d industry that made Heard a poster girl for a corrupt movement determined to crush men and stamp out a keystone of our civil liberties.<\/p>\n<p>The movement has other names, such as \u201cMe Too,\u201d \u201cBelieve Women,\u201d \u201cBelieve All Women,\u201d \u201cBelieve Survivors,\u201d and \u201cTime\u2019s Up.\u201d The defamation verdict exposes this multimillion-dollar industry of nonprofits, lawyers, corporations, lobbyists, and publicists who have weaponized victimhood and pithy jingles to destroy the fundamental concept of due process and foment injustice by exploiting the noble cause of women\u2019s rights.<\/p>\n<p>This trampling of the rights of the accused has been carried out with the complicity of irresponsible media outlets that have included the <a href=\"https:\/\/thehill.com\/blogs\/pundits-blog\/media\/3509487-washington-post-adds-editors-note-to-heard-op-ed-after-verdict\/\">Washington Post<\/a>, <a href=\"https:\/\/www.bbc.com\/news\/world-us-canada-37879151\">Rolling Stone<\/a>, <a href=\"https:\/\/www.vogue.com\/article\/why-its-time-to-believe-amber-heard\">Vogue<\/a>, and <a href=\"https:\/\/www.glamour.com\/story\/amber-heard-january-2018-cover-story\">Glamour<\/a>. They have littered their pages with lopsided narratives, character assassinations, and\u2014now a jury confirms\u2014lies.<\/p>\n<p>In the third row of the spectator gallery last week, Italian-born producer Giuseppe Mercadante, a local father, said the principle of innocent until proven guilty won. \u201cOver the past few years,\u201d he told me, \u201cSomething else has prevailed that took us back to pre-Medieval times when the law was a mob chasing the accused.\u201d<\/p>\n<p>Media outlets, including <a href=\"https:\/\/www.today.com\/news\/news\/exclusive-amber-heards-attorney-says-actor-was-demonized-johnny-depps-rcna31583\">NBC\u2019s \u201cToday\u201d Show<\/a>, <a href=\"https:\/\/www.cnn.com\/2022\/06\/02\/entertainment\/amber-heard-attorney-appeal\/index.html\">CNN<\/a> and<a href=\"https:\/\/www.cbsnews.com\/video\/amber-heards-attorney-elaine-bredehoft-on-verdict-and-whats-next\/\"> CBS<\/a>, continued their complicity in Me Too injustice, however, giving the microphone to Heard attorney Elaine Bredehoft as she did a shameless media tour, smearing Depp and the jurors. In addition, media outlets like The New York Times, The New Yorker, and Rolling Stone pressed a narrative that the verdict is a <a href=\"https:\/\/www.newyorker.com\/culture\/cultural-comment\/the-depp-heard-verdict-is-chilling\">\u201cchilling\u201d<\/a> symbol of \u201cmisogyny\u201d that \u201csickened\u201d survivors of abuse. Heard\u2019s publicity team didn\u2019t return a request for comment.<\/p>\n<p>In trying to understand how we got here as a society, I <a href=\"https:\/\/thefederalist.com\/2022\/05\/09\/how-the-washington-post-and-aclu-helped-amber-heard-attack-johnny-depp\/\">analyzed<\/a> how the American Civil Liberties Union\u2019s PR, legal, fundraising, and \u201cartist engagement\u201d staff and Washington Post editors functioned as co-conspirators with Heard, publishing the <a href=\"https:\/\/www.washingtonpost.com\/opinions\/ive-seen-how-institutions-protect-men-accused-of-abuse-heres-what-we-can-do\/2018\/12\/18\/71fd876a-02ed-11e9-b5df-5d3874f1ac36_story.html\">2018 op-ed<\/a> with Heard\u2019s defamation. Then, after staying overnight to witness Day 20 of the courtroom dynamics and leaving convinced that Heard had defamed Depp, I followed the breadcrumbs that a Hollywood agent, Claire Best, tracked after she noticed an abuse of power by \u201cBelieve Her\u201d advocates. \u201cPeople are finally waking up to the victim entrepreneurship industry,\u201d Best said after the jury verdict.