In the suit, he claims his song got extensive airplay during the 1993 holiday season, a year before Carey released hers. <\/p>\n<p>The Scrooge is suing the \u201cObsessed\u201d singer for $20 million in damages.<\/p>\n<p>\u201cPlaintiff [Stone] personally requested that Defendants [Carey and Afanasieff] cease and desist from further distribution of Plaintiff\u2019s work,\u201d the suit reads in part. \u201cDespite Plaintiff\u2019s request, Defendants continue to exploit Plaintiff\u2019s work \u2018All I Want for Christmas is You,\u2019 reaping tremendous financial awards and other pecuniary benefits to the detriment of Plaintiff.\u201d<\/p>\n<figure class=\"wp-block-image size-large\"><a href=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/06\/mariah-carey-christmas-split-1-copy.jpg\"><\/a><figcaption>Carey is being sued for $20 million for her perennial holiday hit \u201cAll I Want for Christmas Is You.\u201d Andy Stone, who co-wrote a country song of the same title, is alleging copyright infringement. Right: A still from the music video for Stone-written tune.<\/figcaption><figcaption><span class=\"credit\">FilmMagic; Vince Vance and the Valiants<\/span><\/figcaption><\/figure>\n<p>According to the documents, Carey and Afanasieff \u201cknowingly, willfully and intentionally engaged in a campaign to infringe [Stone\u2019s] copyright in the work \u2026 to the commercial gain, personal profit and unjust enrichment of the defendants and the irreparable injury and financial loss\u201d of Stone.<\/p>\n<p>Carey\u2019s representative declined to comment when contacted by The Post.  <\/p>\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-4-3 wp-has-aspect-ratio\">\n<p>\n<span class=\"embed-youtube\">[embedded content]<\/span>\n<\/p>\n<\/figure>\n<p>Decades later, streams and radio airplay of Carey\u2019s \u201cAll I Want For Christmas Is You\u201d continue to stuff her stocking full of cash. The song has over a billion streams on Spotify alone.  <\/p>\n<p>According to the lawsuit, Stone is a self-employed artist in the business of performing, selling and licensing his copyrighted music and earns his livelihood from fees received from these activities.<\/p>\n<figure class=\"wp-block-image size-large\"><a href=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/06\/mariah-carey-music-video-06.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"682\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/06\/mariah-carey-music-video-06.jpg\" alt=\"Mariah Carey&#039;s \" All I Want For Christmas Is You \/><\/a><figcaption>Carey\u2019s \u201cAll I Want For Christmas Is You\u201d is the ultimate gift that keeps on giving, reportedly putting millions into her bank account every year.<\/figcaption><figcaption><span class=\"credit\">Mariah Carey<\/span><\/figcaption><\/figure>\n<h2>Read the full lawsuit below. <\/h2>\n<figure class=\"wp-block-embed is-type-rich is-provider-scribd wp-block-embed-scribd\"><\/figure>\n<p>Carey\u2019s Christmas song <a href=\"https:\/\/nypost.com\/2020\/12\/25\/mariah-carey-all-i-want-for-christmas-is-you-breaks-spotify-record\/\">reached No. 1<\/a> on the Billboard Top 100 chart around the holiday in 2019 and 2020.\u00a0<\/p>\n<p>The song set Spotify\u2019s most streamed track on Spotify in 24 hours (female) record in 2019 \u2014 then <a href=\"https:\/\/nypost.com\/2020\/12\/25\/mariah-carey-all-i-want-for-christmas-is-you-breaks-spotify-record\/\">beat it again in 2020<\/a>, <a href=\"https:\/\/www.guinnessworldrecords.com\/world-records\/462476-most-streamed-track-on-spotify-in-24-hours-female\" target=\"_blank\" rel=\"noreferrer noopener\">according to Guinness World Records<\/a>.\u00a0<\/p>\n<p>\u201cWOW,\u201d <a href=\"https:\/\/twitter.com\/MariahCarey\/status\/1342536443751763975\" target=\"_blank\" rel=\"noreferrer noopener\">Carey tweeted<\/a> in 2020. \u201cI know people think I\u2019m making \u201ccoin\u201d (lil\u2019 secret: artists make very little from streams) but the real reason I\u2019m sitting here in astonishment &#038; gratitude is seeing the joy this little song I wrote brings to people. THANK YOU &#038; MERRY CHRISTMAS!!!\u201d<\/p>\n<p>When they got together in the summer of 1994 to write songs for the album \u201cMerry Christmas,\u201d Afanasieff and Carey carved out the chords, structure and melody for \u201cAll I Want for Christmas Is You\u201d <a href=\"https:\/\/nypost.com\/2014\/12\/13\/8-things-you-didnt-know-about-all-i-want-for-christmas-is-you\/\" target=\"_blank\" rel=\"noreferrer noopener\">in just 15 minutes<\/a>. <\/p>\n<p>\u201cIt\u2019s definitely not \u2018Swan Lake,\u2019\u2009\u201d Afanasieff admitted. \u201cBut that\u2019s why it\u2019s so popular \u2014 because it\u2019s so simple and palatable!\u201d<\/p>\n<p>He also said he hasn\u2019t heard from the \u201cHoney\u201d singer since they worked on her 1997 album \u201cButterfly,\u201d after which she decided to explore a more R&#038;B-influenced direction.<\/p>\n<p>\u201cIt\u2019s a shame because we had great chemistry,\u201d Afanasieff said. \u201cMy greatest dream is to work with her again.
