The nation would probably take Joe Biden\u2019s gun demagoguery more seriously if the president and his staff occasionally cooked up some new material. Because last night\u2019s <a href=\"https:\/\/www.nytimes.com\/2022\/06\/02\/us\/politics\/biden-speech-transcript-gun-control.html\" target=\"_blank\" rel=\"noreferrer noopener\">plea<\/a> for more gun control was a rehashing of the same archaic policy ideas, bad analogies, and lies that Democrats tend to drop after every shooting.<\/p>\n<h2>The Second Amendment Isn\u2019t \u2018Absolute\u2019<\/h2>\n<p>The president, as he always does, began with a strawman. The Second Amendment, Biden claimed, \u201clike all other rights, is not absolute.\u201d (<em>All<\/em>? Fans of the 13th Amendment might find this a bit surprising.) There are, of course, already tens of thousands of laws governing individual gun ownership in the United States. More laws and regulations exist restricting the Second Amendment than any other right in the Constitution, and it\u2019s not particularly close. \u201cVoting rights\u201d advocates treat photo ID laws as if they were tantamount to fascism. Well, practicing your right to self-defense is contingent on an FBI background check.<\/p>\n<p>Indeed, the notion that gun ownership is \u201cabsolute\u201d would not mesh with the experiences of those living in a blue city like Baltimore, (<a href=\"https:\/\/www.cbsnews.com\/pictures\/murder-map-deadliest-u-s-cities\/\">58.27 homicides per 100,000<\/a>), Washington D.C. (23.52), or Chicago (18.26), where, despite the <em><a href=\"https:\/\/www.supremecourt.gov\/opinions\/07pdf\/07-290.pdf\">Heller<\/a> <\/em>and <em><a href=\"https:\/\/www.supremecourt.gov\/opinions\/09pdf\/08-1521.pdf\">McDonald<\/a> <\/em>decisions further codifying the individual right to own firearms, legally purchasing a handgun remains unconstitutionally challenging.<\/p>\n<h2>Banning Assault Weapons<\/h2>\n<p>Biden quoted Justice Scalia\u2019s majority opinion in <em>Heller<\/em>, saying, \u201cIt was Justice Scalia who wrote, and I quote: \u2018Like most rights, the right Second Amendment \u2014 the rights granted by the Second Amendment are not unlimited.\u2019 Not unlimited. It never has been.\u201d (Thankfully, he spared us his historically illiterate diatribes on <a href=\"https:\/\/www.nationalreview.com\/corner\/sorry-mr-president-but-americans-could-always-buy-cannons\/\">cannons<\/a>, \u201c<a href=\"https:\/\/www.nationalreview.com\/corner\/re-deer-in-kevlar\/\">deer in Kevlar<\/a>,\u201d and \u201c<a href=\"https:\/\/lawandcrime.com\/second-amendment\/biden-flubs-the-constitution-and-mischaracterizes-other-laws-while-touting-gun-reform-measures\/\">yelling fire in a crowded theater<\/a>.\u201d)<\/p>\n<p>Democrats habitually isolate this line from <em>Heller<\/em>, a decision they simultaneously contend catastrophically concocted an individual right to firearm ownership. But Scalia\u2019s line, read <em>in context of the decision\u2019s finding <\/em>that the Second Amendment protects a right to possess a firearm unconnected from militia service, only upholds the legality of states limiting \u201cdangerous and unusual weapons,\u201d not weapons \u201cin common use\u201d by \u201claw-abiding citizens.\u201d The AR-15, and similar rifles, easily meet the latter criteria. It is not only the most popular rifle in the nation, it is one of the types of firearms <em>least<\/em> <a href=\"https:\/\/fee.org\/articles\/are-ar-15-rifles-a-public-safety-threat-heres-what-the-data-say\/\">used<\/a> in criminality. Which is why Democrats try to convince the public that AR-15s are \u201cweapons of war,\u201d and thus exceptionally \u201cdangerous and unusual.\u201d This is simply wrong. AR-15s are less a weapon of war than a <a href=\"https:\/\/www.military.com\/daily-news\/2019\/07\/09\/armys-new-9mm-handgun-finally-approved-full-material-release.html\">9mm handgun<\/a> (which, earlier this week, the president <a href=\"https:\/\/www.foxnews.com\/politics\/biden-targeting-9mm-pistols-gop-lawmakers-react\">suggested<\/a> should be banned, as well).<\/p>\n<p>Moreover,<em> Heller<\/em> found prohibition on an entire class of \u201carms\u201d Americans \u201coverwhelmingly choose\u201d to be unconstitutional. So, the notion that Scalia would support outlawing semi-automatic rifles \u2014 whose mechanisms are virtually the same as most firearms \u2014 is risible. In fact, I\u2019m not sure that existing \u201cassault weapons\u201d bans wouldn\u2019t be (rightfully) stuck down if they were challenged before the Supreme Court.<\/p>\n<p>Biden also made the debatably claim that in the decade the \u201cassault weapon\u201d ban was in force, mass shootings went down. \u201cBut after Republicans let the law expire in 2004, and those weapons were allowed to be sold again, mass shootings tripled,\u201d Biden said. \u201cThose are the facts.