<\/p>\n<p>Here are four phases in the \u201cBelieve Her\u201d industry that brought us to this point. You can see the phases in more detail <a href=\"https:\/\/asrainvestigates.substack.com\/publish\/post\/54532084\">on my Substack<\/a>.<\/p>\n<h2><strong>Phase 1: Exploit Good Intentions<\/strong><\/h2>\n<p>In 1981, as women were dismantling barriers in the workplace, the National Women\u2019s Law Center, started as an initiative a decade earlier, was reorganized as a 501(c)3 to fight sex discrimination and sexual harassment. Heard was born into this new era in 1986.<\/p>\n<p>In 2012, the law center registered a political lobbying group and in 2018 it <a href=\"https:\/\/timesupfoundation.org\/about\/our-story\/\">launched<\/a> the \u201cTime\u2019s Up Legal Defense Fund\u201d with a powerful Democratic public relations firm, SKDK, to offer \u201clegal representation and public relations assistance\u201d to \u201csurvivors of harassment and abuse.\u201d It attracted big bucks: The law center and its affiliates had $64.7 million in revenues and $101.7 million in assets for the fiscal year ending June 30, 2021, according to its <a href=\"https:\/\/nwlc.org\/about\/annual-reports-financials\/\">2021 financial statement.<\/a> <\/p>\n<p>An SKDK official declined comment. The National Women\u2019s Law Center didn\u2019t provide comment.<\/p>\n<p>\u00a0In June 1990, then-Sen. Joe Biden <a href=\"https:\/\/youtu.be\/q60NoOQco20\">introduced the Violence Against Women Act<\/a>, later described as a <a href=\"https:\/\/obamawhitehouse.archives.gov\/1is2many\/about\">\u201clandmark piece of legislation.\u201d<\/a> It may have been written with good intentions, but the legislation\u2014and billions of dollars doled out in grants by the <a href=\"https:\/\/www.justice.gov\/ovw\">U.S. Justice Department<\/a>\u2014laid the groundwork for the fundamental flaw that led to the Depp v. Heard defamation: the false binary of women as victims and men as abusers.<\/p>\n<p>In 1991, in my first years in the newsroom, Anita Hill <a href=\"https:\/\/www.npr.org\/2021\/09\/28\/1040911313\/anita-hill-belonging-sexual-harassment-conversation\">accused Supreme Court nominee Clarence Thomas <\/a>of sexual harassment, breaking new ground for accusing men without a legal finding.<\/p>\n<p>While training in 2003 as a volunteer for a domestic violence shelter, I was shocked by the anti-male narrative of the work. As a feminist who has advocated for women\u2019s rights in my Muslim community, I know \u2013 as a woman, a \u201csurvivor\u201d of domestic violence, and mother of a son \u2013 that humanity is not served if defeating sexism hinges on demonizing men and boys.<\/p>\n<h2><strong>Phase 2: Name and Shame<\/strong><\/h2>\n<p>Influential people in powerful positions developed strong ideas about how women\u2019s rights could be parlayed for votes. In 1993, while Heard was riding horses outside Austin, Texas, Democratic operatives including a future Biden consultant Anita Dunn <a href=\"https:\/\/theintercept.com\/2021\/05\/04\/anita-dunn-ethics-disclosure-biden-skdk\/\">cofounded<\/a> SKDK. It became a PR machine for multimillion-dollar enterprises like \u201cTime\u2019s Up,\u201d Black Lives Matter, and L\u2019Or\u00e9al (which later made Heard an \u201cambassador\u201d).