Califf as defendants.<\/p>\n<p>In the filing, plaintiffs Mary Talley Bowden, Paul E. Marik, and Robert L. Apter <a href=\"https:\/\/boydengrayassociates.com\/complaint-in-apter-v-hhs-no-322-cv-184-s-d-tx-june-2-2022-2\/\">argued <\/a>that by publicly ordering health professionals and patients to avoid ivermectin, the FDA both acted outside of its authority and inhibited the doctors\u2019 ability to practice medicine.<\/p>\n<p>Though the FDA has approved ivermectin to treat certain infections, the department has urged the public not to use the drug to treat COVID-19. Neither HHS nor the FDA \u00a0immediately responded requests for comment for this story.<\/p>\n<p>\u201cAttempts by the FDA to influence or intervene in the doctor-patient relationship\u00a0amount to interference with\u00a0the practice of medicine, the regulation of which is\u2014and always has\u00a0been\u2014reserved to states,\u201d the lawsuit said. \u201cThe FDA breached this critical boundary between federal and state authority by directing the public, including health professionals and patients, not to use ivermectin to treat COVID-19, even though the drug remains fully approved for human use.\u201d<\/p>\n<p>The filing emphasizes that the case is not about the efficacy of ivermectin in treating COVID-19: rather, it said,\u00a0\u201cit\u2019s about who determines the appropriate treatment for each unique patient and whether the FDA can interfere with that process.\u201d<\/p>\n<p>\u201cSince the pandemic began, I have had one mission \u2013 help my patients,\u201d Bowden said following the filing. \u201cI provided access to testing when testing was hard to find. I provided treatment when other doctors told my patients to stay home. I have kept over 3,900 patients out of the hospital, but it hasn\u2019t been easy.\u201d<\/p>\n<p>Bowden was \u201cderided by Houston Methodist Hospital and forced to\u00a0resign her privileges there as a result\u201d of her ivermectin recommendations for treating COVID-19, the lawsuit said, stating that Bowden treated over 3,900 patients for COVID-19 \u201cwith a success\u00a0rate over 99.97%.\u201d<\/p>\n<p>\u201cSadly, fighting the system has been a much bigger challenge than fighting the disease,\u201d she continued. \u201cDespite my excellent track record treating COVID patients, the FDA\u2019s smear campaign against ivermectin continues to be a daily hurdle to overcome. I am fighting back \u2013 the public needs to understand what the FDA has done is illegal, and I hope this suit will prevent \u2018them from continuing to interfere in the doctor-patient relationship.\u201d<\/p>\n<p>The lawsuit cites a slew of FDA warnings not to use ivermectin, including an August 2021 tweet saying, \u201cYou are not a horse. If the\u00a0FDA is not limited to its statutory lane, its unlawful actions\u00a0will no doubt persist and repeat themselves.\u201d<\/p>\n<p>\u201cMoreover,\u201d the filing continues, \u201cif the FDA is allowed to interfere with the practice of medicine now\u00a0under cover of a pandemic, this interference will metastasize to other circumstances, destroying\u00a0the carefully constructed statutory wall between\u00a0federal and state regulatory powers, and between\u00a0the FDA and the professional judgment of health professionals.\u201d<\/p>\n<p>Dr. Apter, who is licensed to practice medicine in Arizona and Washington and is a certified Diplomate of the American Board of Emergency Medicine according to the doctor\u2019s law firm, argued in a statement following the filing that \u201cmany thousands more deaths and serious disabilities will be averted\u201d if doctors are freed to \u201ctreat patients according to their best judgment and unprejudiced evaluation of the medical literature.\u201d<\/p>\n<p>\u201cPronouncements from the FDA against the use of ivermectin have been the basis for disciplinary actions against doctors, interfere with the doctor-patient relationship, and have had a severe chilling effect on the use of life-saving medication for a deadly disease,\u201d he added.<\/p>\n<p>According to the lawsuit, Apter was referred to the Washington Medical Commission and Arizona Medical Board for disciplinary proceedings after he prescribed ivermectin to treat COVID-19.<\/p>\n<p>\u201cThe\u00a0referrals include copies of the FDA\u2019s publications directing against the use of ivermectin to treat\u00a0COVID-19,\u201d the lawsuit said. \u201cHe explains that state regulatory boards rely heavily on pronouncements from the\u00a0FDA.\u201d<\/p>\n<p>Apter had completed over 6,000 coronavirus patient consultations through MyFreeDoctor.com with a patient survival rate of more than 99.98%, according to the filing, which notes that \u201che has frequently prescribed ivermectin to these patients, finding the treatment effective.\u201d<\/p>\n<p>The filing describes how Dr. Marik, a highly distinguished critical care specialist who has practiced for decades, developed a protocol for Eastern Virginia Medical School for treating COVIVD-19 called the EVMS COVID-19 Management Protocol.