\u201d You won\u2019t be surprised to learn that they\u2019re not.<\/p>\n<p>Unmentioned by Biden is the fact that after the \u201cassault weapon ban\u201d sunset in 2004, gun crimes kept precipitously dropping. In the 15 years immediately following the sunsetting, overall <a href=\"https:\/\/crime-data-explorer.app.cloud.gov\/pages\/home\">homicides<\/a> fell 10 out of 15 years. Twenty-one years after gun violence peaked in 1993, and a decade after the assault weapon ban ended, homicides by firearms hit <a href=\"https:\/\/bjs.ojp.gov\/content\/pub\/pdf\/htius.pdf\">the lowest point<\/a> since 1976. By that time, the AR-15 had become the most popular rifle in the country. (A 1999 Justice Department study also <a href=\"https:\/\/www.ojp.gov\/pdffiles1\/173405.pdf\">found<\/a> that the ban failed \u201cto reduce the average number of victims per gun murder incident or multiple gunshot wound victims.\u201d)<\/p>\n<p>And, though Republicans may have let the <a href=\"https:\/\/www.nationalreview.com\/2019\/08\/democratic-dishonesty-on-assault-weapon-bans\/\">law expire in 2004, as John McCormack<\/a> has pointed out, Harry Reid didn\u2019t bring an assault weapon ban to the floor of the Senate until 2013, after the Newtown massacre. At the time, Democrats controlled the Senate, and 16 of their senators voted against the bill, including Michael Bennet, Joe Manchin, and Jon Tester. Do the Democrats even have 50 votes for a ban?<\/p>\n<h2>Raising the Age to Purchase an AR-15 from 18 to 21<\/h2>\n<p>This is less about mendaciousness than it is about contemporary liberalism being a giant game of Calvinball. Numerous high-profile Democrats <a href=\"https:\/\/thehill.com\/homenews\/house\/434115-pelosi-says-she-backs-lowering-voting-age-to-16\/\">support<\/a> the idea of allowing 16-year-olds to participate in the most vital, <em>sacred<\/em>, indispensable rite of democracy: voting. Then again, when it comes to government-mandated health care insurance, they believe that Americans should be treated like children until they\u2019re 26-year-olds. But they also seem perfectly fine with 18-year-olds joining the Armed Forces \u2014 but not with the same men and women buying a drink or practicing the right to self-defense.<\/p>\n<p>In the real world, maturity differs from person to person, from place to place. The <a href=\"https:\/\/rockinst.org\/gun-violence\/mass-shooting-factsheet\/\">average age<\/a> of the mass shooter, after all, is 33. But if we\u2019re going to come up with an arbitrary year that marks the beginning of adulthood, it should remain consistent. If you\u2019re ready to vote you\u2019re ready to practice all your rights. Of course, the notion that the founders would have been shocked by an 18-year-old carrying a firearm \u2014 a claim I get a lot \u2014 is also nonsense. The \u201c<a href=\"https:\/\/www.barnesandnoble.com\/w\/teenage-jon-savage\/1100626531\">teenager<\/a>\u201d is a 20th-century invention. In the 19th century, you were a child and then you were an adult. And adulthood began early. <\/p>\n<p>(Biden\u2019s contention that firearms \u201care the number one killer of children in the United States of America \u2026 more than car accidents, more than cancer,\u201d is, as Brad Polumbo <a href=\"https:\/\/www.based-politics.com\/2022\/06\/03\/child-gun-deaths-biden-pushes-false-claim-in-gun-control-speech\/\">notes<\/a>, also quite misleading.)<\/p>\n<h2>Repealing Gun Manufacturers\u2019 Immunity from Liability<\/h2>\n<p>Gun manufacturers, says the president, \u201care the only industry in this country that has that kind of immunity.\u201d This is a perniciously stupid lie. Gun manufacturers do not hold any special protections. If a firearm malfunctions due to shoddy design or subpar production, or if gun maker misleads consumers, they, like every other manufacturer in the nation, can be sued. If guns work correctly but are used in illegal acts, they, like every other industry, can\u2019t. In the same way, an SUV maker isn\u2019t liable when a killer intentionally <a href=\"https:\/\/www.cnn.com\/2021\/11\/22\/us\/wisconsin-christmas-parade-suv-into-crowd-what-we-know\/index.html\">plows<\/a> into a crowd of people killing six people, and neither is a manufacturer when someone uses a baseball bat and a knife to <a href=\"https:\/\/people.com\/crime\/man-charged-with-murder-after-police-say-he-killed-three-coworkers-with-baseball-bat-and-knife\/\">murder<\/a> three of his coworkers.<\/p>\n<p>Biden went on to say, \u201cImagine. Imagine if the tobacco industry had been immune from being sued, where we\u2019d be today. The gun industry\u2019s special protections are outrageous. It must end.\u201d It\u2019s revealing that Biden, who claims to respect \u201cthe culture and the tradition and the concerns of lawful gun owners,\u201d compares cigarettes to a constitutionally protected right. One of these two products could be banned tomorrow if politicians so desired.