<\/p>\n<p>In 2009, when Heard <a href=\"https:\/\/www.insider.com\/johnny-depp-amber-heard-relationship-timeline-2020-7\">met Depp<\/a> filming \u201cThe Rum Diary,\u201d NPR and the Center for Public Integrity, a nonprofit (where I worked at the time), <a href=\"https:\/\/publicintegrity.org\/education\/sexual-assault-on-campus-shrouded-in-secrecy\/\">started publishing<\/a> investigative pieces on college sexual assault. The project included <a href=\"https:\/\/publicintegrity.org\/education\/sexual-assault-on-campus\/sexual-assault-on-campus-laura-dunn-interview-part-one-2\/\">a package<\/a> on allegations of rape from a woman, Laura Dunn, at the University of Wisconsin at Madison.<\/p>\n<p>In April 2011, as \u201cThe Rum Diary\u201d was released, the Biden administration <a href=\"https:\/\/www.youtube.com\/watch?v=Mud-pQ-NZWU\">issued a \u201cDear Colleague\u201d letter<\/a> with the support of the activists in the industry, including Dunn and Michele Dauber, a Stanford University law professor. The letter advocated for preferential treatment for women making accusations on campuses under Title IX of the national Education Amendments of 1972 law. Dauber didn\u2019t return a request for comment.<\/p>\n<p>New nonprofits emerged, like Know Your IX, in 2013. That year, a PhD student, Holly Jacobs, started <a href=\"https:\/\/www.cybercivilrights.org\/\">Cyber Civil Rights Initiative<\/a> to fight nonconsensual porn. That year another woman, Andrea Pino, alleged sexual assault at the University of North Carolina at Chapel Hill. Her claims covered the airwaves yet were <a href=\"https:\/\/reason.com\/2018\/07\/02\/a-gruesome-campus-rape-report-helped-jum\/\">years later noted<\/a> to have included \u201cimplausibilities and inconsistencies.\u201d Pino couldn\u2019t be reached for comment.<\/p>\n<p>In 2014, the White House released a report, <a href=\"https:\/\/obamawhitehouse.archives.gov\/sites\/default\/files\/docs\/sexual_assault_report_1-21-14.pdf\">\u201cRape and Sexual Assault: A Renewed Call to Action,\u201d<\/a> with one mention of \u201cmen and boys\u201d as victims. That year, Laura Dunn <a href=\"https:\/\/www.forbes.com\/sites\/devinthorpe\/2016\/09\/06\/victim-turned-victims-rights-attorney-builds-national-organization\/?sh=9ce167e3a61b\">founded nonprofit<\/a> SurvJustice Inc.<\/p>\n<p>In an interview, Dunn, <a href=\"https:\/\/lldunnlaw.com\/\">now an attorney<\/a>, recognized, \u201cThe gender narrative is very harming. I feel deep pain for male survivors who feel like they have been ignored. I don\u2019t gender survivors.\u201d She noted: \u201cI do believe in the public policy of believing survivors because we have to take it seriously when we have reports of domestic violence and rape. Our system is broken.\u201d<\/p>\n<p>She said: \u201cI\u2019m supportive of due process as an attorney. Sometimes, justice cannot be achieved through the legal process.\u201d<\/p>\n<p>In January 2015, a shocking case grabbed the headlines when Stanford University swimmer Brock Turner sexually assaulted a young woman, first called \u201cEmily Doe,\u201d then self-identifying as Chanel Miller, whose <a href=\"https:\/\/www.nytimes.com\/2018\/02\/06\/us\/stanford-rape-plaque.html\">family friend<\/a> was Dauber. Turner was <a href=\"https:\/\/www.cnn.com\/2017\/12\/02\/us\/brock-turner-sexual-assault-appeal\/index.html\">convicted<\/a> of felony sexual assault.