In the hours after the announcement, Tesla <a href=\"https:\/\/www.cnbc.com\/2018\/08\/07\/tesla-says-no-final-decision-has-been-made-to-take-company-private.html\">share prices surged<\/a> more than 10% \u2014 even though Tesla later said that a final decision had not been made.<\/p>\n<p>Federal officials filed two civil actions in September 2018 over the \u201cmaterially false and misleading statements,\u201d according to the SEC. After Musk and Tesla paid a total of $40 million in civil penalties to the agency, the SEC created a \u201cFair Fund\u201d in 2020 to distribute the money to people who bought shares between the time of Musk\u2019s tweet on August 7, 2018, and market close the following day.<\/p>\n<p>\u201cTesla failed to implement adequate procedures or controls for determining whether to disclose the information Musk disseminated on Twitter in its filings,\u201d the SEC said in reference to its civil actions.<\/p>\n<p>Musk\u2019s legal team has contended that the SEC is trying to discourage the billionaire\u2019s free speech by subpoenaing Tesla regarding his social media use. Beyond Tesla, the SEC is currently <a href=\"https:\/\/www.dailywire.com\/news\/feds-confirm-investigation-into-elon-musk\">investigating<\/a> Musk for allegedly failing to properly report his stake in Twitter within 10 days of meeting the relevant ownership threshold.<\/p>\n<p>Musk\u2019s counsel <a href=\"https:\/\/www.dailywire.com\/news\/elon-musk-accuses-federal-agency-of-harassment-trying-to-chill-his-free-speech\">wrote<\/a> in February that Tesla thought settling the charges would conclude the SEC\u2019s \u201charassment\u201d of Musk, asserting that \u201cthe SEC has broken its promises\u201d and is now \u201cweaponizing the consent decree by using it to try to muzzle and harass\u201d Musk and Tesla.<\/p>\n<p>\u201cThe SEC\u2019s outsized efforts seem calculated to chill his exercise of First Amendment rights rather than to enforce generally applicable laws in evenhanded fashion,\u201d the filing explained.<\/p>\n<p>The SEC, however, believes that its conduct was <a href=\"https:\/\/www.dailywire.com\/news\/sec-responds-to-elon-musks-accusation-of-harassment\">consistent<\/a> with its management of the settlement. \u201cThe commission\u2019s enforcement staff have \u2026 sought to meet and confer with counsel for Tesla and Mr. Musk to address any concerns regarding Tesla and Mr. Musk\u2019s compliance,\u201d senior SEC official Steven Buchholz wrote in a February letter to a Manhattan federal judge.<\/p>\n<p>A Thursday email from Musk to Tesla executives <a href=\"https:\/\/www.dailywire.com\/news\/elon-musk-has-a-super-bad-feeling-about-the-economy-wants-a-massive-layoff-at-tesla\">revealed<\/a> that he wants to cut 10% of jobs at the company due to a \u201csuper bad feeling\u201d about the economy. Musk instructed Tesla to \u201cpause all hiring worldwide.\u201d<\/p>\n<p>Musk has also <a href=\"https:\/\/www.dailywire.com\/news\/elon-musk-explains-why-possible-recession-a-good-thing-predicts-how-long-it-could-last\">contended<\/a> that a recession would \u201cactually be a good thing\u201d since \u201cit has been raining money on fools for too long.\u201d He added that the \u201cstay-at-home stuff has tricked people into thinking that you don\u2019t actually need to work hard\u201d \u2014 prompting a \u201crude awakening.\u201d<\/p>\n<p>The layoff message was sent two days after Musk <a href=\"https:\/\/www.dailywire.com\/news\/musk-remote-work-is-no-longer-acceptable-at-tesla\">said in another email<\/a> that \u201cremote work is no longer\u201d acceptable at Tesla.<\/p>\n<p>\u201cIf there are particularly exceptional contributors for whom this is impossible, I will review and approve those exceptions directly,\u201d he noted, adding that employees must work from \u201ca main Tesla office, not a remote branch office unrelated to the job duties, for example being responsible for Fremont factory human relations, but having your office in another state.\u201d<\/p>\n<p>A Twitter commenter asked for a response from people who believe \u201ccoming into work is an antiquated concept.\u201d Musk replied: \u201cThey should pretend to work somewhere else.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The US Securities and Exchange Commission (SEC) will reimburse certain people who bought Tesla stock immediately after CEO Elon Musk tweeted in 2018 that he would take the company private, according to a Friday press release from the agency.