<\/p>\n<p>The next month, thousands of miles away, Depp <a href=\"https:\/\/people.com\/celebrity\/inside-johnny-depp-and-amber-heards-private-island-wedding-ceremony-photos\/\">married<\/a> Heard.<\/p>\n<p>By November 2015, the new mantra was becoming a political slogan, with Hillary Clinton <a href=\"https:\/\/twitter.com\/HillaryClinton\/status\/668597149291184128?s=20&#038;t=ZT-Hyor__wDMBvbl-m6hhQ\">posting a message<\/a> on Twitter: \u201cEvery survivor of sexual assault deserves to be heard, believed, and supported.\u201d The issue would become a galvanizing theme in Clinton\u2019s race against Donald Trump in the next year.<\/p>\n<p>In 2017, feminist scholar Christina Hoff Sommers wrote a seminal article, \u201c<a href=\"https:\/\/www.thedailybeast.com\/the-media-is-making-college-rape-culture-worse\">The Media is Making College Rape Culture Worse,\u201d<\/a> chronicling the sloppy narrative of \u201cserial predators roaming free on college campuses\u201d and the policy changes that had enabled this hysteria.<\/p>\n<p>It was into this backdrop that Heard\u2019s marriage with Depp was falling apart. At one point in a recording played in court, <a href=\"https:\/\/twitter.com\/LillyJane916\/status\/1518836828954112000?s=20&#038;t=YUlsfIbRQzjKQ7aksCuDlg\">Heard told Depp<\/a>, \u201cI did not deck you. I f-cking was hitting you.\u201d<\/p>\n<h2><strong>Phase 3: #BelieveHer<\/strong><\/h2>\n<p>In May 2016, Heard <a href=\"https:\/\/www.tmz.com\/2016\/05\/27\/amber-heard-domestic-violence-johnny-depp-restraining-order\/\">filed<\/a> for a temporary restraining order against Depp. She catapulted to a new role as a darling of the \u201cBelieve Her\u201d industry. Depp\u2019s lawyer, Camille Vasquez, said: \u201cAmber Heard took on the role of a lifetime. That of a victim of domestic abuse.\u201d<\/p>\n<p>Heard landed on the June 2016 <a href=\"https:\/\/twitter.com\/alzinweb\/status\/1528792603172519944?s=20&#038;t=YUlsfIbRQzjKQ7aksCuDlg\">cover of People magazine <\/a>with her eyes downcast and alleged injuries to her face, behind this headline: \u201cINSIDE THEIR TOXIC MARRIAGE. Jealous fights &#038; accusations of violence.\u201d<\/p>\n<p>In mid-November 2016, Heard <a href=\"https:\/\/www.glamour.com\/video\/watch\/women-of-the-year-watch-freida-pinto-amber-heard-and-gabourey-sidibe-read-the-letters-from-stanford-sexual-assault-case-survivor-emily-doe\">read<\/a> the victim statement from \u201cEmily Doe\u201d at the <a href=\"http:\/\/amberheardfansite.blogspot.com\/2016\/11\/amber-heard-at-glamour-women-of-year.html\">Glamour<\/a> Women of the Year awards, posing for a <a href=\"https:\/\/people.com\/celebrity\/star-tracks-tuesday-november-15-2016\/?slide=5521857#5521857\">selfie<\/a> with honoree Dauber, the Stanford law professor, and actress Lena Dunham, another future <a href=\"https:\/\/www.vox.com\/culture\/2017\/11\/21\/16679078\/lena-dunham-accused-woman-lying-rape-murray-miller-aurora-perrineau\">lightning rod <\/a>in the Me Too movement. Days later, Heard <a href=\"https:\/\/www.youtube.com\/watch?v=iKFdTBi-WYM\">released a public-service announcement<\/a> against domestic abuse, with <a href=\"https:\/\/www.eonline.com\/news\/811941\/amber-heard-fights-back-tears-as-she-opens-up-about-her-own-experience-with-domestic-violence\">ENews writing<\/a> that Heard\u2019s \u201cabuse allegations against ex-husband Johnny Depp made headlines earlier this year.\u201d<\/p>\n<p>There were skeptics of this new justice, with Sommers taping a <a href=\"https:\/\/www.youtube.com\/watch?v=rtO8wUJRNIY\">video<\/a> about the \u201cdeath of the due process.\u201d A high-profile case also raised \u201cBelieve Her\u201d doubts: a <a href=\"https:\/\/www.youtube.com\/watch?v=LWDhIPwm9fg\">jury ruled<\/a> that Rolling Stone engaged in defamation with a 2014 article on an alleged rape victim at the University of Virginia, who fabricated her story.<\/p>\n<p>But now the \u201cBelieve Her\u201d industry had a new political enemy: Donald Trump. Then, in October 2017, a <a href=\"https:\/\/www.nytimes.com\/2017\/10\/05\/us\/harvey-weinstein-harassment-allegations.html\">culprit emerged<\/a>: producer Harvey Weinstein. Me Too took off.<\/p>\n<p>With the start of 2018, the \u201cTime\u2019s Up\u201d movement launched, with <a href=\"https:\/\/skdknick.com\/times-up\/\">none other than SKDK<\/a> and its bevy of Obama and Biden administration supporters aiding its PR. The National Women\u2019s Law Center Fund LLC <a href=\"https:\/\/timesupfoundation.org\/about\/our-story\/\">announced<\/a> it would run the Time\u2019s Up Legal Defense Fund, with SKDK partner Hilary Rosen a <a href=\"https:\/\/skdknick.com\/times-up\/\">cofounder<\/a>.<\/p>\n<p>In its <a href=\"https:\/\/www.documentcloud.org\/documents\/21116205-times-up-foundation-form-990-for-2020\">2020 IRS 990 filing<\/a>, Time\u2019s Up Foundation posted $18.4 million in revenue, spending $1.9 million on the legal defense fund. Former Obama staffer Valerie Jarrett served on its board and former Michelle Obama chief of staff Tina Tchen received $721,744 from the organization and related groups, according to the 990.<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"1024\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/06\/1-1024x1024-1.png\" alt=\"\" class=\"wp-image-273613\" srcset=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/06\/1-1024x1024-1.png 1024w, https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/06\/1-300x300-1.png 300w, https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/06\/1-200x200-1.png 200w, https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/06\/1-768x768-1.png 768w, https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/06\/1.png 1080w\" \/><\/figure>\n<\/div>\n<h2><strong>Phase 4: \u2018Damn the Torpedoes\u2019<\/strong><\/h2>\n<p>In September 2018, the \u201cBelieve Her\u201d juggernaut found momentum with rape accusations by Christine Blasey Ford against Supreme Court appointee Brett Kavanaugh. Kendra Barkoff Lamy, a former Joe Biden press secretary working at SKDK, <a href=\"https:\/\/skdknick.com\/position\/senior-vice-president\/\">advised Ford<\/a>.<\/p>\n<p>Ironically, Heard <a href=\"https:\/\/twitter.com\/realamberheard\/status\/1044708533986627584?s=20&#038;t=v7sa_srsiRFHR7ElsJV7Hw\">shared a column <\/a>on Biden\u2019s \u201cdisastrous Anita Hill hearing\u201d in 1991, with the message: \u201cand we wonder why victims choose to remain silent\u2026.. #BelieveWomen\u2026 #BelieveSurvivors.\u201d Who showed up in D.C. for Kavanaugh protests? Heard, who shared a photo <a href=\"https:\/\/twitter.com\/realamberheard\/status\/1047979565161897985?s=20&#038;t=V63tzng6U1ni8BdTHntF-w\">with the hashtag #Beli<\/a><a href=\"https:\/\/twitter.com\/realamberheard\/status\/1047979565161897985?s=20&#038;t=V63tzng6U1ni8BdTHntF-w\">e<\/a><a href=\"https:\/\/twitter.com\/realamberheard\/status\/1047979565161897985?s=20&#038;t=V63tzng6U1ni8BdTHntF-w\">veWomen.<\/a><\/p>\n<p>On Nov. 6, 2018, ACLU communications staffer Gerry Johnson pitched an op-ed to Heard and her publicist, Gottleib, about what else? How \u201csurvivors of gender-based violence,\u201d or \u201cGBV,\u201d were \u201cless safe under the Trump administration.\u201d Among the talking points: the alleged evil of Trump\u2019s attacks on Ford, Trump\u2019s Title IX policies, Congress\u2019s failure to reauthorize the Violence Against Women Act, and, of course, Heard\u2019s \u201cpersonal story, saying how painful it is as a GBV survivor to witness these setbacks.\u201d<\/p>\n<p>That month, Heard landed on the <a href=\"https:\/\/www.glamour.com\/story\/amber-heard-january-2018-cover-story\">cover of Glamour<\/a>, with the headline, \u201c\u2026Heard is Nobody\u2019s Victim.\u201d In one photo, Heard held the book \u201cWhite Fragility.\u201d Then, on Dec. 12, 2018, Heard PR man Sean Walsh wrote to her, clearing the op-ed: \u201cI say send it off and damn the torpedoes ahead!\u201d<\/p>\n<p>Six days later, the Washington Post <a href=\"https:\/\/www.washingtonpost.com\/opinions\/ive-seen-how-institutions-protect-men-accused-of-abuse-heres-what-we-can-do\/2018\/12\/18\/71fd876a-02ed-11e9-b5df-5d3874f1ac36_story.html\">published the fateful op-ed<\/a>, with comments on Title IX, the Violence Against Women Act, and, of course, Heard as a domestic violence survivor. The ACLU <a href=\"https:\/\/www.aclu.org\/blog\/womens-rights\/violence-against-women\/amber-heard-i-spoke-against-sexual-violence-and-faced-our\">hyped the piece<\/a>, \u201cBy Amber Heard, ACLU Ambassador for Women\u2019s Rights.\u201d In its <a href=\"https:\/\/www.aclu.org\/finances\">2020 IRS 990 filing<\/a>, ACLU Inc. reported $170.9 million in revenues.<\/p>\n<p>The narrative was set. One detail was missing: a conviction. This \u201cBelieve Her\u201d industry could only come tumbling down if someone emerged to challenge it boldly. Depp became that person.<\/p>\n<p>The hypocrisy of the \u201cBelieve Her\u201d industry emerged in summer 2021, when Time\u2019s Up chairwoman Roberta Kaplan \u2013 who had <a href=\"https:\/\/theblast.com\/c\/johnny-depp-amber-heard-lawyer-drops-out-roberta-kaplan-times-up-withdraw-virginia-defamation-case\">stepped down<\/a> as Heard\u2019s attorney in the Depp case \u2013 <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/time-s-leader-roberta-kaplan-resigns-after-criticism-reportedly-aiding-n1276337?cid=sm_npd_nn_tw_mtp\">resigned<\/a> after the New York attorney general alleged that she assisted New York Gov. Andrew Cuomo as he faced sexual harassment charges. After the verdict was announced, Stanford lawyer Dauber, who has mocked Depp as a \u201cdrunken, drugged fake pirate,\u201d <a href=\"https:\/\/twitter.com\/mldauber\/status\/1532456329859973120?s=20&#038;t=gY7nH9hbWD97O9BT02iNNw\">shared a photo<\/a> from the 2016 Glamour awards that launched Heard in the #BelieveHer industry, writing: \u201c#istandwithamberheard and with all survivors, without exception, period\u2026@LeaveHeardAlone.\u201d<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><\/figure>\n<p>Of course, to the \u201cBelieve Her\u201d industry, there is an exception: Depp and any who defy their presumption of guilt. Fortunately, the verdict is in. \u201cBelieve Her\u201d lost.
